grundsätzlich ha qui + il senso di 'in base alla normativa' 'in base alle leggi vigenti' ma siccome qui le leggi vigenti vengono espressamente citate due parole dopo, in realtà non lo tradurrei proprio

se, in base a...... permane un diritto a prestazioni....
