In principiu, odata cu transferul proprietatii se transmite si riscul lucrului (res perit domine). In conformitate cu reglementarile aplicabile, riscul va fi suportat de cumparator fie din momentul incheierii contractului, fie din momentul traditiei lucrului, fie din alt moment stabilit de parti.
