Trennungstatbestand

English translation: as per the statutory definition of separation

German to English translations [PRO]
Law/Patents - Law: Contract(s) / Scheidungsfolgenvereinbarung
German term or phrase: Trennungstatbestand
... leben seit ... im Sinne des gesetzlichen *Trennungstatbestandes* voneinander getrennt.

Es geht um das Jahr des Getrenntlebens vor einer Scheidung, aber wie lässt sich das formulieren?
"fact of separation" - "period of separation"?

"Legal separation" is wrong, it is not about a legalized separation but about the period of separation before a divorce is granted.

Thank you so much!

English translation:as per the statutory definition of separation
Explanation:
Have been separated since...as per the statutory definition of separated (separation)

There's no neat noun phrase for that in English. You have to translate more of that sentence.

Legal Grounds: States generally recognize two legal grounds for divorce: (1) irreconcilable differences and (2) separation.

This is not the same as the waiting period, which is the necessary delay after you've filed.

This is what Australia has to say on the subject:
Divorce

In order for a divorce to be granted in Australia, two main criteria must be satisfied:

That there is no reasonable likelihood of reconciliation; and
That the parties to the marriage have been separated for at least 12 months.

de facto element (ingredient) of separation

Explanation:
In ENG criminal law, Tatbestand would be called the 'actus reus', as opposed to the 'mens rea', namely the intent.

There may not 'in fact' be an intentional split cf. the erstwhile (?) phenomenon of 'living apart together' in the Netherlands.

NB Linguee > der Tatbestand

Examples:
subjektiver Tatbestand m (law)—mens rea AE/BE n (Latin)
objektiver Tatbestand m—*physical elements* of the offence n (mental, offense [Am.])

Example sentence(s):
  • Legal separation (sometimes judicial separation, separate maintenance, divorce a mensa et thoro, or divorce from bed-and-board) is a legal process by which a married couple may formalize a de facto separation while remaining legally married-.

Reference: Separation requirements in the UK

Reference information:
It's probably a [statutory] "separation period" or "separation requirement" in the UK, too - as distinct from "legal separation".

Here is what the law says:
Matrimonial Causes Act 1973

The court hearing a petition for divorce shall not hold the marriage to have broken down irretrievably unless the petitioner satisfies the court of one or more of the following facts, that is to say—
(a) [adultery]
(b) [behaviour]
(c) [desertion]
(d) that the parties to the marriage have lived apart for a continuous period of at least two years immediately preceding the presentation of the petition (hereafter in this Act referred to as “two years’ separation”) and the respondent consents to a decree being granted;
(e) that the parties to the marriage have lived apart for a continuous period of at least five years immediately preceding the presentation of the petition (hereafter in this Act referred to as “five years’ separation”).
