No que ao artigo 2.º da presente proposta de regulamento diz respeito, considera-se que, não sendo esta uma competência da União, mas sim dos Estados-Membros, a equiparação, no âmbito dos direitos fundamentais, entre os direitos sociais e os direitos económicos, defendida pela presente iniciativa, colide com a tradição constitucional portuguesa e com a interpretação que é seguida pela jurisprudência do Tribunal Constitucional português, bem como pela generalidade da doutrina.
