Die Vormerkung dient wie erwähnt dem bedingten Rechtserwerb oder Rechtsverlust des Pfandrechts und ist vor allem dann möglich, wenn eine private Urkunde zwar die allgemeinen, nicht aber die für die Einverleibung aufgestellten Erfordernisse aufweist, etwa wenn die erforderliche Beglaubigung oder die Aufsandungserklärung fehlt, aber auch dann, wenn die öffentliche Urkunde, zB ein Rückstandsaus-weis der Abgabenbehörde noch nicht vollstreckbar ist. Durch die Vormerkung wahrt der Antragsteller seinen Rang. Das Begehren um Einverleibung begreift jenes um Vormerkung stillschweigend in sich, wenn der Antragsteller dies nicht ausdrücklich ausgeschlossen hat.
