Does this mean job allowance or am I mistaken?

As in "Monetary amount that needs to be spent by the Respondent in order for him to be able to earn an income on the job, deducted from the Düsseldorf Table amount of his reported income taken as the basis of calculating the maintenance he owes her for raising the children (child support), deducted from his reported income by way of an allowance (Pauschalbetrag) so as to arrive at the final amount used to perform the maintenance assessment"?

My context:
Der Beklagte schuldet über den anerkannten Betrag hinaus den Kindesunterhalt in der titulierten Höhe ab 01.07.2006.
Der Beklagte verfügte in 2006 über ein durchschnittliches Nettoeinkommen von 2.750 USD, das entspricht bei einem Wechselkurs von 1/1.20 zwischen Juli und Dezember 2006 einem Betrag von XXX EUR.
Er ist damit nach Abzug des 5 %igen ***Erwerbsaufwands*** in Gruppe 9 der Düsseldorfer Tabelle einzustufen und schuldet Kindesunterhalt in Höhe von 160 % des Regelbetrags.
Die Trennungs- und Scheidungsvereinbarung steht einer Verurteilung des Beklagten zu einem über 150 % des Regelbetrags hinausgehenden Kindesunterhalt nicht entgegen, da gemäß § 1614 BGB für die Zukunft auf den Kindesunterhalt nicht verzichtet werden kann und die Vereinbarung insoweit nichtig ist.

Anwendung der Düsseldorfer Tabelle

Um ermitteln zu können, in welcher Höhe der Unterhaltspflichtige Unterhalt zahlen muss, ist es erforderlich das Nettoarbeitseinkommen sowie das Alter des unterhaltsbedürftigen Kindes zu kennen. Im Übrigen ist bei der Bestimmung des Nettoeinkommens des Barunterhaltspflichtigen wie es die Düsseldorfer Tabelle benennt, zu beachten, dass es sich bei diesem Betrag nicht zwingend um den tatsächlichen Auszahlungsbetrag, den der Unterhaltspflichtige aus Arbeitseinkommen erzielt, handeln muss. Vielmehr ist dieser zunächst sozusagen zu um eine Pauschale von 5% bereinigen (also zu kürzen).

Hintergrund ist, dass mit dieser Pauschale die Arbeitsmittel- bzw. kosten wie Fahrtkosten, Berufskleidung etc. abgedeckt werden sollen. Diese Pauschale gilt selbstverständlich nicht für Erwerbslose oder Rentner / Pensionäre.

Auch im Zusammenhang mit Ehegattenunterhalt ist eine 5%-ige Pauschale für berufsbedingte Aufwendungen abzugsfähig. Darüber hinaus können im Zusammenhang mit Ehegattenunterhalt unter Umständen des Einzelfalles auch ehebedingte Schulden abzugsfähig sein.
Erst der sich nach Bereinigung von abzugsfähigen Positionen ergebende Betrag ist ausschlaggebend für die Einstufung in die jeweilige Einkommensgruppe der Düsseldorfer Tabelle.

Im Zusammenhang mit Kindesunterhalt ist für die Bestimmung des Unterhaltsbetrages ausschließlich das (bereinigte) Einkommen des Unterhaltspflichtigen maßgeblich, auch dann, wenn beispielsweise die Kindesmutter, bei der das Kind lebt, höhere Eigeneinkünfte erzielt als der unterhaltspflichtige Kindesvater.

neutral  philgoddard: I don't agree that "allowance" is ambiguous, and Stuart and Aida quite rightly put it in brackets.//Nothing to do with accountancy. It's an allowance that reduces his income for child support purposes.

  -> Paradoxically, bracketing allowance makes the sentence read different ways. Perhaps you, as an accountant, can enlighten us as to what the term then means in this context: a tax deduction or a reimbursement of expenses.
