disagree  Annamaria Amik: This is on a DBS certificate, so the holder was probably sentenced to a main penalty of something under the New Code of Criminal Procedure, including the ancillary penalty/ Well, Romanian legal system is not a common-law system. But I agree, it's punishm.

Nu cred că se poate reda cu un echivalent perfect din legislaţia UK sau US.
Ancillary orders (sau punishments) care s-a mai menţionat aici şi în alte discuţii pe tema pedepselor accesorii şi complementare, se referă mai degrabă la pedepsele complementare, care lărgesc sfera sancţiunilor.

Din câte ştiu, înainte de NCPP, pedeapsa accesorie se aplica de drept, dar acum, pedeapsa accesorie depinde de modul stabilirii pedepsei complementare. Menţionez asta ca să justific formula "combined", care în CPP vechi nu ar fi avut sens.

The accessory punishment is attached to the main custodial punishment by the criminal law as an accessory. As such, concept-wise, it is neither applied nor decreed by the court of law as it ensues ope legis, that is by the power of law and not ope judicis that is by the power of the court of law. In this study, the authors emphasized the fact that the Romanian legislator has rejected the principle according to which the accessory punishment ensues ipso jure from the main punishment, and therefore stipulating that the accessory punishment is decreed by the court of law in addition to the main custodial punishment.

Fiind vorba despre un certificat de cazier judiciar şi în baza celor de mai sus, probabil apare pe listă condamnarea, cu indicarea pedepsei principale, celei complementare şi menţiunea "cu aplicarea pedepsei accesorii". În orice caz, aş opta pentru o formulă succintă şi nu una mai dezvoltată.

Deşi se foloseşte şi ca adjectiv, cum spune Liviu, accessory are un alt sens binedefinit, există riscul să fie interpretat ca sentinţă pentru complicitate. De aceea mai bine varianta propusă de el (eventual: statutory suspension of certain civil rights) sau reformulat: "combined with an auxiliary punishment of..."

Însă doar dacă există riscul confuziei (mai ales dacă a fost condamnat pentru complicitate :) ). Se poate folosi şi cum am propus iniţial, iată de ce:

  -> Da, de asta nu sunt foarte sigură nici eu, însă era un exemplu bun pentru diferenţa dintre accesoriu şi complementar. De altfel, accessory se foloseşte şi ca adjectiv, doar că, după cum spui, există riscul confuziei.
