From the same text, another one that has me stumped. Context: "Se o devedor for condenado a entregar uma coisa ou a prestar um facto, só pode ser registada a hipoteca havendo conversão da prestação numa indemnização pecuniária."
Explanation: The source sentence translates as follows: "Where the debtor is ordered by the court to deliver a thing, or to act, or refrain from acting, in a certain way, the mortgage may only be registered if the said performance is converted into damages."
In Portuguese legalese "facto" can means both act and omission.

Se a prestação for ilíquida, pode a hipoteca ser registada pelo quantitativo provável do crédito. 3. Se o devedor for condenado a entregar uma coisa ou a prestar um facto, só pode ser registada a hipoteca havendo conversão da prestação numa indemnização pecuniária.

The 2015 Brazilian Código do Processo Civil contains an identical provision: "Art. 495. A decisão que condenar o réu ao pagamento de prestação consistente em dinheiro e a que determinar a conversão de prestação de fazer, de não fazer ou de dar coisa em prestação pecuniária valerão como título constitutivo de hipoteca judiciária."
This clarifies that " prestar um facto" = "prestação de fazer ou não fazer".

Quebec Civil Code: Art. 2730. Every creditor in whose favour a judgment awarding a sum of money has been rendered by a court having jurisdiction in Québec may acquire a legal hypothec on the movable or immovable property of his debtor. Louisiana Civil Code: Art. 3299. A judicial mortgage secures a judgment for the payment of money.
This supports the idea that a judicial mortgage can only secure a judgment for the payment of money and that a judgment ordering, or restraining, an act would have to be converted into money before is can be so secured.

Your comment doesn't offend me in any way. I know that I know. And I'm not shy to say it loud. Can you do the same about Portuguese? Or grammar for that matter? (I find it interesting that some people, who supposedly know Portuguese, never post anything in Portuguese. Just an observation worth making.) Indeed Linguee and Reverso translations are just "other people's translations" just like the ones we find on ProZ, isn't that so? Hopefully, they're not made by the Google robot. (grin) Anyway, I'm done with this fruitless discussion. It wont't take us anywhere.
Linguee and reverso.net are just other people's translations, considering the amount of non-natives who mistakenly think they're the dog's bx when it comes to translating into English, it doesn't mean or prove anything at all.
Better not to submit an answer when one lacks the knowledge in the TL, but some seem to think it their mission. You're welcome.
Indeed the document is insufficient to draw a definite interpretation, so the question that begs an answer is: why was my answer singled out as the "WRONG" one? Looking at the text of Article 871, it seems to me that "prestação do facto" and "prestar contas" are closely related. They could be taken almost as synonymous.
The idea of "prestar contas" in PT also implies making a statement or a set of statements. For example, "Trump se recusa a prestar contas publicamente sobre sua declaração de imposto de renda." (Trump refuses to publicly disclose his income tax.) So, yes, my answer is totally feasible. Better not to label an answer "WRONG" unless you're absolutely right. To set the record straight, your "correction" was blatantly WRONG. You assumed that "facto" was a Brazilian Portuguese word when clearly it's not.
It's nothing to do with fato/facto or me mistakenly writing Brazilian Civil Code or Portuguese civil Code, it's about what the sentence MEANS, where Mark and Adrian are on the right track and it has nothing to do with a document, where the answerer even said 'The context seems to be insufficient to draw a definite interpretation', to which the obvious conclusion would be not to make any interpretation at all, let alone just guess and then give a certainty of 4. Askers should not be mislead by guesses.

We all make mistakes, but I am of the opinion that "two wrongs don't make a right". When I'm wrong, I'd rather be corrected by someone who comes up with credible references / justifications and not just disagree for the sake of disagreeing. I haven't heard anything back about my latest insights re. "fato" vs. "facto". I suppose silence means acquiescence.
Richard's reference to the Brazilian Civil Code was obviously a slip. His references to articles 710 and 868 of the Portuguese Civil Code make that quite clear because (i) articles 710 and 868 in the Brazilian Civil Code have no bearing on our issue and (ii) hipotéca judiciária is anyway dealt with in the Brazilian Civil Procedure Code. Everyone makes mistakes.
I beg to disagree. Mistaking BR for PT is not a "squib" for sure. And I suspect my PT colleagues would agree with me on that. It's like saying that Americans should spell "threatre" for "theater", or "colour" for "color". Indeed, facto/fato is a case of double spelling with different meanings across the Atlantic. I am not sure whom that squib was aimed at, but according to the Acordo Ortográfico (Base IV, alínea c)) fato/facto is a case of dupla grafia:
"c) Conservam-se ou eliminam-se facultativamente, quando se proferem numa pronúncia culta, quer geral quer restritamente, ou então quando oscilam entre a prolação e o emudecimento: aspecto e aspeto, cacto e cato, caracteres e carateres, dicção e dição; facto e fato, sector e setor;"
If only people paid closer attention before disagreeing, they would save the embarrassment of making goofy, nonsensical comments. Anyone with a basic knowledge of the differences between Brazilian PT and European PT knows that "facto" is not a Brazilian word. It is Portuguese and it means "fact". Hence, I doubt that the Brazilian Constitution would contain the word "facto". In PT-Br, "facto" is spelled and pronounced "fato".
