Asker: ありがとうございます。生産的財産分与のほうは　division of property でいいようでした。慰謝料的財産分与のほうは、今回の書類ではchild support や　spousal support とも違い、tbさんの　compensation for emotional distressが近い意味でしたので、そちらを使いました。

Asker: ありがとうございました。compensation for emotional distress を使いました。辞書で調べると、同じ意味の１語の単語　solatiumというのもありましたが、誰に聞いても聞いた事もない単語だと言うので、compensation for emotional distress のほうがいいと思いました。

アリモニ; 離婚扶養料; 離婚後扶養
□伝統的には, 別居または離婚にさいして夫から妻に対して給付される扶養料であって, 妻の再婚または死亡まで定期的な給付が義務づけられていたコモン・ロー上の権利. このような alimony は永久的アリモニ (permanent alimony) とよばれる. アリモニには, このほか離婚訴訟係属中に付与される一時的アリモニ (alimony pendente lite; temporary alimony) がある. アメリカでは, 妻のみがアリモニの権利を有することは平等保護条項 (equal protection clause) に違反し違憲であると連邦最高裁判所によって宣言され, 夫から妻への請求も認められる (Orr v. Orr (1979)).
　無責離婚法 (no fault divorce law) の採用により離婚給付法の比重が高まったことも作用し, アメリカの多くの州では制定法上 alimony という用語に代え, spousal support または maintenance (扶養料)という用語が使われるようになった. そして, 財産分与 (distribution of property) 制度の創設により, アリモニは職に就くまであるいは技術修得のため職業訓練を受ける期間に限定して付与されるという形で使われることがある. これを生活再建のためのアリモニ (rehabilitative alimony) という. また, 一括払のアリモニ (lump sum alimony; alimony in gross) が認められる例も増えている.
　イギリスでも alimony という用語は廃止され, financial provision という用語が代りに使われている.
