Dado en la práctica del mercado asegurador es costumbre asignar a los productores atribuciones propias de un mandato tácito, en los términos del art. 1874 del Código Civil, es claro que aquéllos, como mandatarios, no responden por los actos realizados en nombre de su mandante, la compañía aseguradora. Por lo cual, más allá de las acciones que pudiere tener esta última contra su mandatario, por rendición de cuentas o incumplimiento de los deberes inherentes a su función, es claro que el mismo no responde por las consecuencias del contrato de seguro.
