ＳＤＧの事故原因解明調査では、既にこのホームページで記録してきたように、R27上弦材鉄骨の現場溶接欠陥が落下起点であると結論してきた。
それを実物で実証できていないのだが、証拠部品と証拠部材が新潟県の保管倉庫に拉致されている以上、どうしようもない。

その状況下での、この訴訟騒ぎである。

僕は、何とかこの問題を裁判の中でも、問題提起する方法はないかと、最初から模索していた。そしたら「訴訟告知」という裁判上の制度があることを教えてくれた人がいた。

Aさんの車にBさんの車が追突した。当然、AさんはBさんに対して損害賠償を請求し、話し合いがまとまらなければ裁判所に賠償請求訴訟を起こす。
Bさんの言い分は、自分はヤバイと思いブレーキを踏んだのだが、後ろからCさんの車が自分に追突し、その弾みでAさんにぶつかってしまった。Aさんに迷惑をかけたのは事実だが、しかし、その原因はCさんにあり自分の責任ではない、という事件のときにどうするかという問題である。
AさんはCさんのことを知らないから、Bさんだけに賠償請求をする。困るのはBさんだ。それで、BさんはCさんに「訴訟告知」をすることになる。裁判の結果、自分がAさんに賠償金を支払えという判決が出たときは、その費用はCさんが支払うべきものだから、事前に、こういう裁判があることをCさんに通知しておきます、という制度だ。その「訴訟告知書」を受け取ったCさんは、AさんとBさんの裁判に出席して、自分とは関係ないと主張するか、出席しなければ自動的にBさんの支払額をCさんが負担しなければならない・・・という合理的な法律だ。
どうも詳細は判らないが、同じ事件の裁判は一回しか行わないというルールがあるらしい。AさんとBさんとの争いに一旦、判決が出ると、その後でBさんが、実はこの追突事件の原因はCさんにあるのだからといって、BさんがCさんに賠償請求訴訟を起こしても裁判所は受理しないらしい。「訴訟告知」の制度を知らなかったBさんの負けらしい。

「らしい」ばかりで恐縮だが、どうも法律は合理的につくられているようだ。

で、僕はこの制度に念のためにのることにした。新潟県がＳＤＧの「定着部の設計ミス」だといって賠償責任を裁判所が認めたとき、ＳＤＧは設計ミスの覚えがない以上、落下原因当事者に「訴訟告知」しなければならないのである。

新潟県が訴訟を起こした直後、平成16年（2004年）11月17日に、僕は裁判所と原告新潟県、大川トランスティル（ここは裁判所経由）に、「訴訟告知」を行った。
