The statute of prescription to request enforcement is a period (range) time established by the law during which the right of action may be exercised for the enforcement of an obligation contained in an enforceable title, after the expiry ofwhich it can be lost. Potrivit art. 6 din Decretul nr. 167/1958 privitor la presciptia extinctiva, dreptul de a cere executarea silita in temeiul oricarui titlu executor se prescrie prin implinirea termenului de 3 ani, acest articol constituind dreptul comun in ce priveste durata prescriptiei dreptului de a cere executarea silita, el gasindu-si aplicarea ori de cate ori, prin dispozitii speciale nu sunt prevazute alte termene [1]. |
