In einer Vertriebsvereinbarung heißt es:

Vertragsgebiet ist die Bundesrepublik Deutschland in den seit dem 03.10.1990 gültigen Grenzen, sowie die Schweiz, Holland, Belgien, Österreich und Italien.

[Firma] kauft und verkauft auf eigene Rechnung Produkte von [XY] und liefert diese an ihre Kunden (Regelfall). [Firma] vermittelt verhandelte Aufträge aus ihrem Kundenkreis an [XY] (Ausnahmefall). Im Ausnahmefall ist die Provisionshöhe auszuhandeln. Sie bemisst sich an dem Verhältnis EK-Preis zu VK-Preis.

Anfragen, die direkt an [XY] gerichtet sind, werden wie folgt bearbeitet:
- [Firma] wird unmittelbar informiert und bearbeitet den Kunden direkt.
