Zwangsmittelbeschlüsse coercive rulings Explanation: The Hanseatic Higher Regional Court had apparently ruled that coercive measures be imposed upon the party concerned in order to get them to do the needful, i.e. comply with the previous judicial order and carry out the actions requested by court X. "Petitions under this section must be limited to matters involving conduct or activity regulated by the Commission under statutes administered by the Commission. The procedures of this section must be invoked solely for the purpose of obtaining declaratory rulings which will allow persons to act without peril upon their own view. Dies sind: die Ersatzvornahme (Ausführung einer Handlung auf Veranlassung der Vollstreckungsbehörde durch einen anderen als den zur Handlung Verpflichteten, aber auf dessen Kosten. Beispiel: Baupolizeibehörde läßt baufällige Mauer auch ohne Mitwirkung des Eigentümers durch Abbruchunternehmer einreißen); die Verhängung von Zwangsgeld (früher Zwangsstrafe); der unmittelbare Zwang. Alle Z. müssen grds. schriftlich mit angemessener Frist angedroht werden. Bleibt die Androhung erfolglos, so können die Z. so oft wiederholt und hierbei auch erhöht oder gewechselt werden, bis die Verpflichtung erfüllt ist.
