Law/Patents - Law (general) / Court / Police Report
Spanish term or phrase: Comunica Principio de Oportunidad
This is the heading on an official document from the 'fiscalia los angeles' in Peru.

I've found a couple of entries to similar phrases but can't quite work out which ones are relevant to put this one together

Notice of (the Doctrine of) Discretion to Prosecute
Explanation:
Principio de Oportunidad: 'Prosecutorial Discretion' (Tom West III's ES/EN law dictionary). Maybe time to invest therein!

Notably teenagers need not be hauled before the courts - see the 2nd example sentence.

PS in some German-speaking countries, the Prosecuting Authorities have no discretion whether to prosecute - and pursue to the end - certain auto-piloted offences.

Well, Cathy, I used to specialise on St. Kilda Beach in Melbourne and on Palm Beach in Queensland, but I'm not saying in what.

BTW, 'prosecutorial discretion' as such might be slightly ambiguous for your purposes, namely meaning not only to exercise a discretion whether to prosecute, but also a prosecution's discretion e.g. to make disclosure of any exonerating evidence held. That's why I reworded that entry (before anyone claims it is superior).

Example sentence(s):
  • Diversas experiencias reconocen la importancia del principio de oportunidad para dirigir la per-secución penal hacia los delitos más graves y las organizaciones criminales.
  • ...en el sistema de responsabilidad de adolescentes deben considerarse los fines de la sanción (como es denominada), esto es, protectora, educativa y restaurativa.

Notes to answerer
Asker: Thanks Adrian. Re the dictionary, you might be right, though I don't really specialise so the required purchase list could be long. I optimistically expect that most answers can be found online these days.

  -> Gracias! As I commented, I don't think prosecutorial discretion is entirely free of ambiguity for the prosecution's discretion to do something other than prosecute.
