Si quien se constituyó en importador temporario de cierta maquinaria con el objeto de exhibirla en una exposición, en cumplimiento de las disposiciones emergentes del Código Aduanero, contrató con una aseguradora un seguro de caución en orden a proveer a la Administración Nacional de Aduanas la garantía exigida por el mentado código en su arts. 255 y concs.; resulta improcedente que reclame judicialmente de quien en definitiva adquirió el bien, la restitución del “precio” de la garantía a cuya constitución se hallaba legalmente obligado por efecto de su calidad de importador temporario, toda vez que carece de apoyatura normativa o convencional en tal sentido. No empece lo expuesto que –como en el caso-, el pretensor haya alegado que el accionado –importador definitivo- tenía la obligación de obtener la restitución de la garantía para así lograr su liberación, toda vez que no adujo –ni menos aún probó-, que el adquirente definitivo hubiese incurrido en alguna actuación negligente durante la secuencia que concluyó con la liberación de la susodicha garantía, de cuya hipotética negligencia se hubiese seguido daño resarcible al reclamante.
