Traditio Explanation: traditiune = tradiţiune, mod de dobândire a drepturilor reale, constând în simpla predare materială a obiectului; operează transferul proprietăţii în cazul darurilor manuale. în actele juridice translative, având ca obiect bunuri certe, dreptul real fiind transmis dobânditorului prin chiar încheierea acordului de voinţă, tradiţiunea operează numai transmiterea posesiei lucrului, partea pusă în întârziere pentru îndeplinirea obligaţiei de a face tradiţiunea lucrului va suporta riscurile pieirii fortuite a lucrului, afară dacă poate dovedi că lucrul ar fi pierit şi la dobânditor, dacă i-ar fi fost predat.
