Portuguese term or phrase: espera criminal
Ainda dentro do límite máximo previsto na apólice, a seguradora poderá responder pelas despesas com a defesa do segurado na espera criminal, visando a melhoria das condições de defesado mesmo en ação civil da qual possa advir responsabilidade amparada por este contrato.

This is from Brasil. Although I've found some references to "espera criminal" in Portuguese on the Net, I can't get a handle on what this actually means in English. Is it while awaiting a criminal trial or just some sort of investigative period? Thanks.

Sim, creio tratar-se de um typo. EsFera criminal, e não espera criminal.

Explanation:
Espera is a typo for esfera. In this context, criminal sphere means little in EN and is at best vague, while the meaning in PT, in this context, is clear, i.e. criminal proceedings.
