decision with pending effect Explanation: Ezt találtam rá egy törvény fordításában: "(10) When applying this §, the regulations pertaining to summary procedures and decisions with pending effect of the Act [CXL of 2004] on the general rules of administrative proceedings and services shall not be applied." (A linkjét nem tudom bemásolni, mert mindjárt a word jön elő, de keress rá erre a mondatra idézőjelben, és elő fog jönni egy EU-s oldalon.) Vagy ezt írtam volna magamtól is egyébként, vagy "decision with suspended effect"-et. |

conditionally effective decision Explanation: Egyetértek Evelin válaszával is. Az én javaslatom picit magyarázóbb. Az egyetlen különbség a pending és conditional között akkor releváns, ha a hatóság az érdemi határozatban - amire két hónap áll rendelkezésére - másképpen határoz, tehát akkor a függő hatályú döntés nem is emelkedik jogerőre, és ilyen esetben a hatálya nem "pending" lenne, mert nem is következik be. Ugyanez derül ki az MNB függő hatályú határozatából is: http://alk.mnb.hu/data/cms2443399/keksz_12630391.pdf Az MNB elismeri, hogy a kérelmezőt a jogosultság megilleti, de teljes jogerőre a határozat akkor emelkedik, ha... Nagyon érthető magyarázat itt: http://www.ferencvaros.hu/bizhon/K/160128/08/20_16.pdf A függő hatályú döntéshez csak abban az esetben fűződnek joghatások, vagyis akkor lép hatályba (akkor válik teljes hatályúvá a döntés), ha a hatóság két hónapon belül nem hozza meg az érdemi döntését, vagy nem szünteti meg az eljárást. Éppen ezért a függő hatályú döntés elleni fellebbezési határidő is csak akkor nyílik meg az ügyfél számára, ha a két hónap a hatóság egyéb döntése nélkül telt el. Ha azonban a hatóság másként döntött, a függő hatályú döntés nem lép hatályba és nem emelkedik jogerőre.
