Spanish to English translations [PRO]
Law/Patents - Law (general) / Civil Casación
Spanish term or phrase: censura
Dear colleagues,

I'm struggling with what "censura" means in the following sentences:

"Respecto a esta Causal de fondo, la censura estima que la Sentencia recurrida ha infringido los Artículos 217,780,832,908 y 966 del Código Judicial y los Artículos 1644 y 1644 A del Código Civil."

"Y finalmente, en el MOTIVO QUINTO la censura considera que "en la sentencia de segunda instancia no se apreciaron los informes de evaluación psicológicos realizados al señor..."

This is Spanish from Panama.

I suspect it may be referring to the Cassation itself as a "disapproval" of the original judgment?

Many thanks!

censura (casacional)
(ESP & PAN) Highest-Level ('Quashing') Appeal Submission

Explanation:
JR . judicial review (of administrative action), pace Allegro, is on the right lines, except - in the UK or Ireland (?) - it is neither an appeal, nor can it overturn - merely review a decision by a public body or agency.

I use 'quashing' in inverted commas as an unusual term in English for overturning a ruling of a court below and rhyming, as it does, with lemon etc. squash.

Example sentence(s):
  • ÓRGANO JUDICIAL DE LA REPÚBLICA DE PANAMÁ ...... En otras palabras, pretende la censura que la Sala deje sin efecto la inscripción.
  • La sentencia objeto de la presente censura casacional es condenatoria para el recurrente por un delito contra la salud pública.

  -> The ST = source text says: 'la censura considera...', so the appeal ' holds or considers' might not be enough. So I have added the word submission at the appeal stage and patently not at the judgment(al) stage.
