Incheiere de sedinta - Procedura de Judecata

Reglementata in cap. I, t. II, C. proc. pen., partea speciala, hotarare pronuntata de instanta de judecata in cursul judecatii care nu rezolva fondul cauzei, ci se pronunta asupra diverselor cereri, probleme sau exceptii ori masuri procesuale (ex. arestarea preventiva etc.) care se ivesc in timpul judecatii.
Acest act are o dubla functionalitate, constituind, pe de o parte, o hotarare judecatoreasca, dar in acelasi timp tinand loc de proces-verbal de sedinta.Ea se intocmeste de grefier in termen de 24 de ore de la terminarea sedintei si se semneaza de presedintele completului de judecata si de cel care a intocmit actul.Potrivit legii, incheierea de sedinta trebuie sa cuprinda mentiunile necesare referitoare la data
incheierii, instanta care a judecat cauza, daca sedinta a fost sau nu publica, completul de judecata, partile care au participat in proces etc.
