non-contentious disposal out-of-court Explanation: I surmise that this something to do with 'voluntary (agreed) jurisdiction', to wit: non-contentious business with probate (Scots law: letters of confirmation) issued in 'common' (undisputed) vs. 'solemn' (litigious) form, rather than a settlement like a DoFa: a Deed of Family Arrangement e.g. of Variation of a Will out-of-court.
