THIS IS A LEGAL AGREEMENT (THE “AGREEMENT”) BETWEEN YOU AND THE COCA-COLA COMPANY (“COMPANY”) STATING THE TERMS THAT GOVERN THE DOWNLOAD, INSTALLATION, AND USE OF THE SOFTWARE APPLICATION (THE “APPLICATION”). IF YOU DO NOT ACCEPT THEM, DO NOT DOWNLOAD, INSTALL OR USE THE APPLICATION. YOUR DOWNLOAD, INSTALLATION AND/OR USE OF THE APPLICATION IS SUBJECT TO THE TERMS OF THIS AGREEMENT. THE APPLICATION IS NOT INTENDED FOR USE WHILE OPERATING A MOTOR VEHICLE. YOU AGREE THAT YOU WILL NOT USE THE APPLICATION WHILE OPERATING A MOTOR VEHICLE OR IN ANY OTHER MANNER THAT WOULD BE UNSAFE TO YOURSELF OR TO OTHERS. YOU VOLUNTARILY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH AND/OR DAMAGE ASSOCIATED IN ANY WAY WITH DOWNLOADING, INSTALLING, AND/OR YOUR USE OF THE APPLICATION.
AGE REQUIREMENTS FOR USE OF THE APPLICATION. The Application is available for individuals aged 13 years or older. If you are 13 or older but under the age of 18, you should review these terms and conditions with your parent or guardian to make sure that you and your parent or guardian understand these terms and conditions.
OWNERSHIP OF CONTENT. Other than User Content (as defined below), the Application and all of its contents including, but not limited to, all text and images (“Content”) are owned and copyrighted by The Coca-Cola Company, its subsidiaries, sponsors or affiliated companies (collectively, “Affiliated Entities”) or others with all rights reserved unless otherwise noted. Any Content that is a trademark, logo or service mark is also a registered and unregistered trademark of Company or others. Your use of any Content, except as provided in this Agreement, without the written permission of the Content owner, is strictly prohibited. You are also advised that Company will aggressively enforce its intellectual property rights to the fullest extent of the law, including seeking criminal prosecution.
INSTALLATION AND USE. You may install and use a copy of the Application, subject to the terms of this Agreement and any applicable agreements with the applicable channel partners or associated service provider (collectively, “Channel Partner”). The Application is licensed, not sold, to you. Your license to the Application is subject to your prior acceptance of this Agreement. Company reserves all rights in and to the Application not expressly granted to you under this Agreement.
SYSTEM REQUIREMENTS. Use of the Application requires one or more compatible Mobile Devices, and Internet access (fees may apply), and may require obtaining updates or upgrades from time to time. Because use of the Application involves hardware, Software (as defined below), and Internet access, your ability to use the Application may be affected by the performance of these factors. High speed internet access is strongly recommended. You acknowledge and agree that such system requirements, which may be changed from time to time, are your responsibility.
SCOPE OF LICENSE. Company grants to you a non-exclusive, non-transferable, limited license to download, install, and/or use the Application on a Mobile Device that you own or control and as permitted by any applicable agreements with any Channel Partner. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the Application. You may not copy (except as expressly permitted by this Agreement), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the Application). Any attempt to do so is a violation of the rights of Company and its licensors. If you breach this restriction, you may be subject to prosecution and damages.
The Application may contain various contests, in which Company invites registered users to submit user-generated content (“User Content”) for display on the Application or a related website (“Site”) owned or operated by Company (a "Submission"). Each Submission must comply with the applicable rules set forth in the related Application. You may not use the Application in a manner that could interfere with any other party’s use and enjoyment of the Application (or servers or networks connected to the Application). The only Content you may download from the Application is Content made expressly for downloading by Company, such as wallpapers, screensavers, or ringtones. Such downloaded Content may be used only for non-commercial and personal use; provided that you retain all copyright and other proprietary notices contained on the Content. You must comply with all applicable laws, rules and regulations while using the Application. You are prohibited from using the Application to post or transmit any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability or otherwise violate any law. If applicable, you are prohibited from using the Application to impersonate any person or entity, including any moderator or any representative of the Company or its Affiliated Entities, or falsely stating or otherwise misrepresenting your affiliation with any person or entity in connection with the Application, or stating or implying that we endorse any statement you make. You are prohibited from using the Application to advertise or perform any commercial solicitation, or otherwise exploiting for any commercial purposes any portion of, use of or access to the Application. You are prohibited from using the Application to post or transmit any virus, worm, Trojan Horse, easter egg, time bomb, spyware or other computer code, file or program that is harmful or invasive or may or is intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment. You are prohibited from using the Application to violate the legal rights of others or harvest or collect personally identifiable information about users of the Application. You will not take any action to circumvent or defeat the security or Content usage rules provided, deployed or enforced by any functionality (including without limitation digital rights management functionality) contained in the Application. You will not remove, obscure, or alter the Company’s or any third party’s copyright notices, trademarks, or other proprietary notices affixed to or contained within or accessed in conjunction with or through the Application. You may not use the Application in any manner that could damage, disable, overburden, or impair the Application (or servers or networks connected to the Application).
The terms of this Agreement will govern any upgrades provided by Company that replace and/or supplement the original Application, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.
We reserve the right, at any time and from time to time, temporarily or permanently, in whole or in part, to: modify or discontinue the Application, the Services or the Software, with or without notice; limit the Application’s availability to any person, geographic area or jurisdiction we choose; charge fees in connection with the use of the Application; modify and/or waive any fees charged in connection with the Application; and/or offer opportunities to some or all users of the Application. You agree that neither we nor any Affiliated Entity shall be liable to you or to any third party for any modification, suspension or discontinuance of the Application, in whole or in part, or of any Service, Software, Content, Submission, feature or product offered through the Application. Your continued use of the Application after such changes will indicate your acceptance of such changes.
SOFTWARE, SERVICES, AND USER CONTENT.
The Company may from time to time provide users of the Application with access to certain specialized Content and interactive services through which you are able to display or post information and materials (such Content and services, collectively, the "Services"), and certain software tools that can be used for various purposes, including to play music provided by the Application, to interact with other Application users or to create content (the foregoing software and tools, collectively, the "Software").
The Services and Software, the information and materials made available through the Application and all software used to make the Application available are and shall remain the property of the Company and its licensors and suppliers, and are protected by copyright, trademark, patent, and/or other proprietary rights and laws. You agree to use the Application only on the device to which the Application was downloaded or installed, even if downloaded or installed pursuant to an unlimited or other long-term agreement, solely for your personal, non-commercial use. Certain Software may be governed by an additional end user license agreement or "EULA" to which you may be required to agree to before using such Software.
REGISTRATION; USER NAMES AND PASSWORDS.
You may be required to register with the Company in order to use the Application. With regard to any such registration, we may refuse to grant you, and you may not use, a user name (or e-mail address) that is already being used by someone else; that may be construed as impersonating another person; that belongs to another person; that violates the intellectual property or other rights of any person; that is offensive; or that we reject for any other reason in our sole discretion. You are responsible for maintaining the confidentiality of any password you may use to access the Application, and agree not to transfer your password or user name, or lend or otherwise transfer your use of or access to the Application, to any third party. You are fully responsible for all interaction with the Application that occurs in connection with your password or user name. You agree to immediately notify the Company of any unauthorized use of your password or user name or any other breach of security related to your account or the Application, and to ensure that you "log off"/exit from your account with the Application (if applicable) at the end of each session. We are not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.
PRIVACY. Any personal data (for example, your name, address, telephone number or e-mail address) you transmit to the Application by electronic mail or otherwise will be used by the Company in accordance with the Company’s Privacy Policy as posted. You represent and warrant that any information you provide in connection with your use of the Application is and shall remain true, accurate and complete. You agree that if any information you provide is false, inaccurate, obsolete or incomplete, we may terminate your use of the Application. The Company’s Privacy Policy explains how the Company treats your information and protects your privacy when you use the Application.
CONSENT TO USE OF DATA. You also agree that Company may collect location information about your device in order to allow the Application to provide certain services to you. Location data provided by the Application is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Use of real time route guidance is at your sole risk. Location data may not be accurate. Company does not guarantee the availability, accuracy, completeness, reliability, or timeliness of location data displayed in the Application.
TERMINATION. The license is effective until terminated by you or Company. Your rights under this license will terminate automatically without notice from Company if you fail to comply with any term(s) of this license. Upon termination of the license, you shall cease all use of the Application, and destroy all copies, full or partial, of the Application.
In addition, the Application is not available in all languages or in all countries. Company makes no representation that the Application is available for use in any particular location. To the extent you choose to access the Application, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. Company and its licensors reserve the right to change, suspend, remove, or disable access to the Application at any time without notice. In no event will Company be liable for the removal of or disabling of access to the Application. Company may also impose limits on the use of or access to the Application, in any case and without notice or liability.
DISCLAIMER OF WARRANTIES; LIABILITY LIMITATIONS.
COMPANY DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME COMPANY MAY REMOVE THE APPLICATION FOR INDEFINITE PERIODS OF TIME, OR CANCEL THE APPLICATION AT ANY TIME, WITHOUT NOTICE TO YOU.
YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, THE APPLICATION IS AT YOUR SOLE RISK. THE APPLICATION AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE APPLICATION ARE (EXCEPT AS EXPRESSLY STATED BY COMPANY) PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSION OF IMPLIED WARRANTIES MAY NOT APPLY TO YOU.
COMPANY AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, PRINCIPALS, LICENSORS, AND CHANNEL PARTNERS SHALL HAVE NO LIABILITY OF ANY KIND FOR ANY COSTS, INJURIES, LOSSES, OR DAMAGES (INCLUDING, WITHOUT LIMITATION ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES) ARISING FROM THE DOWNLOAD, INSTALLATION, AND/OR YOUR USE OF THE APPLICATION, THE SERVICES, SOFTWARE, CONTENT, OR USER CONTENT, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO DOWNLOADING, INSTALLING, AND/OR YOUR USE OF THE APPLICATION, THE SERVICES, SOFTWARE, CONTENT, OR USER CONTENT (INCLUDING, WITHOUT LIMITATION ANY CLAIM OR LIABILITY FOR ANY INJURY, DEATH, OR INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS), OR THE PERFORMANCE OR NONPERFORMANCE OF THE APPLICATION, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE APPLICATION, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, COMPANY’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW. You acknowledge and agree that any applicable Channel Partners are third party beneficiaries of this Agreement with respect to the provisions of this paragraph, and that, upon your acceptance of this Agreement, such Channel Partners will have the right (and will be deemed to have accepted the right) to enforce such provisions against you as a third party beneficiary thereof.
COMPANY SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE APPLICATION, BUT YOU ACKNOWLEDGE AND AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND COMPANY HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.
COMPANY DOES NOT REPRESENT OR GUARANTEE THAT THE SERVICE WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND COMPANY DISCLAIMS ANY LIABILITY RELATING THERETO.
With reference to any postings, submissions and the like that may be on the Application, Company assumes no responsibility or liability arising from any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability or otherwise violate any law, contained in any such locations on the Application.
LINK TO THIRD PARTY SITES.
The Application may contain links to sites owned or operated by parties other than Company. Such links are provided for your convenience only. The Company does not control, and is not responsible for, the content or privacy policies on, or the security of, such sites. Without limiting the foregoing, Company specifically disclaims any responsibility if such sites: (i) infringe any third party's intellectual property rights, (ii) are inaccurate, incomplete or misleading; (iii) are not merchantable or fit for a particular purpose; (iv) do not provide adequate security; (v) contain viruses or other items of a destructive nature; or (vi) are libelous or defamatory.
Company does not endorse the content, or any products or services available, on such sites. If you establish a link to such sites, you do so at your own risk and without the permission of Company. You will also be responsible for compliance with any applicable laws including, but not limited to, applicable local laws. Company reserves the right to change, suspend, remove, or disable access to any Application at any time without notice. In no event will Company be liable for the removal of or disabling of access to any Application. Company may also impose limits on the use of or access to any Application, in any case and without notice or liability.
INDEMNITY AND WAIVER OF LIABILITY.
You agree to defend, indemnify and hold harmless Company (and/or the Affiliated Entities), and/or its respective principals, or licensors and any other party involved in creating, producing or delivering the Application, and their respective directors, officers, employees, agents, shareholders, licensors and representatives, from and against all claims, losses, costs and expenses (including without limitation lawyers' fees) arising out of (i) your use of, or activities in connection with, the Application, the Services or the Software; (ii) any violation of this Agreement by you or through your account; (iii) any allegation that any Submission or User Content that you make available or create through the Application, the Services or the Software infringes or otherwise violates the copyright, trademark, trade secret, privacy or other intellectual property or other rights of any third party; or (iv) any action taken by Company as part of its investigation of a suspected violation of this Agreement or as a result of its finding or decision that a violation of this Agreement has occurred.
THIS INDEMNIFICATION AND WAIVER OF LIABILITY MEANS THAT YOU CANNOT SUE OR RECOVER ANY DAMAGES FROM COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, PRINCIPALS, AND LICENSORS AS A RESULT OF ITS DECISION TO REMOVE OR REFUSE TO PROCESS ANY INFORMATION OR CONTENT, TO WARN YOU, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE APPLICATION, OR TO TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF A SUSPECTED VIOLATION OR AS A RESULT OF COMPANY’S CONCLUSION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. THIS WAIVER AND INDEMNITY PROVISION APPLIES TO ALL VIOLATIONS DESCRIBED IN OR CONTEMPLATED BY THIS AGREEMENT.
EXPORT RESTRICTIONS. You may not use or otherwise export or re-export the Application except as authorized by United States law and the laws of the jurisdiction in which the application was obtained. In particular, but without limitation, the Application may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List. By downloading, installing, and/or using the Application, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture or production of nuclear, missiles, or chemical or biological weapons.
LAW AND JURISDICTION.
If you are a resident of the United States, Canada, Russia or Ukraine:
This Agreement and your use of the Application are governed by the laws of the State of Georgia, USA, without regard to its choice of law provisions. The courts of general jurisdiction located within Fulton County, Georgia, USA, will have exclusive jurisdiction over any and all disputes arising out of, relating to or concerning this Agreement and/or the Application or in which this Agreement and/or the Application are a material fact, and you waive any jurisdictional, venue or inconvenient forum objections to such courts.
If you are a resident of a country within Europe:
This Agreement and your use of the Application are governed by the laws of your country of residence. By using this Application you agree to submit to the exclusive jurisdiction of the courts of such country in the event of any dispute.
If you are a resident of a country in Africa or the Middle East:
This Agreement and your use of the Application are governed by the laws of the Republic of South Africa. By using this Application you agree to the exclusive jurisdiction of the High Court of South Africa (Witwatersrand Local Division or its successor) in the event of any dispute.
If you are a resident of India:
This Agreement and your use of the Application are governed by the laws of India. By using this Application you agree to submit to the exclusive jurisdiction of the Indian courts in the event of any dispute.
If you are a resident of a country in Asia other than India:
This Agreement and your use of the Application are governed by the laws of Australia. By using this Application you agree to submit to the exclusive jurisdiction of the Australian courts in the event of any dispute.
If you are a resident of a country in Latin America:
This Agreement and your use of the Application are governed by the laws of Mexico. By using this Application you agree to submit to the exclusive jurisdiction of the Mexican courts in the event of any dispute.
If you are a resident of any other country, this Agreement and your use of the Application are governed by the first paragraph of this Section.
MISCELLANEOUS. This Agreement constitutes the entire agreement between you and Company and governs your use of the Application, superseding any prior agreements between you and Company. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parities, and the remaining portions shall remain in full force and effect. Company’s failure to enforce any right or provisions in this Agreement will not constitute a waiver of such provision, or any other provision of this Agreement. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the other provisions will remain in full force and effect. Company will not be responsible for failures to fulfill any obligations due to causes beyond its control.

VLASNIŠTVO SADRŽAJA. INSTALACIJA I KORIŠTENJE. Smijete instalirati i koristiti kopiju Aplikacije, koja je predmet uvjeta ovog Ugovora i sličnih primjenjivih ugovora sa primjenjivim Partnerskim lancem ili pridruženim pružateljima usluga (zajedno „Partnerski lanac“). Aplikacija vam se daje na licencirano korištenje, a ne na prodaju. Pravo na korištenje Aplikacije predmet je gore prihvaćenog Ugovora. Kompanija zadržava sva prava na Aplikaciju koja nisu izričito navedena u ovom Ugovoru.
SUSTAVNI ZAHTJEVI. Korištenje Aplikacije zahtjeva jedan ili više kompatibilnih mobilnih uređaja i pristup internetu (naknade su moguće), te povremeno može zahtijevati preuzimanje ažuriranja ili nadogradnju. Budući da Aplikacija uključuje strojnu opremu, programsku opremu i pristup internetu, mogućnost korištenja Aplikacije pod utjecajem je ovih faktora. Brzi internet je preporučljiv. Ovime prihvaćate i slažete se da su takvi zahtjevi sustava, koji se povremeno mogu naplaćivati, vaša odgovornost.
PODRUČJE LICENCE. Kompanija Vam odobrava neisključivu, neprenosivu, ograničenu dozvolu za preuzimanje, instalaciju i/ili korištenje Aplikacije na mobilnom uređaju kojeg posjedujete ili nad kojim imate kontrolu prema primjenjivim ugovorima sa Partnerskim lancem. Ne smijete raspačavati Aplikaciju niti ju činiti dostupnom preko mreže gdje ju može koristiti više uređaja istovremeno. Ne smijete iznajmljivati, davati u zakup, posuđivati, prodavati, dalje distribuirati ili podlicencirati Aplikaciju. Ne smijete kopirati (osim ako je izričito dozvoljeno Ugovorom), dekompilirati, obavljati funkcionalnu analizu, rastavljati, pokušavati izvesti izvorni kôd, mijenjati ili činiti izvedenice Aplikacije, ažuriranja, niti dijelova iste (osim, do mjere do koje su gore navedene restrikcije zabranjene nadležnim zakonom, ili do mjere do koje je dozvoljeno ugovorom koji uređuje korištenje komponenti otvorenog koda kao dijela Aplikacije). Svaki pokušaj takvih radnji je povreda prava Kompanije i njenih nositelja licence. Ako prekršite ova ograničenja, možete biti izloženi kaznenom progonu i nadoknadi štete.
Aplikacija može sadržavati razna natjecanja, u kojima Kompanija poziva registrirane korisnike da podnesu korisnički generirane sadržaje („Korisnički sadržaj“) za prikazivanje na Aplikaciji ili vezanoj internetskoj stranici („Internetska stranica“) koja je vlasništvo i pod vodstvom Kompanije („Unošenje podataka“). Svako Unošenje podataka mora biti u skladu sa pravilima unaprijed postavljenima u Aplikaciji. Ne smijete koristiti Aplikaciju na način koji može ometati rad i uživanje druge stranke koja koristi Aplikaciju (ili servera ili mreža na koje se Aplikacija povezuje). Jedini Sadržaj koji smijete preuzimati sa Aplikacije je Sadržaj koji je Kompanija isključivo namijenila preuzimanju, kao što su slike za pozadine, slike za zaslone ili melodije. Takav preuzeti Sadržaj smije se koristiti isključivo u nekomercijalne i osobne svrhe; pod uvjetom da zadržite sva autorska prava i druge obavijesti o vlasništvu sadržane u Sadržaju. Morate se pridržavati svih primjenjivih zakona, propisa i pravila dok koristite Aplikaciju. Ne smijete koristiti Aplikaciju kako biste objavljivali ili prenosili prekršajne, prijeteće, krive, obmanjujuće, uvredljive, uznemirujuće, klevetničke, pogrdne, vulgarne, opscene, skandalozne, raspaljive, pornografske ili proste materijale koji predstavljaju ili potiču kriminalna djela, društvene reakcije ili krše bilo koje zakone. Ukoliko je primjenjivo, ne smijete koristiti Aplikaciju kako biste lažno predstavljali bilo koju osobu ili tijelo, uključujući bilo kojeg urednika ili predstavnika Kompanije ili Pripojenih tijela, ili lažno iznosili ili na bilo koji način krivo predstavljali vašu vezu sa osobama ili tijelima u vezi sa Aplikacijom, ili iznosili i implicirali kako mi odobravamo vaše izjave. Zabranjeno vam je koristiti Aplikaciju u svrhu reklamiranja ili komercijalnog posredovanja, te ikakvog iskorištavanja u komercijalne svrhe, bilo kojeg dijela, samog korištenja ili pristupa Aplikaciji. Zabranjeno vam je korištenje Aplikacije u svrhu širenja virusa, crva, trojanskih konja, uskršnjih jaja, vremenskih bombi, špijunskih programa ili drugih kompjuterskih kodova, datoteka ili programa koji su štetni ili invazivni te mogu ili su namijenjeni da oštete ili preuzmu provedbu i nadgledaju strojnu opremu, programsku podršku i opremu. Zabranjeno vam je koristiti Aplikaciju kako biste narušavali prava drugih da prikupljaju osobne podatke korisnika Aplikacije. Ne smijete poduzimate nikakve akcije zaobilaženja ili poništavanja sigurnosti ili osiguranih pravila korištenja Sadržaja, razvijenih ili provođenih od bilo koje funkcije (uključujući funkciju menadžmenta digitalnih prava bez ograničenja) sadržanih u Aplikaciji. Nećete uklanjati, prikrivati ili mijenjati obavijesti o autorskim pravima, zaštitnim znakovima ili druge vlasničke obavijesti Kompanije ili trećih strana, pridodane ili sadržane u ili unutar, ili raspoložive u kombinaciji ili kroz samu Aplikaciju). Ne smijete koristiti Aplikaciju ni na koji način koji može oštetiti, onesposobiti, preopteretiti ili narušiti Aplikaciju (ili servere ili mreže povezane sa Aplikacijom).
Uvjeti ovog Ugovora uređuju ažuriranja koje osigurava Kompanija koja nadomještavaju i/ili nadopunjuju izvornu Aplikaciju, osim ako takvo ažuriranje dolazi u pratnji drugačije licence, u kojem slučaju će uvjeti takve licence biti posebno uređeni.
Zadržavamo pravo da, u svakom trenutku ili povremeno, privremeno ili trajno, u cijelosti ili djelomično, prepravimo ili ukinemo Aplikaciju, usluge ili programsku podršku, sa ili bez obavijesti; ograničimo pristup Aplikaciji pojedincu, geografskom području ili nadležnosti prema našoj volji; naplaćujemo naknade u vezi sa korištenjem Aplikacije; prepravimo i/ili ukinemo naknade vezane za Aplikaciju; i/ili ponudimo mogućnosti nekim ili svim korisnicima Aplikacije. Pristajete da niti mi niti Pripojena tijela nećemo biti odgovorni vama niti trećoj strani za ikakve preinake, obustave ili ukidanje, u cijelosti ili djelomično, Aplikacije, usluga, Sadržaja, programske podrške, podnošenja, karakteristika ili proizvoda ponuđenih kroz Aplikaciju. Vaše opetovano korištenje Aplikacije nakon takvih izmjena ukazuje na prihvaćanje izmjena.
PROGRAMSKA PODRŠKA, USLUGE I KORISNIČKI SADRŽAJ.
Kompanija može povremeno omogućiti korisnicima Aplikacije pristup određenim Sadržajima i interaktivnim servisima kroz koje možete prikazivati ili objavljivati podatke i materijale (sadržaji i materijali nadalje zvani „Usluge“) i određenim programskim alatima koji se mogu koristiti u razne svrhe, uključujući puštanje glazbe preko Aplikacije, komunikaciju sa drugim Aplikacijama ili stvaranje Sadržaja (gore navedeni programski sadržaj i alati, nadalje „Programska podrška“)
Usluge i programska podrška, podaci i materijali dostupni kroz Aplikaciju i sva programska podrška korištena u izradi Aplikacije jesu i bit će vlasništvo Kompanije i njenih nositelja licence i dobavljača, te su zaštićeni autorskim pravom, zaštitnim znakovima, patentima i/ili drugim vlasničkim pravima i zakonima. Pristajete na korištenje Aplikacije samo na uređaju na kojem je Aplikacije preuzeta ili instalirana, iako preuzeta ili instalirana prema neograničenom ili dugoročnom dogovoru, isključivo za osobne, ne komercijalne potrebe. Određeni dijelovi programske podrške mogu biti uređeni dodatnim ugovorom za krajnje korisnike ili „EULA“ na kojeg ćete morati pristati prije korištenja takve programske podrške.
REGISTRACIJA; KORISNIČKA IMENA I LOZINKE
Možda bude potrebno registrirati se kod Kompanije kako biste mogli koristiti Aplikaciju. Vezano za registraciju, možemo odbiti vaš zahtjev, i možda nećete moći koristiti korisničko ime (ili adresu e-pošte) koje netko drugi već koristi, koja se može protumačiti kao lažno predstavljanje; koja pripada drugoj osobi; koja krši intelektualno vlasništvo ili druga prava bilo koje osobe; koja je uvredljiva; ili koju odbijamo iz bilo kojeg razloga prema vlastitom nahođenju. Vi ste odgovorni za održavanje tajnosti svake lozinke koju koristite za pristup Aplikaciji, te pristajete da ne prenosite lozinku ili korisničko ime, ne posuđujete ili na bilo koji drugi način prenosite korištenje ili pristup Aplikaciji trećoj strani. Vi snosite punu odgovornost za svaku interakciju sa Aplikacijom koja se dogodi vezano za vašu lozinku ili korisničko ime. Pristajete smjesta obavijestiti Kompaniju o neovlaštenom korištenju vaše lozinke ili korisničkog imena ili bilo kakav drugi proboj sigurnosti vezan za Aplikaciju, i da ćete se odjaviti/izaći iz svog računa pri Aplikaciji (ukoliko je moguće) na kraju svake sesije. Mi ne odgovaramo ni za kakav gubitak ili oštećenje koje proizađe iz nepoštivanja gore navedenih obaveza.
PRIVATNOST. Svaki osobni podatak (npr. ime, adresa, telefonski broj ili adresa e-pošte) koji šaljete Aplikaciji preko e-pošte ili kako drugačije, Kompanija će koristiti u skladu sa Kompanijinim pravilima kako je navedeno. Vi izjavljujete i jamčite da svi podaci koje date u vezi sa korištenjem Aplikacije jesu i ostat će istiniti, točni i potpuni. Slažete se da, ukoliko su podaci koje date krivi, netočni, zastarjeli ili nepotpuni, možemo ukinuti vašu mogućnost korištenja Aplikacije. Kompanijina izjava o privatnosti objašnjava kako Kompanija koristi vaše podatke i štiti vašu privatnost dok koristite Aplikaciju.
PRISTANAK NA KORIŠTENJE PODATAKA. Također, pristajete da Kompanija koristi lokacijske podatke vašeg uređaja kako bi omogućila Aplikaciji da vam pruži određene Usluge. Lokacijski podaci dobiveni preko Aplikacije koristit će se samo u osnovne navigacijske svrhe i ne može se na njih računati u situacijama kada je potreba precizna lokacija ili kada pogrešni, netočni ili nepotpuni lokacijski podaci dovedu do smrti, osobne ozljede ili oštećenja imovine ili okoliša. Korištenje navođenja u stvarnom vremenu je na vašu vlastitu odgovornost. Lokacijski podaci možda nisu točni. Kompanija ne garantira dostupnost, točnost, potpunost, pouzdanost ili pravovremenost lokacijskih podataka prikazanih u Aplikaciji.
RASKID. Licenca je na snazi dok ju ne raskinete vi ili Kompanija. Vaša prava tijekom korištenja licence će se prekinuti automatski bez upozorenja ako ne poštujete uvjet(e) licence. Po raskidu licence, prestat ćete svako korištenje Aplikacije, uništiti sve primjerke Aplikacije, djelomične ili potpune.
Nadalje, Aplikacija nije dostupna na svim jezicima niti u svim zemljama. Kompanija ne daje nikakve izjave da je Aplikacija dostupna ni na kojem određenom području. Do mjere do koje sami odlučite koristiti Aplikaciju, radite to na vlastitu inicijativu i sami odgovarate za usklađenost sa svim primjenjivim zakonima, uključujući ali ne ograničujući primjenjive lokalne zakone. Kompanija i nositelji licence zadržavaju pravo na izmjenu, obustavu, uklanjanje ili onemogućavanje pristupa Aplikaciji u svako doba bez obavijesti. Kompanija neće ni u kom slučaju biti odgovorna za uklanjanje ili onemogućavanje pristupa Aplikaciji. Kompanija također može nametnuti ograničenja na korištenje ili pristup Aplikaciji, u svako doba te bez obavijesti ili odgovornosti.

KOMPANIJA NE OSIGURAVA, NE PREDSTAVLJA ILI JAMČI DA ĆE VAŠE KORIŠTENJE APLIKACIJE BITI NEPREKIDANO I BEZ POGREŠAKA, I VI PRISTAJETE NA TO DA KOMPANIJA POVREMENO MOŽE UKLONITI APLIKACIJU NA NEODREĐENO VRIJEME ILI JU UKINUTI BEZ OBAVIJESTI.
IZRIČITO SE SLAŽETE DA JE VAŠE KORIŠTENJE, ILI NEMOGUĆNOST KORIŠTENJA APLIKACIJE, NA VLASTITI RIZIK. APLIKACIJA I SVI NJENI PROIZVODI I USLUGE KOJI SU VAM OMOGUĆENI KROZ APLIKACIJU SU (OSIM AKO JE IZRIČITO NAVEDENO OD STRANE KOMAPNIJE) TAKVI KAKVI JESU I KAO TAKVI SU VAM OMOGUĆENI NA KORIŠTENJE, BEZ IKAKVIH JAMSTAVA, IZRAVNIH ILI NEIZRAVNIH, UKLJUČUJUĆI SVA IZVEDENA JAMSTVA PRODAJE, PRILAGOĐENOST ODREĐENOJ SVRSI, ZVANJU I NEPOVREDIVOSTI. GORE NAVEDENE IZNIMKE SE MOŽDA NE ODNOSE NA VAS JER ODREĐENE ZAKONSKE INSTANCE NE DOZVOLJAVAJU IZNIMKE PODRAZUMJEVAĆIH JAMSTAVA.

KOMPANIJA ĆE KORISTITI RAZUMNE NAPORE DA ZAŠTITI PODATKE PRIBAVLJENE KROZ APLIKACIJU, ALI PRIHVAĆATE I PRISTAJETE DA TAKVE PODATKE UNOSITE NA VLASTITI RIZIK., I KOMPANIJA SE ODRIČE BILO KAKVE ODGOVORNOSTI PREMA VAMA ZA IKAKVE GUBITKE ILI ODGOVORNOSTI ZA TAKVE PODATKE U BILO KOJEM SMISLU.
KOMPANIJA NE PREDSTAVLJA ILI JAMČI DA ĆE USLUGA BITI BEZ GUBITAKA, OŠTEĆENJA, NAPADA, VIRUSA, OMETANJA, HAKIRANJA ILI DRUGIH SIGURNOSNIH PROVALA, TE SE ODRIČE ODGOVORNOSTI VEZANO ZA ISTE.
VEZANO ZA OBJAVE, UNOŠENJA I SLIČNE FUNKCIJE APLIKACIJE, KOMPANIJA NE PREUZIMA NIKAKVU ODGOVORNOST ZA NARUŠAVANJE, PRIJETNJE, LAŽNE, OBMANJUJUĆE, UVREDLJIVE, UZNEMIRUJUĆE, POGRDNE, KLEVETNIČKE, VULGARNE, SKANDALOZNE, RASPALJIVE, PORNOGRAFSKE ILI PROSTE MATERIJALE, ILI BILO KAKVE MATERIJALE KOJI MOGU SAČINJAVATI ILI POTICATI PONAŠANJA KOJA SE MOGU SMATRATI KAZNENIM PREKRŠAJEM, POTICATI NA DRUŠTVENE REAKCIJE ILI NA BILO KOJI NAČIN DOVESTI DO KRŠENJA ZAKONA, A SADRŽANI SU BILO GDJE U APLIKACIJI.
POVEZANOST SA INTERNETSKIM STRANICAMA TREĆIH STRANA.
Aplikacija može sadržavati poveznice za internetske stranice kojima rukovode tijela nevezana za Kompaniju. Takve poveznicu su osigurane isključivo radi vaše udobnosti. Kompanija nema kontrole i nije odgovorna za sadržaj ili pravila o privatnosti niti za sigurnost istih. Bez ograničavanja istih, Kompanija se osobito odriče u slučaju da te internetske stranice: (i) naruše intelektualno vlasništvo treće strane (ii) su netočne, nepotpune ili obmanjujuće; (iii) ako nisu pogodne za prodaju ili ne služe određenoj svrsi; (iv) ne pružaju primjerenu sigurnost (v) sadrže viruse ili druge predmete štetne prirode; ili (vi) su pogrdni ili klevetnički.
Kompanija ne podržava sadržaj, proizvode niti usluge dostupne na takvim internetskim stranicama. Ako uspostavite vezu sa takvim internetskim stranicama, činite to na vlastitu odgovornost bez dozvole Kompanije. Također ćete biti odgovorni za provođenje primjenjivih zakona, ali ne ograničavajući se na lokalne zakone. Kompanija zadržava pravo na promjenu, obustavu, uklanjanje ili onemogućavanje pristupa Aplikaciji. Kompanija Također može nametnuti ograničenja na korištenje ili pristup Aplikaciji, u bilo kojem slučaju bez upozorenja ili odgovornosti.
NAKNADA ŠTETE I ODRICANJE OD ODGOVORNOSTI.
Pristajete braniti, osigurati i štititi Kompaniju (i/ili Pripojena tijela) i/ili dotične upravitelje, davatelje licence ili bilo koje druge stranke uključene u stvaranje, proizvodnju ili dostavljanje Aplikacije, te dotične rukovoditelje, službenike, zaposlenike, agente, dioničare, nositelje licenci ili predstavnike, od ili protiv svih potraživanja, gubitaka, troškova ili izdataka (uključujući odvjetničke naknade bez ograničenja) koji proizađu iz (i) vašeg korištenja ili aktivnosti na vašem računu (ii) vašeg kršenja Ugovora kroz Aplikaciju (iii) bilo kakvih navoda da Unošenje podataka ili Korisnički sadržaj koji učinite dostupnim ili stvorite putem Aplikacije, Usluga ili korisničke podrške narušavaju ili na bilo koji način krše autorska prava, zaštitne znakove, poslovne tajne, privatnost ili intelektualno vlasništvo ili druga prava bilo koje treće strane; ili (iv) bilo koje radnje Kompanije kao dijela istrage zbog sumnje na kršenje Ugovora ili kao rezultat te istrage ili odluke da je do kršenja Ugovora došlo.
OVAJ ISKAZ O NAKNADI ŠTETE I ODRICANJU OD ODGOVORNOSTI ZNAČI DA NE MOŽETE TUŽITI ILI POTRAŽIVATI ODŠTETU OD KOMPANIJE, NJENIH RUKOVODITELJA, SLUŽBENIKA, ZAPOSLENIKA, PRIPOJENIH TIJELA, AGENATA, IZVODITELJA RADOVA, UPRAVITELJA I NOSITELJA LICENCI ZBOG NJIHOVE ODLUKE DA UKLONE ILI ODBIJU OBRADITI BILO KOJE PODATKE ILI SDARŽAJ , DA VAS UPOZORE, DA OBUSTAVE ILI UKINU VAŠ PRISTUP APLIKACIJI, ILI DA PODUZMU DRUGE RADNJE TIJEKOM ISTRAGE NAVODNOG KRŠITELJA KAO REZULATAT KOMPANIJINOG ZAKLJUČKA DA SE DOGODILO KRŠENJE UGOVORA. OVA ODREDBA O NENADOKNAĐIVANJU ŠTETE ODNOSI SE NA SVE PREKRŠAJE OPISANE ILI RAZMATRANE U UGOVORU.
IZVOZNA OGRANIČENJA. Ne smijete koristiti ili na bilo koji drugi način izvoziti ili prevoziti Aplikaciju osim kako je dozvoljeno američkim zakonom i zakonom pravnih instanci preko kojih je Aplikacija pribavljena. Posebice, ali bez ograničenja, Aplikacija se ne smije izvoziti ili prevoziti u (a) zemlje nad kojima SAD ima embargo ili (b) bilo kojem pojedincu na popisu američkog Ministarstva financija navedenom kao posebno određeni stanovnik ili osobama na popisu odbijenih američkog Ministarstva trgovine. Preuzimanjem, instaliranjem i/ili korištenjem Aplikacije, vi tvrdite i jamčite da se ne nalazite, niste pod utjecajem, ili niste državljanin ili boravite u bilo kojoj od gore navedenih zemalja, te niste ni na kojem od gore navedenih popisa. Također pristajete da nećete koristiti ove proizvode u bilo koje svrhe zabranjene američkim zakonom, uključujući bez ograničenja, razvoj, nacrt, izradu ili proizvodnju nuklearnog oružja, projektila, kemijskog ili biološkog oružja.
ZAKON I NADLEŽNOST.
Ako ste državljanin Sjedinjenih Američkih Država, Kanade, Rusije ili Ukrajine:
Ovaj Ugovor i vaše korištenje Aplikacije uređeno je zakonima države Georgije (SAD), bez obzira na izbor zakonskih odredbi. Sudovi opće nadležnosti smješteni u Fulton Countyju (Georgia, SAD) imaju isključivu nadležnost nad svim sporovima proizašlim, povezanim ili u pogledu ovog Ugovora i/ili Aplikacije ili u kojem su ovaj Ugovor i/ili Aplikacija materijalna činjenica, te se odričete bilo kakvih prigovora na nadležnost, mjesto ili nepogodnost takvih sudova.

Ovaj Ugovor i korištenje Aplikacije uređeni su zakonima zemlje koje ste državljanin. Korištenjem Aplikacije pristajete na isključivu nadležnost sudova te zemlje u slučaju spora.
Ako ste stanovnik afričkih zemalja ili Bliskog istoka:
Ovaj Ugovor i korištenje Aplikacije uređeni su zakonima Južnoafričke Republike. Korištenjem Aplikacije pristajete na isključivu nadležnost Visokog suda Južne Afrike (Witwatersrand lokalni odjeljak ili njegov nasljednik) u slučaju spora.
Ako ste stanovnik Indije:
Ovaj Ugovor i korištenje Aplikacije uređeni su zakonima Indije. Korištenjem Aplikacije pristajete na isključivu nadležnost indijskih sudova u slučaju spora.
Ako ste stanovnik azijskih zemalja, osim Indije:
Ovaj Ugovor i korištenje Aplikacije uređeni su zakonima Australije. Korištenjem Aplikacije pristajete na isključivu nadležnost australskih sudova u slučaju spora.
Ako ste stanovnik zemalja Latinske Amerike:
Ovaj Ugovor i korištenje Aplikacije uređeni su zakonima Meksika. Korištenjem Aplikacije pristajete na isključivu nadležnost meksičkih sudova u slučaju spora.
Ako ste stanovnik bilo koje druge zemlje, ovaj Ugovor i korištenje Aplikacije uređeni su prvim stavkom ovog
odjeljka.
OSTALO. Ovaj Ugovor predstavlja čitav dogovor između vas i Kompanije i uređuje vaše korištenje Aplikacije, te zamjenjuje prvotne dogovore između vas i Kompanije. Ako je ikoji dio ovog Ugovora nevažeći ili neprovediv, taj dio će se tumačiti na način suglasan primjenjivim zakonima, i to što sličnije izvornim namjerama stranaka, dok ostali dijelovi ostaju na snazi u potpunosti. Kompanijina nemogućnost da provodi bilo koja prava i odredbe ovog Ugovora ne određuje odricanje od takvih odredbi, ili bilo kojih drugih odredbi Ugovora. Ako nadležni sud bilo bilo koju odredbu ovog Ugovora proglasi nevažećom, ostale odredbe ostaju na snazi. Kompanija nije odgovorna za propuste u ispunjavanju obaveza koji su van njenog utjecaja.
