Italian to English Law/Patents Law (general)
This comes from a document from the Agenzia delle Entrate. I just can't find an equivalent in English. Any ideas?

My take on this.

This would seem to be the 'provvedimento' of 25 March:

The provvedimenti istitutivi are the orders/statutory instruments that provided for the archive/database to be set up in the first place

I think it means "Provvedimento istitutivo della procedura", i.e. the order to start the procedure.

(Scots etc.) Order-in-Council setting up

No doubt Sebastiano will expound why this is not an Order-in-Council - another type of Statutory Instrument, thank you David. But the asker, like Thomas, seems to be in Scotland where this type of order is well-'established'.

But 1. both the Order and Archive should have initial caps and
2. establishing is Franglais Eurospeak for creating, such as the Treaty creating the European Community.

Indeed, the EU Treaty establishing the Common Market, as I have mentioned. Jurisprudence is also lazy Eurospeak for case law or a line of precedent. But establishing is too ambiguous as your ref., paradoxically, shows and 'establishes' the point.
