Definition
In simple terms, a letter of credit is a bank undertaking of payment separate from the sales or other contracts on which it is based. It is a way of reducing the payment risks associated with the movement of goods.
Expressed more fully, it is a written undertaking by a bank (issuing bank) given to the seller (beneficiary) at the request, and in accordance with the buyer’s (applicant) instructions to effect payment — that is by making a payment, or by accepting or negotiating bills of exchange (drafts) — up to a stated amount, against stipulated documents and within a prescribed time limit.
Why use a Letter of Credit?
The need for a letter of credit is a consideration in the course of negotiations between the buyer and seller when the important matter of method of payment is being discussed. Payment can be made in several different ways: by the buyer remitting cash with his order; by open account whereby the buyer remits payment at an agreed time after receiving the goods; or by documentary collection through a bank in which case the buyer pays the collecting bank for account of the seller in exchange for shipping documents which would include, in most cases, the document of title to the goods. In the aforementioned methods of payment, the seller relies entirely on the willingness and ability of the buyer to effect payment.
When the seller has doubts about the credit-worthiness of the buyer and wishes to ensure prompt payment, the seller can insist that the sales contract provides for payment by irrevocable letter of credit. Furthermore, if the bank issuing the letter of credit (issuing bank) is unknown to the seller or if the seller is shipping to a foreign country and is uncertain of the issuing bank’s ability to honour its obligation, the seller can, with the approval of the issuing bank, request its own bank — or an International bank to assume the risk of the issuing bank by confirming the letter of credit.
Basic Types of Letters of Credit
There are three basic features of letters of credit, each of which has two options. These are described below. Each letter of credit has a combination of each of the three features.
SIGHT OR TERM/USANCE
Letters of credit can permit the beneficiary to be paid immediately upon presentation of specified documents
(sight letter of credit), or at a future date as established in the sales contract (term/usance letter of credit).
IRREVOCABLE
An irrevocable letter of credit cannot be cancelled without the consent of the beneficiary.
UNCONFIRMED OR CONFIRMED
An unconfirmed letter of credit carries the obligation of the issuing bank to honour all drawings, provided that the terms and conditions of the letter of credit have been complied with. A confirmed letter of credit also carries the obligation of another bank which is normally located in the beneficiary’s country, thereby giving the beneficiary the comfort of dealing with a bank known to him.

Definiţie
În termeni simpli, un acreditiv este angajamentul asumat de către o bancă pentru a efectua o plată fără a ţine cont de activităţi comerciale sau de alte contracte în baza cărora acesta este justificat. Este o modalitate de a reduce riscurile aferente plăţii asociate cu procesul de mişcare a bunurilor.
Pentru a da o definiţie mai cuprinzătoare, este vorba de un angajament scris al unei bănci (banca emitentă) dat către un vânzător (beneficiar) la cererea şi în conformitate cu instrucţiunile date de către cumpărător (ordonatorul acreditivului) de a efectua plata – adică prin efectuarea plăţii sau acceptarea sau negocierea de cambii (trate) – până la o anumită sumă, contra documentelor specificate şi într-un interval de timp prestabilit.
De ce se foloseşte acreditivul documentar?
Necesitatea utilizării unui acreditiv documentar este o chestiune luată în considerare pe parcursul negocierilor derulate între compărător şi vânzător atunci când se discută importanta problemă a metodei de plată. Plata poate fi efectuată pe mai multe căi diferite: de către cumpărător plătind cu numerar la ordin; prin sistem de cont deschis prin care cumpărătorul remite plata la un termen stabilit de cumun acord după recepţia bunurilor; prin sistem de incasso documentar prin intermediul unei bănci, caz în care cumpărătorul plăteşte băncii colectoare în contul vânzătorului în schimbul documentelor de transport care ar include, în majoritatea dintre cazuri, documentul ce atribuie dreptul de proprietate asupra bunurilor. În metodele de plată descrise mai sus, vânzătorul se bazează în totalitate pe dispoziţia şi abilitatea cumpărătorului de a efectua plata.
Atunci când vânzătorul are îndoieli cu privire la credibilitatea acreditivului unui cumpărător şi doreşte asigurarea unei plăţi prompte, vânzătorul poate insista asupra faptului că acest contract de vânzare-cumpărare să aiba clauza de plată prin acreditiv documentar irevocabil. Mai mult decât atât, dacă banca emitentă a acreditivului (banca emitentă) este necunoscută vânzătorului sau dacă vânzătorul face un transport al bunurilor către o ţară străină şi este nesigur în ceea ce priveşte abilitatea băncii emitente de a-şi onora obligaţiile, vânzătorul are posibilitatea, cu aprobarea băncii emitente, să solicite băncii cu care lucrează sau unei bănci internaţionale să îşi asume riscul băncii emitente prin confirmarea acreditivului.
Principalele tipuri de acreditive
Există trei tipuri principale de acreditive, fiecare având câte două opţiuni. Acestea din urmă sunt descrise mai jos. Fiecare acreditiv are o combinaţie a fiecăreia dintre cele trei caracteristici.
LA VEDERE SAU LA TERMEN / COMFORM UZANŢEI
Acreditivele pot permite beneficiarului să încaseze plata imediat după prezentarea documentelor specifice (acreditiv la vedere), sau la o dată viitoare stabilită în cadrul contractului de vânzare cumpărare (acreditiv la termen/conform uzanţei).
IREVOCABIL
Un acreditiv irevocabil nu poate fi anulat fără consimţământul beneficiarului.
NECONFIRMAT SAU CONFIRMAT
Un acredtitiv neconfirmat poartă obligaţia băncii emitente de a onora toate retragerile, cu condiţia ca toate termenele şi condiţiile să fi fost respectate. Un acreditiv documentar confirmat poartă de asemenea obligaţia unei alte bănci care, în mod normal este amplasată în ţara beneficiarului, astfel că, oferind beneficiarului confortul de a lucra cu o bancă care îi este familiară.

Source text - Romanian Instituirea procedurii speciale pentru infracţiunile flagrante răspunde, pe de o parte, unor interese de ordin procesual, deoarece, în asemenea condiţii, sporesc valenţele principiului operativităţii în procesul penal; pe de altă parte, procedura urgentă grăbeşte restabilirea ordinii de drept încălcate şi contribuie la sporirea rolului educativ al procesului penal.
Deşi procedura specială privind unele infracţiuni flagrante conţine norme derogatorii de la procedura obişnuită a procesului penal, se cuvine menţionat faptul că sunt respectate, în aceeaşi măsură, principiile fundamentale care guvernează procesul penal.
Articolul 41 al Legii nr. 535/2004 prevede obligativitatea operatorilor sau furnizorilor de servicii poştale, precum şi a celor de reţele de comunicaţii electronice de a transmite, de îndată, procurorului, la solicitarea scrisă a acestuia, informaţiile necesare identificării persoanelor suspecte de pregătirea sau săvârşirea actelor de terorism.
În România, efectuarea urmăririi penale se realizează de către Direcţia de Investigare a Infracţiunilor de Criminalitate Organizată şi Terorism (DIICOT), structură aflată în cadrul Ministerului Public, care dispune de mijloace procedurale investigative moderne. Activitatea Direcţiei este reglementată de Legea nr. 508/2004 privind înfiinţarea şi funcţionarea DIICOT.
Cooperarea judiciară internaţională în materie penală şi care vizează ca domenii de aplicare extrădarea, predarea în baza unui mandat european de arestare, transferul de proceduri în materie penală, recunoaşterea şi executarea hotărârilor, transferarea persoanelor condamnate, asistenţa judiciară în materie penală şi alte forme de cooperare judiciară internaţională în materie penală - este reglementată prin Legea nr. 302/2004 privind cooperarea judiciară în materie penală, cu modificările şi completările aduse prin Legea nr.224/2006.
Enumerăm, în continuare, actele normative din legislaţia naţională care conţin dispoziţii penale specifice de fond şi de procedură menite să faciliteze anchetarea şi urmărirea infracţiunilor legate de terorism:
Legea nr. 535/2004 privind prevenirea şi combaterea terorismului corelate şi cu dispoziţiile Codului penal şi art. 106-109 din Ordonanţa Guvernului nr. 29/1997 privind Codul aerian; Codul de procedură penală – art. 91 şi art. 224; Legea nr. 656/2002 pentru prevenirea şi sancţionarea spălării banilor, precum şi pentru instituirea unor măsuri de prevenire şi combatere a finanţării actelor de terorism; Legea nr. 111/1996 privind desfăşurarea în siguranţă, reglementarea, autorizarea şi controlul activităţilor nucleare – art. 47; Legea nr. 508/2004 privind înfiinţarea, organizarea şi funcţionarea în cadrul Ministerului Public a Direcţiei de Investigare a Infracţiunilor de Criminalitate Organizată şi Terorism; Legea nr. 302/2004 privind cooperarea judiciară internaţională în materie penală; Legea nr. 122/2006 privind azilul în România; Legea nr. 39/2003 privind prevenirea şi combaterea criminalităţii organizate – art. 7-8 coroborat cu art. 2, precum şi numeroase acte internaţionale de cooperare în acest domeniu, ratificate şi transpuse în legislaţia internă.
Translation - English The establishment of the special procedure in place for flagrant crimes answers to certain procedural objectives, on one hand, due to the fact that they increase the valence of the of the efficiency principle within the criminal process, under such conditions; and on the other hand, the emergency procedure speeds up the reestablishment of rule of law that was breached, contributing to the increase of educational role of the criminal trial.
Even though the special procedure concerning some flagrant crimes includes derogations from the common procedure of the criminal trial, it must be underlined the fact that the central principles governing the criminal process are observed at the same extent.
Article 41 of Law no. 535/2004 provides the fact that postal services as well as the electronic communications providers are under the obligation of transmitting, as soon as possible, to the prosecuting attorney, upon his written request, the information needed to identify the individuals under suspicion of being involved with organizing or performing terrorist acts.
In Romania, Directorate for Investigation of Organized Crime and Terrorism (DIICOT) conducts the criminal prosecution, being an institution operating under the Public Ministry, having at its disposal modern procedural means of investigation. The activity of the Directorate is regulated by Law no. 508/2004 on the establishment and development of DIICOT.
The judicial international cooperation regarding the criminal field and aimed at fields of activity like extradition, transfer based on a European arrest mandate, the transfer of criminal law procedures, the validation and enforcement of decisions, the transfer of convicted individuals, judicial assistance in the field of criminal law and other forms of international judicial cooperation in criminal law – is regulated by Law no. 302/2004 regarding the judicial cooperation within the field of criminal law, with the amendments and alterations brought about by Law no. 224/2006.
