(not included) by reference Explanation: In general, other documents are made part of the present one "by reference" - i.e., they are not included physically. Here they say that the mentioning of some other documents does not include them in the present one "by reference". Plain legalese |

by way of reference Explanation: I found an Israeli document (most likely translated from Hebrew) with a very similar phrase: "the reference does not constitute inclusion by way of reference" http://www.icl-group.com/investorinformation/Immediate Repor... -------------------------------------------------- Note added at 54 mins (2011-12-01 19:21:03 GMT) -------------------------------------------------- http://www.icl-group.com/investorinformation/Immediate Repor... Link may be broken. Try this... -------------------------------------------------- Note added at 55 mins (2011-12-01 19:22:05 GMT) -------------------------------------------------- I can't get the link to post, I'll try posting it in the discussion area. I've just noticed that the document is definitely translated from the Hebrew (and the Hebrew version is binding). -------------------------------------------------- Note added at 1 hr (2011-12-01 19:27:28 GMT) -------------------------------------------------- Finally got the link to work: - also posted above. http://bit.ly/tXxmJD |

by reason of / by virtue of Explanation: This may be another option, less literal. Meirs is right, the English translation may be somewhat haphazard, although they stand by the use of "Immediate Report" as this also features on their English language website: http://www.icl-group.com/investorinformation/Pages/Immediate... "the reference does not constitute inclusion by virtue of referral" You could probably use any synonym of "by reason of" and slot it in above. (See link for synonyms).
