A obrigatoriedade da apresentação desta certidão para negócios de compra e venda de imóvel, está prevista na Lei Federal 7.433/85, regulamentada através do decreto Federal 93.240/86.
A ação real provém de uma variação da expressão “direito real”, do latim jus in re que significa “direito sobre a coisa”. Sendo assim, aquele que tem direito sobre um bem móvel ou imóvel, é o proprietário legal e esta sujeito de uma ação real. Como exemplo de ações reais, pode-se definir: usucapião, reconhecimento de um usufruto, uso ou habitação, hipoteca, penhor, propriedade fiduciária, entre outros.

A ação pessoal ou reipersecutória visa relacionar se existe alguma ação em nome do proprietário atual do imóvel, decorrente de uma obrigação acordada e não honrada pelo devedor, que repercutiu sobre o imóvel tomando-o do proprietário, e entregando-o à um terceiro.

A expedição da certidão de ações reais e pessoais ou reipersecutórias é realizada pelo Poder Judiciário no Cartório Distribuidor, tendo em vista que é ali que se dá publicidade aos atos da esfera judicial e extrajudicial. O Cartório de Registro de Imóveis também realiza a expedição desse tipo de certidão, entretanto, corre o risco do cartório ainda não ter conhecimento de informações relevantes para expedição da certidão.

I can see where Mark R. gets the pending actions from, though have tied up that aspect with the other 'adjudicated actions' question.

I think the first 'real burdens' part is closer to a certificate = an official UK (Local/ Municipal) Land Charges search which I used to 'bespeak' = order from the Registry in my 'day'.

In the England & Wales, mortgage foreclosure (Scotland is slightly different) is called a mortgage repossession action, usually dealt with or 'disposed of' in the County Court on certain weekdays.

PS This, in the UK, would be called a Land Certificate if the land is clear of encumbrances and a Charge Certificate, if not.

In AmE, land charges are called 'land liens'. A lien in the UK can be taken only over personal, so movable property e.g. a hotelier's or tradesman's/ mechanic's lien or attaches automatically e.g. for non-payment of company shares.
