This means that the felony is of a higher degree because the perpetuator of the crime is a church authority, a member of Law Enforcement, a teacher or a professor, etc.

Is there an equivalent term in English to express this?

PSA: presunto supuesto autor, as per Taña D.'s decoding in the discussion entries.

Putative, not used only in Anglo-Am- family law for the putative father or even mother ('don't mention the British Royal Family'), but to avoid an 'alleged' double-up.

I think in British or guess in American that this in Anglo-Am. law - e.g. in the context of old etc. people being forced to make Wills, but see also the 2nd US web ref. to sexual assault - would be looked upon as an undue-influence scenario (cf. definition in Barron's US Am. Law Dictionary).

I will leave our friend Sandro T. to post his 'relationship with the perpetrator' as the latter is certainly what also occured to me, except there might be a co-autor who - even as a mere onlooker or aider and abettor - turns the abusers into *joint principals*.

Perp. BTW om the answer line stands for perpetrator and not, more fittingly, for perv.

neutral  ormiston: Not too sure about 'undue influence', which woul be the RESULT of the perpetrator's status/ position

  -> Indeed, but 1. the asker is specifically out for an 'equivalent' in English (undue influence partly adopted in Scots law. plus 2. I was unwilling to recycle Sandro T's idea of 'the relationship of = with the perpetrator' for fear of trolling 'abuse'.
