German to English translations [PRO]
Law/Patents - Law (general) / Ablehnung eines Asylantrags
German term or phrase: Offensichtlichkeitsurteil
Text of court decision:
Mit Bescheid vom 6. Juli 2020 lehnte das Bundesamt die Anträge auf Zuerkennung der Flüchtlingseigenschaft (Nr. 1), auf Asylanerkennung (Nr. 2) und auf subsidären Schutz (Nr. 3) als offensichtlich unbegründet ab.

In another section it continues:

Does anyone have a good translation for Offensichtlichkeitsurteil?
Thanks in advance!

According to Article 16a (4) of the Basic Law (GG), Section 36 (4) of the Asylum Act, the administrative court may order the suspension of deportation if there are serious doubts about the legality of the challenged administrative act - in particular about the Federal Office's judgment/decision declaring the *the obvious unfoundedness" of the claim*.

If the BAMF rejects your asylum application, you will be asked to leave Germany. Refugees who receive a 'simple' rejection ('einfachen Ablehung') have 30 days to depart. You may receive a 'simple' rejection if no other European country is responsible for your asylum application (Dublin regulation) and the BAMF does not assume you intend to deceive them or have economic motives for your flight. If your application for asylum is rejected as 'inadmissible' ('unzulässig') or 'obviously unfounded' ('offensichtlich unbegründet'), you only have one week to voluntarily leave Germany.

As to the latter type, two categories are particularly relevant to my research: (a) compliance with the Geneva Convention (‘motives which don’t qualify for asylum’), and (b)evidence indicating persecution (‘obvious unfoundedness’). The latter criterion implies that the credibility of the case has to be assessed.

->  Thank you. ”summary judgment” (Urteil im Schnellverfahren) is a procedural device in civil law proceedings, while "Offensichtlichkeit" , given the asker’s context, clearly refers to a specific Asylum Law provision.

neutral  AllegroTrans: I think your explanation and research are sound but this wording is too clunky

-> The German term refers to the specific wording of a specific German law and an accurate translation should reflect that. I prefer “clunky” wording over a short and snappy term that is plain wrong in this context.

summary judgment

Explanation:
A party moving (applying) for summary judgment is attempting to avoid the time and expense of a trial when, in the moving party's view, the outcome is obvious. Typically this is stated as, when all the evidence likely to be put forward is such that no reasonable factfinder could disagree with the moving party, summary judgment is appropriate.

offensichtlich unbegründet = manifestly unfounded

You’re welcome. Peter Lautz is doubly determined that you should chose the long definition over the translation, although I’m not sure exactly how he sees this being shoe-horned into the context where the term occurs: “insbesondere am *Offensichtlichkeitsurteil* des Bundesamts”

My learned friends on the bench opposite maintain that ‘summary judgement’ is a term restricted to civil law. In fact, the use of ‘summary’ to describe an ‘arrest’ ‘conviction’ or ‘offence’ extends to the criminal law. The same objection could be raised to the use of ‘claim’ which is most often associated with a civil case involving damages.
In this case, we have the summary dismissal of an application on the grounds that it was manifestly unfounded. Yes, ‘unfoundedness’ can be found on a web search, but it is about as elegant as ‘undismissableness’.

Hi there, Vera, and thanks for the extensive closing comments – something that very few askers here are willing to provide. What are we to surmise from the cryptic reference to Canada?

Notes to answerer
Asker: That seems to be what I am looking for - Thank you, Lancashireman!

Asker: In light of the specific type of judgment, I have decided on Johanna's response instead - it may be longer, but more accurate for the purpose of explaining the decision rendered in the German legal system to a Canadian audience. Thanks for your contribution and discussion!

agree  Adrian MM.: assuming this is shorthand for a Bundesamt 'preliminary determination on the ostensible merits > or demerits' rather than court judgment.
6 hrs

disagree  Peter Lautz: summary judgment obviates a full trial, other than in most proceedings in Germany. Summary judgment may be given if costs would be disproprortionate with regard to the matter in issue; there is no such rule in German law.
16 hrs
-> Asker: "Does anyone have a good translation for Offensichtlichkeitsurteil?" To paraphrase PL: “There is no such rule in UK/US law.” So what comes closest? The gap in the text does not allow for a long-winded unpacking of the term.

neutral  AllegroTrans: Summary judgment in an asylum case seems the wrong term
