El cumplimiento de las metas del Plan Nacional de Agua Potable y Saneamiento y el consecuente ambicioso plan de inversiones asociado implican un desafío de gestión y financiamiento . Por tal motivo y en línea con la política llevada a cabo a nivel nacional, desde la Subsecretaría de Recursos Hídricos de la Nación se está llevando adelante un plan para la incorporación del sector privado en el sector de agua potable y saneamiento. La concreción de las obras requerirá de la participación del sector privado ya sea como forma de obtener financiamiento a través de capital privado y difiriendo su pago al mediano o largo plazo, como así también para aportar innovación y eficiencia en la gestión.
Además de1 mecanismo tradicional de ejecución de obra pública, existen múltiples modalidades alternativas que permiten la participación del sector privado como por ejemplo: los contratos de obra con pago diferido, los contratos de participación público privada, los contratos de concesión, o cualquier otra forma legal en la que pudieran acordarse las condiciones de pago frente a las necesidades de financiamiento.

For that reason and aligned with the policies developed within the national environment, the Secretariat of Water Resources is developing a plan for the inclusion of the private sector into the drinking water and sanitation area. Works completion shall require the participation of the private sector, not only as a way of financing through the private sector and deferring payment for a medium or long term, but also to bring management innovation and efficiency.
Apart from the traditional mechanism for the execution of public works, there exist many other alternatives that allow private sector’s participation, such as: Work agreements with deferred payments, private and public partnerships, concession agreements, or any other legal form in which payment conditions may be agreed considering financial needs.
Private and public partnership (PPP) agreements come out as a favorable tool for the development of projects carried out within the Secretariat of Water Resources. Source text - Spanish CONDICIONES GENERALES DE PRESTACION DE SERVICIOS DE NSS S.A.
I.- OBJETO
En caso que se hubiera perfeccionado la contratación de servicios por parte del Cliente, IPLAN prestará los servicios (los Servicios) detallados: i) en el documento identificado como solicitud de servicio, y/o ii) en el mail de confirmación de contratación de servicios si el Cliente los hubiera contratado a través del portal web de IPLAN y/o iii) en el mail de aceptación de la propuesta si el cliente los hubiera contratado vía mail (en adelante cualquiera de ellos en forma indistinta denominados la “Solicitud”). Las condiciones generales (en adelante, las “Condiciones”) que se detallan a continuación regirán para la prestación del/ los Servicio/s. El/los Servicio/s será/n brindado/s de conformidad a lo establecido en las Condiciones; la Solicitud y el/los Alcance/s del Servicio correspondiente/s.
II.- INSTALACION
2.1. El plazo de instalación y/o implementación de los Servicios consignado en la Solicitud, regirá desde el momento en que el Cliente entregue a IPLAN, el permiso y la información que resulte necesaria para permitir el acceso a los domicilios consignados, a efectos de instalar el equipamiento para la prestación de los Servicios y/o brinde la información y parámetros de configuración que los Servicios a implementar requieran, detallados en el Alcance del Servicio.
2.2. La finalización de las tareas de instalación y/o implementación de los Servicios y la consecuente activación de los mismos, será comunicada al Cliente a través de cualesquiera de los siguientes medios, en forma indistinta: i) el envío de un correo electrónico a la casilla de correo informada por el Cliente en la Solicitud, y/o ii) la entrega de un documento para la firma por parte del Cliente, dejando constancia de la activación de los Servicios.
III.- VIGENCIA - NUEVAS CONDICIONES - RESCISION
3.1. Ambas partes aceptan expresamente que las prestaciones a cargo de IPLAN deben ser revisadas periódicamente en lo que respecta a las condiciones de prestación de los Servicios, a efectos de mantener su competitividad y relación con las condiciones de mercado.
3.2. El Cliente o IPLAN podrán rescindir la prestación de los Servicios en cualquier momento con una notificación previa y fehaciente de treinta (30) días. Es requisito que el Cliente esté al día con el pago de todas las facturas emitidas por IPLAN y que éstas se hayan cancelado totalmente, para que el Cliente pueda utilizar la facultad rescisoria aquí descripta.
3.3. En cualquier momento IPLAN podrá introducir nuevas condiciones de prestación de servicios excepto modificaciones de precios (las “Nuevas Condiciones”). Las Nuevas Condiciones serán comunicadas al Cliente por cualesquiera de los siguientes medios de manera indistinta: carta, fax, factura o correo electrónico, según los datos que el Cliente haya informado a IPLAN, o mediante su publicación en el sitio www.iplan.com.ar. La comunicación referida será efectuada al Cliente con una anticipación de treinta (30) días al momento en que sean de aplicación las Nuevas Condiciones. Si transcurrido dicho plazo el Cliente no ha manifestado por medio fehaciente a IPLAN su voluntad de rescindir la relación contractual y continuara haciendo uso de los Servicios, se considerará que el Cliente ha aceptado las Nuevas Condiciones.
3.4. IPLAN podrá con una anticipación de treinta (30) días al momento en que sea de aplicación el mismo, notificar al Cliente un nuevo precio por los Servicios a través de cualesquiera de los siguientes medios de manera indistinta: carta, fax, factura o correo electrónico, según los datos que el Cliente haya informado a IPLAN, o mediante su publicación en el sitio www.iplan.com.ar. Si transcurrido el plazo de treinta (30) días desde la notificación efectuada el Cliente no ha manifestado por medio fehaciente a IPLAN su voluntad de rescindir el acuerdo y continuara haciendo uso de los Servicios, se considerará que el Cliente ha aceptado el nuevo precio. En caso que el cliente no acepte el nuevo precio, la baja del Servicio será procesada en la fecha solicitada en forma fehaciente por el Cliente.
3.5. IPLAN tendrá la facultad de rescindir la relación contractual, sin necesidad de previa notificación, por concurso o quiebra del Cliente, acuerdo judicial preventivo de sus acreedores, presentación de un pedido de concurso o quiebra voluntario o por terceros, o por intervención, liquidación o disolución del Cliente.
3.6. En el supuesto que por cualquier causa sea rescindido el acuerdo por cualquiera de las Partes antes de transcurrido el plazo inicial consignado en la Solicitud de Servicios, el Cliente deberá abonar a IPLAN el importe equivalente a la totalidad de los abonos que resten hasta la finalización del plazo de vigencia mínimo establecido.
IV.- PRECIO - CONDICIONES DE FACTURACION – PAGO
4.1. El Cliente abonará a IPLAN los Cargos de Instalación, los Abonos Mensuales y los Cargos por Consumo (conjunta o indistintamente, el “Precio”) especificados en la Solicitud o en la Nuevas Condiciones que rijan, de acuerdo con lo establecido en la cláusula tercera
Los Abonos Mensuales, serán facturados al Cliente por mes adelantado. Los Cargos de Instalación podrán ser facturados desde la fecha de firma de la Solicitud. Por su parte, los Cargos por Consumo serán informados en la factura correspondiente. La obligación de abonar el Precio es independiente del uso que el Cliente haga de los Servicios.
4.2. El Cliente podrá consultar los Precios aplicables en las Llamadas Locales, Larga Distancia Nacional y Larga Distancia Internacional, como así también la definición de Destinos y Claves tarifarias en el sitio web de IPLAN (www.iplan.com.ar).
4.3. Los Precios podrán estar expresados en Pesos o en Dólares Estadounidenses, según corresponda. Los Precios expresados en Dólares Estadounidenses serán facturados en dicha moneda y deberán ser abonados en moneda de la misma especie o en Pesos al tipo de cambio vendedor del Banco de la Nación Argentina vigente al cierre de las operaciones del día anterior a la fecha de acreditación del pago.
4.4. El Precio es neto para IPLAN, debiendo adicionársele el importe del impuesto al valor agregado aplicable de acuerdo a la legislación en vigencia o todo otro cualquiera que lo sustituya en el futuro, el cual será a cargo exclusivo del Cliente, junto con cualquier impuesto, tasa, carga o contribución específicos que se pudieren imponer en el futuro a IPLAN por la prestación de los Servicios.
4.5. Conforme a lo dispuesto en la Res. 2485/08 y sus modificatorias, la Administración Federal de Ingresos Públicos (AFIP) dispone la implementación del régimen de factura electrónica, en virtud de lo cual las facturas que emita IPLAN estarán disponibles con una antelación de diez (10) días a su fecha de vencimiento en el sitio web de IPLAN (www.iplan.com.ar) y deberán ser abonadas por el Cliente antes de la fecha de vencimiento para que el pago sea considerado en término. Para ser procedente todo reclamo que el Cliente pudiera tener sobre conceptos facturados, dicho reclamo deberá presentarlo ante el Centro de Atención al Cliente antes de la fecha de vencimiento de la respectiva factura.
4.6. En caso de mora del Cliente, la que se producirá en forma automática sin necesidad de intimación previa, el Cliente se obliga a pagar un interés equivalente a una vez y media la tasa activa cartera general diversa del Banco de la Nación Argentina.
4.7. La falta de pago por parte del Cliente facultará a IPLAN, a su exclusivo criterio, a resolver las Condiciones y/o suspender y/o dar de baja los Servicios. El ejercicio de cualquiera de estas opciones no liberará al Cliente de la obligación de abonar los montos adeudados con más sus accesorios. En caso que el Cliente cancelara el total de los montos adeudados, IPLAN cobrará al Cliente el costo de reconexión de los Servicios conforme a las condiciones comerciales vigentes y todo otro costo operativo en que pudiera incurrir IPLAN para restablecer los Servicios.
4.8. Los importes consignados en la factura podrán ser reclamados ante IPLAN, únicamente hasta los SESENTA (60) días corridos de la fecha de vencimiento de la misma. Transcurrido dicho plazo se considerarán aceptados de conformidad.
V.- PROPIEDAD Y USO DE LOS EQUIPOS
5.1. El Cliente reconoce que IPLAN es y continuará siendo durante todo el plazo de vigencia de la prestación de los Servicios titular del dominio de los equipamientos que utilice a los efectos de la prestación de los Servicios (“Equipamiento”). El Cliente como guardián y beneficiario de los Servicios que se prestan con el Equipamiento desde su instalación, tomará todas las medidas de hecho o de derecho, necesarias para evitar cualquier turbación de hecho y/o de derecho sobre el Equipamiento, comunicando a IPLAN cualquier circunstancia que potencialmente pudiera ocasionar u ocasione tal turbación en cuanto llegara a su conocimiento. En atención a lo establecido, IPLAN facturará al Cliente todos aquellos cargos que se originen en el proceso de recuperación y ejercicio del legítimo derecho de dominio sobre el Equipamiento en caso de tal turbación. En caso de robo o hurto del Equipamiento, el Cliente deberá efectuar dentro de las veinticuatro (24) horas de sucedido el siniestro, la denuncia policial, notificar a IPLAN sobre lo sucedido por escrito y adjuntar copia de la denuncia policial. IPLAN tomará las medidas apropiadas para la recuperación del Equipamiento, con cargo al Cliente, quien deberá hacerse asimismo responsable por el costo del Equipamiento.
5.2. El Cliente mantendrá completamente visible la leyenda colocada sobre el Equipamiento, señalando al Cliente y a terceros que IPLAN es el propietario del mismo. El Cliente no podrá vender, ceder, rentar u ofrecer como garantía, o disponer en cualquier manera, el Equipamiento o sus partes.
5.3. Finalizada la prestación de los Servicios, por cualquier motivo, el Cliente devolverá a IPLAN el Equipamiento en perfecto estado de conservación, dentro del plazo de tres (3) días contados desde la finalización de la prestación de los Servicios, sin que el Cliente tenga derecho a retener el Equipamiento por razón alguna. En caso que el Cliente se niegue a devolver el Equipamiento, el Cliente autoriza a IPLAN a facturarlo, de acuerdo al valor vigente de mercado.
VI.- RESPONSABILIDAD
6.1. IPLAN no será responsable por ningún daño ocurrido en las dependencias y/o equipos del Cliente como consecuencia de las tareas de conexión de los Servicios y/o instalación del Equipamiento, salvo que estos daños se hayan producido por negligencia del personal de IPLAN.
6.2. En ningún caso IPLAN será responsable por daño emergente (salvo dolo), lucro cesante y/o cualquier otra pérdida que pudiera sufrir el Cliente como consecuencia directa o indirecta de la prestación de los Servicios.
6.3. En ningún caso IPLAN será pasible de sanción por interrupción o falla del Servicio atribuible a caso fortuito o fuerza mayor.
6.4. La responsabilidad de IPLAN se extenderá como máximo y en cualquier caso, a las tres últimas facturas efectivamente pagadas por el Cliente y percibidas por IPLAN.
6.5. El Cliente efectuará un uso debido del Servicio y se abstendrá de realizar “Spamming” (envío indiscriminado de mensajes de correo electrónico con fines de publicidad a gente que no los solicita) y/o cualquier otro tipo de acción que pueda dañar a personas, sistemas, equipos o servicios accesibles directa o indirectamente a través de los Servicios. El no cumplimiento de esta disposición facultará a IPLAN a considerar que existe uso indebido y a resolver y/o suspender y/o dar de baja la prestación del Servicio.
6.6. IPLAN no será responsable por el contenido de la información o datos que circulen por su red, exonerando el Cliente a IPLAN de toda responsabilidad directa o indirecta que pudiera surgir en razón de cualquier infracción a las leyes de propiedad intelectual, difamación, calumnia y/o de cualquier otro acto de terceros fuera del control de IPLAN.
6.7. La responsabilidad de IPLAN en su calidad de prestador del servicio de telecomunicaciones y de conformidad con la normativa vigente, se extiende hasta la prestación del Servicio y no dentro de los límites internos de las redes informáticas y de telecomunicaciones del Cliente. IPLAN no asume responsabilidad alguna por vulneraciones de seguridad o ataques informáticos que reciba la red del Cliente.
VII.- DATOS PERSONALES
El Cliente toma conocimiento que los datos personales (nombre, domicilio, número de teléfono, persona de contacto y servicios contratados, e-mail, etc.) podrán utilizarse y divulgarse a terceros con fines comerciales siempre que los terceros cumplan con las políticas sobre uso y divulgación de datos personales. No obstante ello, IPLAN reformará, suprimirá, o actualizará cualquier dato en el supuesto que el Cliente así lo requiera de conformidad con lo establecido en la normativa aplicable que se transcribe a continuación:
Ley 25326 - art.27. - inc. 3. El titular podrá en cualquier momento solicitar el retiro o bloqueo de su nombre de los bancos de datos a los que se refiere el presente artículo.
El titular de los datos personales tiene la facultad de ejercer el derecho de acceso a los mismos en forma gratuita y a intervalos no inferiores a 6 meses, salvo que se acredite un interés legítimo al efecto conforme lo establecido por el artículo 14, inciso 3 de la ley 25326.
La DIRECCIÓN NACIONAL DE PROTECCIÓN DE DATOS PERSONALES, órgano de control de la ley Nº 25.326, tiene la atribución de atender las denuncias y reclamos que se interpongan con relación al incumplimiento de las normas sobre protección de datos personales
VIII.- AUTORIDAD DE APLICACION
El Ente Nacional de Comunicaciones es el órgano facultado para resolver en sede administrativa los reclamos de los clientes del servicio telefónico. Para el caso en que IPLAN preste al Cliente el servicio de telefonía, se aplicarán con carácter general las disposiciones del Reglamento General de Clientes del Servicio Básico Telefónico (Resolución SC Nº 10059/99) que el Cliente declara conocer y que se encuentra a su disposición en el sitio Web de IPLAN (www.iplan.com.ar).
IX.- DOMICILIO- JURISDICCION
IPLAN constituye domicilio en Reconquista 865, Piso 2°, Ciudad Autónoma de Buenos Aires, y el Cliente en el domicilio consignado en la Solicitud, sin perjuicio de lo cual cada parte podrá modificar su domicilio previa notificación fehaciente a la otra parte. Para cualquier divergencia que se pudiera suscitar, ambas partes se someten a la jurisdicción de los Tribunales Ordinarios de la Capital Federal, renunciando a cualquier otro fuero o jurisdicción que pudiera corresponder.

Translation - English GENERAL TERMS AND CONDITIONS FOR THE PROVISON OF SERVICES OF NSS S.A.
I. PURPOSE
In case the customer has formalized the contracting services, IPLAN shall provide the services (the Services) specified: i) in the document identified as Request for Services Form, and /or ii) in the confirmation email of the contracting services should the Customer have hired the same through IPLAN web page and /or iii) in the email of acceptance of proposal should the Customer have hired the service via email (any of them mentioned hereinafter as the “ Form”) The general terms and conditions (hereinafter, the “Conditions”) mentioned herein shall govern the provision of the Service/s. The Service/s shall be provided in accordance with the Conditions, the Request Form and the Scope of the appropriate Service/s.
II. INSTALLATION
2.1 The term for the installation and implementation of the Services included in the Request Form shall start at the moment the Customer submits to IPLAN the authorization and the necessary information to access the appointed addresses to install the required equipment for the provision of the Services and/ or provides the information and the configuration parameters required by the Services to be implemented, specified in the Service Scope.
2.2 The completion of installation and implementation tasks of the Services and the consequent activation shall be informed to the Customer through any of the following: i) email to the email address provided by the Customer in the Request Form, and/or ii) the delivery of a document to be signed by the Customer, to provide a record of the activation of the Services.
III. TERM. NEW CONDITIONS. TERMINATION
3.1 Both parties expressively acknowledge that the Services provided by IPLAN must be checked from time to time in reference to the conditions for the provision of the Services, for the purposes of keeping up with the competitiveness and market conditions.
3.2 Either the Customer or IPLAN may terminate the provision of the Services at any time with a (30) thirty-day reliable prior notice. The Customer is required to have paid in due date all the invoices issued by IPLAN and such must be fully paid, to be entitled to terminate the contract.
3.3 IPLAN may, at any time, establish new conditions for the provision of the Services except for price changes (the “New Conditions”.) The New Conditions shall be informed to the Customer by any of the following means: regular mail, fax, invoice or email, based on the information provided by the Customer to IPLAN, or through a publication on the web site: www.iplan.com.ar. Said communication shall be informed to the Customer thirty (30) days prior to its implementation. Should the Customer not express his will to terminate the contract to IPLAN within said term and should he/she continue using the Services, he/she shall be considered as having accepted the New Conditions.
3.4 IPLAN may inform the Customer, thirty (30) days prior to its implementation, of a new price of the Services by any of the following means: regular mail, fax, invoice or email based on the information provided by the Customer to IPLAN, or through a publication on the web site: www.iplan.com.ar. Should the Customer not express his will to terminate the contract to IPLAN within such thirty-day term and should he/she continue using the services, he/she shall be considered as having accepted the new price. In the event the Customer does not accept the new price, the end of service shall be processed on the date the Customer duly notifies it.
3.5 IPLAN may terminate the contract, without prior notice, in case of Customer’s bankruptcy or insolvency, precautionary legal agreement of its creditors, application for voluntary bankruptcy or insolvency proceedings or by third parties, or state receivership, settlement or dissolution of the Customer.
3.6 In the event the agreement is terminated by any reason and party before the initial term defined in the Services Request Form is finished, the Customer shall pay IPLAN the total amount of the fees to become due until the expiration of the minimum term set forth therein.
IV- PRICE- BILLING CONDITIONS- PAYMENTS
4.1 The Customer shall pay IPLAN for the installation charges, monthly payments and usage-based charges (jointly or individually, the “Price”) specified in the Request Form or in the applicable New Terms and Conditions, as set forth in section three.
IPLAN shall invoice the Customer with monthly payments in advance. The Installation charges may be invoiced as from the date of the formalization of Request Form. In turn the Usage-based Charges shall be informed in the corresponding invoice. The Customer must pay the Price regardless of the use of the Services.
4.2 The Customer may check the current prices for Local Calls, Long-distance Domestic calls and Long-distance International calls, together with the definition of destinations and fees on IPLAN website (www.iplan.com.ar)
4.3 The prices may be expressed in Pesos or US Dollars, as appropriate. The Prices expressed in US Dollars shall be billed in said currency and shall be paid in the same or in Argentinian Pesos at the current selling rate for the US Dollar quoted by the National Bank of Argentina (Banco de la Nación Argentina) applicable on the previous day of the due date of payment.
4.4 IPLAN provides a net price, the applicable valued added tax must be added in accordance with the current legislation, or any other applicable tax or duty in the future, which shall be entirely on the exclusive charge of the Customer, together with any other specific tax, rate, charge or contribution that may be imposed in the future to IPLAN for the provision of the Services.
4.5 Pursuant to Resolution 2485/08 and amendments, the Federal Public Revenue Administration (AFIP) establishes the implementation of electronic billing, wherefore invoices issued by IPLAN shall be available on IPLAN website (www.iplan.com.ar) ten (10) days prior to its due date and the Customer shall pay no later than that to be considered duly paid. Any complaint that the Customer may have about billing shall be made before the Customer Service Department before due date of said invoice.
4.6 In the event of delinquency by the Customer, which shall be generated automatically, without any prior notification of default, the Customer shall be obliged to pay an interest rate of one and a half times the general portfolio lending rate of the National Bank of Argentina (Banco de la Nación Argentina)
4.7 Non-payment by the Customer shall entitle IPLAN, at its sole discretion, to apply the Conditions and/ or suspend and/or terminate the Services. The exercise of any of these options shall not release the Customer to pay the amount owed together with their related costs. In the event the Customer should pay off the total amount owed, IPLAN shall charge the Customer with a reconnection fee for the Services pursuant to the applicable commercial conditions and any other operational cost IPLAN may incur to reconnect the Services.
4.8 The amounts included in the invoice may be claimed by the Customer before IPLAN only within a term of SIXTY (60) calendar days after its due date. After said term, the amounts shall be considered as accepted.
V. OWNERSHIP AND USE OF EQUIPMENT
5.1 The Customer acknowledges that IPLAN is and shall continue to be during the term of this provision of Services the owner of the equipment used to provide the Services (“Equipment”). The Customer as the guardian and beneficiary of the Services provided by means of such Equipment from the moment they are installed, shall take all the necessary measures, de facto or by law, to prevent any disruption de facto and/or by law of the equipment, informing IPLAN of any circumstances that may potentially or actually cause such disruption, as soon as he/she is aware of it. In view of the foregoing, IPLAN shall bill the Customer for all such charges originated in the recovery process and in exercise of its lawful ownership right upon the Equipment in case of such disruption. In the event of robbery or theft of the Equipment, the Customer shall file a police report within twenty-four (24) hours after the offense, and shall notify IPLAN in written of the event and attach a copy of the police report. IPLAN shall take all the necessary measures for the recovery of the Equipment, charging the Customer, who shall be also responsible for the cost of the same.
5.2 The Customer shall keep the legend showing the Customer and any third party that IPLAN is the sole owner of the Equipment, somewhere on the Equipment where it is clearly visible. The Customer shall not sell, assign, rent, or offer as a guarantee, or otherwise dispose of the Equipment or any of its parts.
5.3 Upon the completion of the Services, by any reasons, the Customer shall return the Equipment to IPLAN, in perfect condition, within the term of three (3) days after the completion of the Services; the Customer shall not have any right to withhold the Equipment by any reason. In the event the Customer refuses to return the Equipment, the Customer authorizes IPLAN to bill the same, at the current market value.
VI. LIABILITY.
6.1 IPLAN shall not be liable for any damages incurred in the premises and/or equipment of the Customer, as a consequence of Services connection tasks and/or installation of Equipment, except that said damages have been caused by negligence of IPLAN staff.
6.2 IPLAN shall not be liable in any case for consequential damages (except intent), loss of profits and/or any other loss that the Customer may suffer as a direct or indirect consequence of the provision of Services.
6.3 In no case IPLAN shall be liable to penalty for interruption or failure of Service due to unforeseeable circumstances or force majeure.
6.4 IPLAN liability shall be extended in any case and extent to the last three invoices duly paid by the Customer and received by IPLAN.
6.5 The Customer shall make a proper use of the Service and shall refrain from the activity of “Spamming” ( the abusive sending of emails with publicity purposes to people who have not asked for) and/or any other type of action that may damage people, systems, equipment or services directly or indirectly accessible through the Services. The breach of this provision shall entitle IPLAN to consider there exists improper use and to terminate, and/or suspend and/or end the provision of the Services.
6.6 IPLAN shall not be responsible for the content of the information or data circulating through its network, the Customer shall waive IPLAN from all direct and indirect liability that may arise from any infringement to the Intellectual Property Law, libel, calumny and/or any other act of third parties out of IPLAN’s control.
6.7 IPLAN, in its capacity of provider of telecommunications services and pursuant to the applicable legislation, limits its liability to the provision of Services and not to the internal limits of the Customer’s IT networks and telecommunications.
IPLAN is not liable for any security violation or cyber-attack to the Customer’s network.
VII. PERSONAL DATA.
The Customer is fully aware that his/her personal information (name, address, phone number, contact name and hired services, email address, etc.) may be used and disclosed to third parties with business purposes, provided that third parties shall comply with the Use and Disclosure of Personal Data policies. Notwithstanding the foregoing, IPLAN shall modify, delete or update any information at the Customer’s request, in accordance with the applicable regulation transcribed herein under:
Law 25326- Art. 27. (3). The bearer may at any time request the withdrawal or blocking of their name from the databases referred to in this article.
The bearer of personal data is entitled to exercise his right to access to such for free and every not shorter 6 months, except a lawful interest is credited pursuant to article 14, section 3 of Law 25326.
The NATIONAL BUREAU OF PERSONAL DATA PROTECTION, regulating office of Law Nº 25326, has the authority to receive complaints and claims related to the non-compliance of personal data protection standards.
VIII- ENFORCEMENT AUTHORITY
The National Registry of Communications is the agency entitled to seek an administrative settlement for the complaints filed by customers of phone services. In the event IPLAN should provide phone services to the Customer, the provisions of General Rules for Customers of Basic Phone Service (Resolution Nº 10059/99) shall generally apply, which the Customer states he is aware of and which is available on IPLAN website (www.iplan.com.ar)
IX- ADDRESS- JURISDICTION
IPLAN is domiciled at Reconquista 865, 2º floor, of the city of Buenos Aires, and the Customer is domiciled at such address included in the Request Form, notwithstanding the aforementioned the parties may modify their addresses with a prior reliable notice to the counter party. Both parties agree to submit any arising disputes to the Ordinary Courts of Buenos Aires, waiving to file a claim before any other court or jurisdiction that may apply.
