I'm having a bit of a block at the moment and struggling with the phrase:

Cuando se presente la propuesta en forma subsidiaria al cumplimiento de cualquier condición o modalidad.

Its a bid/tender specification detailing the bid requirements for an engineering project. This particular section is about the reasons for which proposals may be rejected, e.g. when the proposal is submitted after the deadline, when various bids have been presented by the same proponent etc.

The only thing I could think of would be something along the lines of the following, which does not convince me to be honest:

When the proposal is presented without complying with any condition or modality.

The idea seems to be that the party issuing the tender is reminding potential bidders that *it* issues the conditions under which bids will be considered acceptable, and that it will in no wise accept conditions imposed by a bidder.

This is how I read it. What I'm not entirely clear about is what "modalidad" is intended to refer to. It seems to be a reference to the overall way the proposed contract is structured.

Asker: Thanks Robert, I was thinking it referred to the conditions in the bid specification, so of course I wasn't getting anywhere. But the idea that it means any other kind of condition/provision certainly makes sense.
