Law/Patents - Real Estate / Land register entry
German term or phrase: verbunden mit dem Sondereigentum an den jeweiligen Raeumen in 2.
Hello,

I am translating an entry from a German land register.

It reads as below:

Miteigentumsanteil von 26,99 / 1,000 an Grundstueck

[Name of town] [Reference number] Gebaeude- und Freiflaeche
[Name of street and numbers]

verbunden mit dem Sondereigentum an den jeweiligen Raeumen in 2.

I am confused about the sentence directly above.

First attempt at translation was:

"connected with the individually-owned property to the respective spaces in 2."

I am not too worried about the "Sondereigentum", because I think I have researched that and come up with a reasonable solution, but it's the "verbunden mit" and use of "an" that I am not happy with. I am not convinced that my attempt makes sense.

Do others see the "verbunden mit" as describing the actual physical connection of parts of the apartment building to others, or could it be figurative, i.e. "associated with" or "in relation to".

Or could "an" be translated as "by" in this context.

Any help in seeing the meaning clearly would be appreciated.

Thanks.

associated with

Explanation:
I would use associated with here as it is not entirely clear how they are linked.

Peer comments on this answer (and responses from the answerer)
agree  Alexandra Hirsch (X): Yes, because the point of stating the "verbunden mit" (linked with or associated to) is that the owner has to share the cost for anything to do with his part of the common property (i.e. the Miteigentumsanteil) accordingly.

disagree  Daniel Arnold (X): This proposal would suggest that the first-mentioned property is derived from the second-mentioned. That's not the case. They are two separate properties in one transaction. They always come together, but the 1st one is not an "associate" of the 2nd one.

agree  Henry Schroeder: Or connected. Critical is "ownership in" (at least for AE)

(co-owned share) running with the separate estate in the areas in 2.

Explanation:
The state of the land register would suggest a description of the 'Miteigentumsanteil' percentage share of co-ownership (BrE commonhold, pace French/ English translators throwing a fit / AmE condo) 'directly linked to' e.g. the separate estate (Herbst) or a 'separately registered title' vs. a physical desciption of being annexed (bolted on) to or 'consolidated with' the land.

Another option of 'entailed by' would be historically fraught in Eng. land law with its connottations of a settlement of land.

Othwerwise, I agree with Alexandra H's analysis.

connotations ....

Example sentence(s):
  • Der Miteigentumsanteil ist im deutschen Wohnungseigentumsrecht ein rechnerischer Bruchteil. Dann entfallen auf jeden Quadratmeter *Sondereigentum* (1000 : 800 = 1,25) 1,25/1000.
  • "Running with the land" refers to the rights and covenants in a real estate deed that remain with the land regardless of ownership.

Explanation:
"together with" is what I have seen used many time before in exactly that context
