A obrigatoriedade da apresentação desta certidão para negócios de compra e venda de imóvel, está prevista na Lei Federal 7.433/85, regulamentada através do decreto Federal 93.240/86. A ação real provém de uma variação da expressão “direito real”, do latim jus in re que significa “direito sobre a coisa”. Sendo assim, aquele que tem direito sobre um bem móvel ou imóvel, é o proprietário legal e esta sujeito de uma ação real. A expedição da certidão de ações reais e pessoais ou reipersecutórias é realizada pelo Poder Judiciário no Cartório Distribuidor, tendo em vista que é ali que se dá publicidade aos atos da esfera judicial e extrajudicial. I think the first 'real burdens' part is closer to a certificate = an official UK (Local/ Municipal) Land Charges search which I used to 'bespeak' = order from the Registry in my 'day'.
