Spanish term or phrase: trabajadoras en inclusión en la plantilla
This is for a situation where two or more companies are tied in terms of their scores for their bids.
I understand the concept of people who are deemed to be socially excluded, but "en inclusión"?? Does it just mean the number of socially excluded people who have now been *included" in the team? But, really, I don't understand why they didn't simply repeat the earlier phrase - o sea, "mayor número de trabajadores en situación de exclusión social en la plantilla".
What do others think, please?

"El empate entre varias ofertas tras la aplicación de los criterios de adjudicación del contrato se resolverá mediante la aplicación por orden de los siguientes criterios sociales, referidos al momento de finalizar el plazo de presentación de ofertas:
a) Mayor porcentaje de trabajadores con discapacidad o en situación de exclusión social en la plantilla de cada una de las empresas, primando en caso de igualdad, el mayor número de trabajadores fijos con discapacidad en plantilla, o el mayor número de personas trabajadoras en inclusión en la plantilla."

This is my reading.

I thought at first it might be a mistake, but it's not - it's a direct quote from an act of parliament. And I don't really follow the logic of using these two criteria to decide who gets the contract, but perhaps someone can explain. This is how I'd translate it:

El mayor número de trabajadores fijos con discapacidad en plantilla, o el mayor número de personas trabajadoras en inclusión en la plantilla.

The number of permanent employees with disabilities, or the number of employees not affected by social exclusion, whichever is greater.

I suspect disability and social exclusion are synonyms, but I'd stick to what the Spanish says.

Asker: Thanks Phil, it's very helpful that you have found the quote from the act of parliament. But given the aims of the legislation (to have disabled and socially excluded people in employment), it can't make sense that a company with more people "not affected by social exclusion" would win over a company employing more disabled people... I'm going to raise it with the agency, because it just doesn't make sense to me. Thanks

disagree  Angelo Berbotto: Disability can be a reason for social exclusion but not the only one - there is poverty, limited education, caring responsibilities. The source text refers to the social measures that the company has undertaken which makes the company score higher points

Estoy de acuerdo contigo, lo más lógico habría sido repetir social exclusion-- pero se me ocurre que si una persona está ya en plantilla no está en situación de exclusión social sino que lo estaría si perdiera el trabajo, por eso propongo at risk of social exclusion.

Lo que dice el texto de partida es que el método para desempatar las ofertas es mediante el uso de 'criterios sociales' o sea la contribución de la empresa a la sociedad.

El primer criterio es el porcentaje de empleados con discapacidad o en situación de exclusión social que cada empresa tenga en plantilla --

' primando en caso de igualdad' significa si el empate continúa porque las empresas tienen el mismo porcentaje


entones, en caso de persistir el empate

el criterio siguiente es ver qué empresa tiene más empleados discapacitados FIJOS (o sea no temporarios) y lo mismo para los trabajadores en situación de exclusión -- pero como están empleados, no están en situación de exclusión sino en riesgo de situación de exclusión

No se me ocurre otra interpretación de este párrafo que respete la lógica del contexto. Saludos.
