In the context of a confidenciality agreement between two companies (one is "the client" and the other party the provider of certain consulting services). We are dealing about sharing confidential information with third parties which need to know such information.

The term proposed appears in the following paragraph:

"A estos efectos, XXXXX (the company provider of services) advertirá a dichas personas físicas o jurídicas por las que responde de sus obligaciones respecto de la confidencialidad, velando y respondiendo por el cumplimiento de las mismas."

The paragraph does seem to be very fortunately written, so below I give a couple of "interpretative" translations:

"For these purposes, XXXX will inform those natural or legal persons that it is under the above obligations of confidentiality, and therefore will supervise their enforcement."

"For these purposes those natural or legal persons shall be notified by XXXX that it is accountable with respect to their binding obligations of confidentiality, being responsible for monitoring their enforcement."

Interestingly, if you Google ""ensuring compliance with the same" you get 25 million hits, whereas "ensuring fulfilment of the same" only gets one! So that's the version I'd probably use (lol).
