The case being litigated started at district level, was appealed, then was ultimately appealed to the BGH, which remanded the case back to the original district court. The sentence above comes from the district court ruling after all of those stages in the proceedings were over. I am thinking that the term might be translated as "coercive rulings" or "rulings involving coercive methods." I have never seen this before, however.

I think the meaning of this is that one of the previous courts issued a ruling which required that one of the parties surrender certain information that the party did not wish to surrender.

Any help will be appreciated.

Warm regards,
Timothy

ruling on the enforcement of compulsory measures
Explanation:
Zwangsmittel=

method-of-enforcement order post-stay of execution (proceedings)

Explanation:
In the UK, the process is one of methods of enforcement (Scots law: acts of diligence) like equitable receivership, attachment of earnings or bank garnishee order a.k.a. third-party debt order or a fine (Zwangsgeld often used in DE admin law §§ 9 ff. VwVG - Verwaltungsverfahrensgesetz).

Here there seems to have been a challenge of the writ of execution - Vollstreckungskalusel cf. in E&W a judg(e)ment indorsed (vs. endorsed) for enforcement, so the court bounces back with 'means of coercion' compelling compliance.

The Vollstreckungsklausel or -formel might have been objected to by the judgment or execution debtor/ corporate debtors. Trademark infringement > the Zwangsmittel or means of enforcement could, according to the asker's explanation, be forcible disclosure of info., whilst confiscation (impounding and seizure) of the offending goods and an account of profits, depending on the target of execution levied, are other likely avenues (world-wide).

-> Thanks, but method of enforcement arguably makes more sense in Anglo-American law than means of forcible-whipping coercion.

Zwangsmittelbeschlüsse
coercive rulings

Explanation:
The Hanseatic Higher Regional Court had apparently ruled that coercive measures be imposed upon the party concerned in order to get them to do the needful, i.e. comply with the previous judicial order and carry out the actions requested by court X.

"Petitions under this section must be limited to matters involving conduct or activity regulated by the Commission under statutes administered by the Commission. The procedures of this section must be invoked solely for the purpose of obtaining declaratory rulings which will allow persons to act without peril upon their own view. Controversies involving an allegation of violation by another person of statutes administered by the Commission, ***for which coercive rulings such as payment of reparation or cease and desist orders are sought***, are not proper subjects of petitions under this section."

agree  A. & S. Witte: Brilliant. Just wanted to add that a Zwangsmittelbeschluss is an act of imposition of measures only, not also one of their enforcement. The court threatens the party concerned with imprisonment in the event of non-payment, rather than enforcing imprisnmnt
