Corresponde hacer lugar al reclamo efectuado en los términos de la Ley N° 17.418 (art. 80), por la aseguradora del consorcio de propietarios de un edificio afectado por un incendio contra el titular de la unidad en la que el siniestro se inició, toda vez que admitida la personalidad jurídica del consorcio de propietarios (Código Civil art. 33 segundo párrafo, texto según Ley N° 17.711, que sólo puede hacer referencia a estos entes creados por Ley N° 13.512, según autorizada doctrina) distinta de la de los miembros que la integran, estos revisten calidad de terceros en los términos de la referida norma (art. 80 Ley N° 17.418), respecto al contrato de seguro celebrado por la aseguradora con el consorcio, ante el siniestro ocurrido en una de las unidades del inmueble asegurado; de tal modo y tratándose de un caso de responsabilidad aquiliana, el consorcio tenía inicialmente acción para reclamar al consorcista aquí accionado, el resarcimiento de los daños ocasionados por el fuego sobre las partes comunes, por lo que habiendo abonado la indemnización, la aseguradora ha quedado subrogada en los derechos que correspondía al consorcio asegurado contra el titular de la unidad en cuestión, en razón del siniestro.

Rectifico algo de la explicación entre paréntesis de la respuesta y pido disculpas. Puse \"from the Roman jurist Aquilian\" y su nombre no era Aquilian,sino Aquillius, como puse en el origen del adjetivo \"Aquilian\" del Webster.
Añado también que este adjetivo se debe escribir con mayúscu-
la, aunque casi siempre se ve escrito con minúscula.

disagree  Paul Stevens: In an insurance context "liability" is always used rather than "responsibility and I'm really not sure about the use of "Aquilan" here
