On browsing more on this point, I discover that some jurisdictions use the term 'penal code 'as an alternate term for 'criminal code', or just merge the two into a single code as 'penal code'. So it would be safer to take 刑別, literally as : (dealt with under a judicial code) other than the Criminal code". Rendering that qualifier as '(dealt with under the) Civil Code' (or the common law of ‘Tort’), only if it can be determined that the distinction made in the body of text leaves ' Civil code' (or 'Tort') as the only remaining option in the code range of judicial system concerned. |
