English translation:charged with the burden of proof
Explanation:
Burden of Proof - A duty placed upon a civil or criminal defendant to prove or disprove a disputed fact.

Burden of proof can define the duty placed upon a party to prove or disprove a disputed fact, or it can define which party bears this burden. In criminal cases, the burden of proof is placed on the prosecution, who must demonstrate that the defendant is guilty before a jury may convict him or her. But in some jurisdiction, the defendant has the burden of establishing the existence of certain facts that give rise to a defense, such as the insanity plea. In civil cases, the plaintiff is normally charged with the burden of proof, but the defendant can be required to establish certain defenses.

If the defensive party, either by a preponderance of evidence or evidence sufficient to establish equilibrium, has met and answered the prima facie case, then the burden of going forward with the evidence returns to the original proponent charged with the burden of proof who must in turn, by a preponderance or greater weight of evidence, overcome the equilibrium thus established, or otherwise support his burden of proof by a preponderance of the evidence.

neutral  TechLawDC: Confidence level 5. Really? For a level 5, you would want to be sure that the term is 100% idiomatic in the given context (contractual collateral provision) -- which here it is not.

has the burden of proof; will be required to conclusively demonstrate [etc.]

Explanation:
This is contract language, not legal procedure language. Thus "charged" is unidiomatic in English.
Full second alternative Answer presented above: will be required to conclusively demonstrate that the deficiency is due to circumstances beyond its (the Supplier's) control.

I prefer "conclusively demonstrate" rather than just "demonstrate" because this is contract language, which tends to slight excess when stating mandatory provisions.

neutral  TechLawDC: "charged with" is not idiomatic legal English. The examples Mike23 gives ARE IRRELEVANT, because they are not in the context of a contract. (I FORGOT TO MENTION ABOUT THE CONTEXT -- WHICH IS THAT OF A CONTRACT.) This wrong answer should be disregarded.
