1 Onderzoek van de zaak
De zaak is inhoudelijk behandeld op de zittingen van 1 november 2017, 3 november 2017 en 6 november 2017. De verdachte en haar raadsman zijn verschenen. De officieren van justitie en de verdediging hebben hun standpunten kenbaar gemaakt. Op 1 december 2017 is het onderzoek ter terechtzitting formeel gesloten. Bij die gelegenheid waren de verdachte en haar raadsman niet aanwezig.
2 De tenlastelegging
De tenlastelegging is als bijlage aan dit vonnis gehecht.
De verdenking komt er, kort en feitelijk weergegeven, op neer dat de verdachte heeft deelgenomen aan een criminele organisatie die gericht was op het plegen van fraude met persoonsgebonden budgetten.
3 De beoordeling van het bewijs
3.1 Het standpunt van de officieren van justitie
De officieren van justitie hebben zich, zoals weergegeven in het door hen ter terechtzitting overgelegde requisitoir, op het standpunt gesteld dat het tenlastegelegde feit bewezen kan worden verklaard. Zij baseren hun standpunt op de in het dossier aanwezige processen-verbaal van verhoor van verdachten, processen-verbaal van verhoor van getuigen en overige documenten waaronder verantwoordingsformulieren, declaratieformulieren en nota’s.
3.2 Het standpunt van de verdediging
De verdediging heeft zich voor wat betreft de bewezenverklaring aan het oordeel van de rechtbank gerefereerd, behoudens de ten laste gelegde periode. De periode van 1 februari 2010 tot en met 31 december 2011 en de periode van 1 januari 2013 tot en met 23 mei 2014 kunnen volgens de raadsman niet bewezen worden verklaard. De verdachte heeft namelijk in die perioden niet gewerkt voor [medeverdachte 1] ( [medeverdachte 1] ) en uit haar fiscale gegevens blijkt ook niet dat zij in die perioden een salaris of een vergoeding heeft ontvangen.
3.3 Het oordeel van de rechtbank 1
Algemeen
Deze strafzaak is de uitkomst van een onderzoek door de Inspectie SZW van het Ministerie van Sociale Zaken en Werkgelegenheid. Het onderzoek draagt de naam Contone en gaat over fraude met persoonsgebonden budgetten (PGB’s).
In de periode waarop de tenlastelegging ziet, is het PGB een voorziening uit de Algemene Wet Bijzondere Ziektekosten (AWBZ). Met een PGB kan iemand die vanwege ziekte, handicap of ouderdom zorg nodig heeft, deze zorg zelf inkopen bij (bijvoorbeeld) een zorgbureau. Om een PGB te krijgen is een indicatie nodig. Deze indicatie moet worden aangevraagd bij het Centrum Indicatiestelling Zorg (CIZ). Als de aanvraag is goedgekeurd, geeft het CIZ een indicatiebesluit af. In dit besluit staat dan de zorgbehoefte, waarmee wordt bedoeld het aantal uren, de klasse en het type zorg dat de aanvrager nodig heeft. Met dit indicatiebesluit kan vervolgens een PGB worden aangevraagd bij een zorgkantoor. Het zorgkantoor betaalt dan het toegekende PGB uit bij wijze van voorschot. Het PGB wordt door het zorgkantoor in beginsel overgemaakt op een daarvoor speciaal bestemde bankrekening op naam van de persoon voor wie de zorg bestemd is. Deze wordt daarmee budgethouder. De budgethouder sluit daarna een zorgovereenkomst af met personen en/of bedrijven die de zorg gaan leveren en betaalt hun vanuit het PGB. Deze personen en/of bedrijven declareren hun werkzaamheden bij de budgethouder. Voor het declareren van de
zorg heeft de overheid regels opgesteld. Deze regels zien o.a. op welke activiteiten als zorg kunnen worden gezien2 en hoe zorg gedeclareerd moet worden. Zo mag zorg enkel worden gedeclareerd voor zover deze daadwerkelijk is geleverd en moet, tenzij de zorgkantoren en zorgaanbieders daarvoor een bestendige gedragslijn hebben, geleverde zorg per vijf minuten worden gedeclareerd.3 Uit diverse zich in het strafdossier bevindende zorgovereenkomsten die door zorgverleners zijn gesloten met budgethouders4 is de rechtbank niet gebleken dat afspraken zijn gemaakt over de afronding van geleverde zorg. Dat betekent dat geleverde zorg dus per vijf minuten moet worden gedeclareerd, waarbij afronding naar boven is toegestaan.5 Van de besteding van het PGB moet de budgethouder een administratie bijhouden. Hij of zij moet ook regelmatig verantwoording afleggen aan het zorgkantoor. Deze verantwoording gebeurt door het indienen van een verantwoordingsformulier bij het zorgkantoor. Op dit formulier moet dan o.a. worden ingevuld hoeveel betaald is aan de zorgverleners. Het zorgkantoor controleert achteraf of de formulieren correct zijn ingevuld en kijkt daarbij dan naar contracten, declaraties en bewijzen van betalingen. Blijkt na controle dat het budget correct is besteed aan zorg, dan wordt het voorschot omgezet in een definitieve vaststelling.
Verdachten
De door de Inspectie SZW onderzochte fraude zou gepleegd zijn door een aantal personen. Het betreft hier:
[medeverdachte 10] ,
[medeverdachte 2] ,
[medeverdachte 3] ,
[verdachte] ,
[medeverdachte 5] ,
[medeverdachte 6] en
[medeverdachte 7] .
Deze personen zullen hierna telkens met hun voornaam worden aangeduid. Dat voor de leesbaarheid van het vonnis.
Ook zouden bij de fraude betrokken zijn:
de besloten vennootschap met beperkte aansprakelijkheid: [medeverdachte 8] ,
de vennootschap onder firma: [medeverdachte 9] en
de vennootschap onder firma: [medeverdachte 1] ( [medeverdachte 1] ).
Dit zijn rechtspersonen of samenwerkingsverbanden die volgens de wet (artikel 51, derde lid, van het Wetboek van Strafrecht) met rechtspersonen gelijk moeten worden gesteld. Deze rechtspersonen zullen hierna, voor de leesbaarheid van het vonnis, worden aangeduid met [medeverdachte 8] , [medeverdachte 9] en [medeverdachte 1] .
Over deze verdachten merkt de rechtbank het volgende op.
[medeverdachte 1]
stond van 1 januari 2007 tot en met 1 juni 2015 ingeschreven in het handelsregister van de Kamer van Koophandel als bemiddelingsbureau voor particuliere thuiszorg.
Als vennoten staan ingeschreven:
- [medeverdachte 6] , sinds 1 januari 2007;
- [medeverdachte 8] , sinds 30 september 2008.6
[medeverdachte 10] is enig aandeelhouder en bestuurder van [medeverdachte 8] sinds de oprichting van deze vennootschap op 30 september 2008.7
Zowel [medeverdachte 10]8 als [medeverdachte 6]9 heeft over de oprichting en de feitelijke werkzaamheden van [medeverdachte 1] een verklaring afgelegd. Uit die verklaringen komt het volgende naar voren.
Oprichting [medeverdachte 1]
Beiden hebben over [medeverdachte 1] verklaard dat het bedrijf in 2005 is gestart als eenmanszaak op naam van [medeverdachte 6] . [medeverdachte 10] was toen namelijk nog gebonden aan een concurrentiebeding van een bedrijf dat zij daarvoor had. De vennoten van [medeverdachte 1] zijn [medeverdachte 6] en [medeverdachte 10] , met dien verstande dat [medeverdachte 10] in [medeverdachte 1] zit met haar bv [medeverdachte 8] . Naast een zakelijke verhouding is er ook sprake van een familieverhouding: [medeverdachte 10] is een tante van [medeverdachte 6] . Sinds 2007, toen [medeverdachte 1] een vennootschap onder firma werd, rust de aansprakelijkheid voor de helft op [medeverdachte 6] en voor de helft op [medeverdachte 10] . Ook de winstverdeling is gelijk.
Activiteiten [medeverdachte 1]
[medeverdachte 6] heeft verklaard dat de insteek was om een soort uitzendbureau te zijn met een bestand van zorgverleners, die ingezet konden worden bij mensen die zorg nodig hadden. De clientèle van [medeverdachte 1] betrof dus zowel budgethouders als zorgverleners, zo begrijpt de rechtbank uit de verklaring van [medeverdachte 6] . Een van de hoofdactiviteiten van [medeverdachte 1] was het inzetten van zorgverleners, zoals huishoudelijke hulp en verpleegkundigen. Die zorgverleners waren zelfstandig en niet in loondienst van [medeverdachte 1] . [medeverdachte 1] stelde wel regels op en maakte een dossier aan per budgethouder. [medeverdachte 1] maakte roosters voor de budgethouders en de zorgverleners. Ook [medeverdachte 10] omschrijft [medeverdachte 1] als een bemiddelingsbureau tussen zorgaanvrager en zorgverlener op het gebied van huishoudelijke hulp, verzorging, verpleging en ondersteunende begeleiding.
Wanneer zorgverleners via [medeverdachte 1] ingezet werden bij budgethouders waren de zorgverleners bemiddelingskosten aan [medeverdachte 1] verschuldigd ter hoogte van 10% over de gewerkte uren, exclusief btw. Nadat zorgverlener en budgethouder met elkaar in contact waren gebracht via [medeverdachte 1] bleven deze bemiddelingskosten doorlopen omdat [medeverdachte 1] werkzaamheden voor de zorgverleners bleef verrichten. [medeverdachte 6] noemt als voorbeelden het maken van planningen en het regelen van vervanging.

1 Case Investigation

2 The Indictment
The indictment is attached to this judgement as an appendix.
In summary, the charge is that the defendant took part in a criminal organisation whose aim was to commit fraud in relation to personal budgets.
3 The assessment of the evidence
The position of the public prosecutors
As indicated in the closing arguments they submitted during the trial, the public prosecutors took the position that the charge had been proven.
They based their position on the police reports of the interrogation of suspects, police reports of the interrogation of witnesses and other
documents including accountability forms, claim forms and invoices as present in the dossier.
The position of the defence
With regard to judicial findings, the defence left that to the judgement of the court, except for the last charged period.
The period from 1 February 2010 to 31 December 2011 inclusive and the period from 1 January 2013 to 23 May2014 inclusive could not be deemed proven
according to the counsel for the defence.
The defendant had not actually worked for [co-defendant 1] ( [co-defendant 1] ) in those periods and from her fiscal data it appeared that she had
not received a salary or any payment in those periods.
The judgement of the court 1
General
This criminal case is the result of an investigation by the Inspectorate SZW of the Ministry of Social Affairs and Employment.
The investigation bears the name Contone and concerns fraud in relation to personal budgets (PGBs).
In the period covered by the indictment, the PGB is a provision under the Exceptional Medical Expenses Act (AWBZ)
Using a PGB, a person who needs care owing to sickness, handicap or old age, can purchase this care themselves from (for example) a healthcare
agency.
In order to receive a PGB, an assessment is required.
The assessment has to be applied for at the Care Assessment Centre (CIZ)).
If the application is approved, the CIZ issues an assessment decision.
This decision states the care requirement, that is, the number of hours, the class and type of care that the applicant needs.
Once the assessment decision has been obtained, a PGB can be applied for at a care administration office.
The care administration office then pays out the allocated PGB as an advance.
In principle, the PGB is transferred to a specially dedicated bank account in the name of the person for whom the care is intended.
This person becomes the budget holder.
The budget holder then enters into a care agreement with persons and/or firms that will provide the care and pays them out of the PGB.
These persons and/or firms declare their work to the budget holder.
The government has established rules for the declaration of care.
Among other things, these rules state which activities can be regarded as care2 and how care is to be declared.
Thus, care can be declared in so much as was actually provided and must, unless the care assessment offices and care providers have a consistent
policy for this, be declared as care provided per five minutes.3From various care agreements present in the criminal file which were made between
care providers and budget holders, 4 it did not appear to the court that agreements were made about the rounding-up of provided care.
That means that the care provided had to be declared per five minutes, with rounding upwards permitted.5The budget holder has to keep records of PGB
expenditure.
He or she must also regularly make account to the care administration office.
This account takes the form of an accountability form for the care administration office.
Amongst other things, details about how much has been paid to the care providers has to be completed on this form.
The care administration office checks afterwards whether the forms have been completed properly by examining the contracts, declarations and proofs
of payments.
If the check confirms that the budget has been correctly spent on care, then the advance is converted into a final determination.
Defendants
The fraud investigated by the Inspectorate SZW was committed by a number of persons.
These were:

These persons will hereafter be referred to by their first names.
That is for the readability of the judgement.
Also implicated in the fraud:
the private company with limited liability: [co-defendant 8]
the partnership firm: [co-defendant 9] and
the partnership firm: [co-defendant 1] ( [co-defendant 1] ).
These are legal entities or joint ventures which, according to the law (Article 51, third paragraph, of the Criminal Code) must be equated with
legal persons.
Henceforth, these legal entities, for readability of the judgement, will be referred to as [co-defendant 8], [co-defendant 9] and [co-defendant 1].
The court notes the following about these defendants.
[co-defendant 1] ,
was recorded in the business register of the Chamber of Commerce as an intermediary agency for private homecare from 1 January 2007 to 1 June 2015
inclusive.
The following are recorded as partners:
[co-defendant 6], since 1 January 2007;
[co-defendant 8] , since 30 September 2008.6
[co-defendant 10] is the only shareholder and director of [co-defendant 8] since the incorporation of this company on 30 September 2008.7
Both [co-defendant 10]8 and [co-defendant 6]9 have made a statement about the incorporation and the actual activities of [co-defendant 1].
Those statements provide the following information.
Incorporation [co-defendant 1]
Both have stated about [co-defendant 1] that the business was started in 2005 as a one-man business in the name of [co-defendant 6]. [Co-defendant
10] was then actually still bound by a competition clause of a business she had previously had.
The partners of [co-defendant 1] are [co-defendant 6] and [co-defendant 10] , it being understood that [co-defendant 10] in [co-defendant 1] is in
her private company [co-defendant 8] .
In addition to the business relationship, there was also a family relationship: [co-defendant 10] is the aunt of [co-defendant 6].
Since 2007, when [co-defendant 1] was established as a partnership, half of the liability rests with [co-defendant 6] and half with [co-defendant
10].
And any profit is shared equally.
Activities [co-defendant 1]
[Co-defendant 6] stated that the approach was to act as a type of employment agency with a bank of care providers who could be employed by people
needing care.
From the statement by [co-defendant 6], the court understands that the clientele of [co-defendant 1] thus consisted of both budget holders and care
providers.
One of the main activities of [co-defendant 1] was the deployment of care providers, such as domestic help and nurses.
The care providers were independent and not in paid employment of [co 1]. [Co-defendant 1]did draw up rules and kept a dossier for each budget
holder. [Co-defendant 1] made schedules for the budget holders and the care providers.
[Co-defendant 10] also describes [co-defendant 1] as an intermediary agency between care applicant and care provider in the field of domestic help,
care, nursing, and supportive guidance.
When care providers were deployed via [co-defendant 1] to budget holders, the care providers owed middle-man costs to [co-defendant1] amounting to
10% of the hours worked, excluding VAT.
After care provider and budget holder were put in touch with each other via [co-defendant 1], these middle-man costs continued because [co-defendant
1] continued to perform activities for the care providers. As examples, [co-defendant 6] names the making of schedules and arranging replacements.

Малообеспеченные семьи получат дополнительные пособия на детей. Кроме того, будет расширен перечень целей, на которые можно будет потратить материнский капитал. Государство заплатит за рождение первенца
Один из законов наделяет малообеспеченные семьи правом на получение выплат за рождение первого и второго ребёнка. Соответствующее пособие будет выплачиваться с 1 января 2018 года семьям со среднедушевым доходом, не превышающим 1,5 кратную величину прожиточного минимума в регионе.
«Разница в том, что средства на пособия на первого ребёнка будут перечисляться в виде субвенций из федерального бюджета в бюджеты субъектов Федерации. На второго ребёнка выплаты будут осуществляться из средств материнского капитала», — пояснил министр труда и социальной защиты Максим Топилин.
Размер выплат составит размер прожиточного минимума ребёнка в том субъекте Федерации, где живёт семья. Второй закон предполагает продление программы материнского капитала на три года, а также расширяет перечень целей, на которые эти средства можно потратить. Так, в перечень целей попадёт дошкольное образование в ясельных группах.
МРОТ приблизится к прожиточному минимуму
С 2018 года минимальный размер оплаты труда (МРОТ) повысится до 85 процентов прожиточного минимума, а в 2019 году они сравняются. При этом в законе предусмотрено, что в случае снижения фактического прожиточного минимума, величина МРОТ уменьшаться не будет.
Размер МРОТ в 2018 году составит 9489 рублей.
Председатель Комитета Совета Федерации по социальной политике Валерий Рязанский подчеркнул, что указанный закон можно назвать судьбоносным. «На протяжении последних лет мы каждый год принимали закон, приближающий МРОТ к уровню прожиточного минимума, — сказал сенатор. — Этот документ подводит финишную черту под этими процессами».
Ставку акцизов на бензин повысят
Ставки акцизов на литр автомобильного бензина и дизельного топлива будут увеличены на 50 копеек.
Как пояснил заместитель министра финансов Илья Трунин, такая мера принесёт бюджету 55 миллиардов рублей дополнительного дохода. Также с Нового года увеличатся ставки на сигареты, папиросы, табак, сигары, сигариллы, электронные системы доставки никотина и жидкости для них.
Как изменятся цены в наступающем году
Скорректируют и ставки акцизов для легковых автомобилей. В 2018 году ставка для машин с мощностью двигателя от 200 до 300 лошадиных сил составит 714 рублей за 1 лошадиную силу, с мощностью двигателя от 300 до 400 — 1218 рублей, с мощностью двигателя от 400 до 500 — 1260 рублей, с мощностью двигателя более 500 лошадиных сил — 1302. Это обеспечит дополнительные доходы в бюджет в размере 14 миллиардов рублей ежегодно.
В здравоохранение придут телемедицинские технологии
В России появятся правовые основы для внедрения телемедицины. Как пояснил председатель Комитета Госдумы по информационной политике, информационным технологиям и связи Леонид Левин, прежде врачам приходилось оказывать соответствующие услуги фактически на свой страх и риск, «пересылая по почте и через мессенджеры результаты анализов, копии выписок и заключений».
Кроме того, информатизация здравоохранения позволит перейти к выписке электронных рецептов, а данные медицинских карт пациентов, внесённые в систему, сможет просмотреть любой врач, к которому обратится больной.
Особое внимание при работе над законам парламентарии уделили защите персональных данных пациентов и информации из их медицинских карт.

В отечественных аэропортах заработает система tax free
В России появится система tax free — компенсация иностранцам налога на добавленную стоимость при вывозе приобретенных в России товаров.
Воспользоваться этим правом смогут граждане государств, не входящих в Евразийский экономический союз. Как пояснил первый заместитель председателя Комитета Госдумы по бюджету и налогам Александр Ремезков, речь идёт о крупных покупках на сумму не менее чем десять тысяч рублей.
По мнению депутата, таким образом Россия демонстрирует открытость для взаимодействия с другими странами и заинтересованность в притоке иностранных туристов.
Систему tax free апробируют в аэропортах и морских портах, где фиксируется наибольшее количество иностранных граждан. На внедрение системы придётся потратить 260 миллионов рублей, но, по словам руководителя Ростуризма Олега Сафонова, в будущем она позволит увеличить турпоток и обороты российской торговли.
Пенсии уволившимся пенсионерам проиндексируют оперативно
Прекратившим работать пенсионерам проиндексируют пенсию с месяца, следующего за месяцем увольнения.
«То есть если человек уволился с 1 июня, то его пенсия должна быть проиндексирована с 1 июля. Обращу внимание — если он уволился с 30 июня, то пенсия ему также должна быть проиндексирована с 1 июля», — пояснила один из авторов соответствующего закона, член Комитета Совета Федерации по социальной политике Елена Бибикова.
Какие доплаты ждут пенсионеров в новом году
При этом сенатор подчеркнула, что корректировка будет идти не сразу, а примерно в те же сроки, что и сегодня — через три-четыре месяца, так как те административные процедуры, которые действуют в настоящее время, сохранятся.
«То есть Пенсионному фонду нужно получить необходимые данные, их обработать, рассчитать сумму выплат. Но очень важно, что деньги у пенсионеров не пропадут, и через 3-4 месяца они получат всю причитающуюся им сумму с учётом индексации с месяца, следующего за месяцем увольнения», — подчеркнула она
Дети-«подкидыши» начнут получать социальную пенсию
Сироты, чьи родители неизвестны — так называемые «подкидыши» — начнут получать социальную пенсию. Размер выплат составит 10 068 рублей 53 копейки в месяц. Разработанный группой сенаторов во главе с председателем Совета Федерации Валентиной Матвиенко закон решил проблему, которая стояла с 1956 года.
Сиротам активнее стали находить новых родителей
«Именно в 1956 году был принят закон, устанавливающий детям-сиротам социальную пенсию по случаю потери кормильца. Но дети, чьи родители неизвестны, не подпадали под это правовое регулирование», — сказал председатель Комитета Совета Федерации по социальной политике Валерий Рязанский.
Новый вид социальной пенсии будут назначать тем детям, кто был найден или оставлен матерью, не предъявившей удостоверение личности.

Задержек с чартерами в новогодние праздники не будет
С квитанцией «электронной путёвки» можно будет обращаться в фонд персональной ответственности туроператора при Ассоциации «Турпомощь» в случае невыполнения туроператором своих обязательств. Кроме того, проект обеспечит постоянный обмен данными между Ростуризмом, Роспотребнадзором, Фондом финансовых гарантий, ФНС, банками и страховыми компаниями, туроператорами, провайдерами туристических услуг.
Госуслуги предоставят без привязки к месту жительства
Подавать запросы, документы, информацию, необходимую для получения госуслуг, можно будет в любом подразделении федерального органа исполнительной власти, органа государственного внебюджетного фонда или в многофункциональном центре (МФЦ) вне зависимости от места жительства или пребывания.
С такой законодательной инициативой выступило Правительство. Как пояснил статс-секретарь — заместитель министра связи и массовых коммуникаций Олег Пак, документ призван повысить качество оказания государственных услуг гражданам.
«Указанные изменения минимизируют материальные и временные издержки россиян, позволят федеральным органам исполнительной власти более гибко реагировать на объективные потребности граждан в части получения государственных услуг, которые могут возникнуть в разных регионах России», — указано в пояснительной записке к закону.

«Когда урон от кибератак для отечественной экономики исчисляется сотнями миллионов долларов, государство не должно стоять в стороне. Мессенджеры не смогут работать с анонимными пользователями
Вводится запрет на анонимное использование мобильных мессенджеров. Идентификация будет осуществляться при помощи абонентского номера на основании соответствующего договора между мессенджером и оператором связи.
Кроме того, владельцев мессенджеров обяжут обеспечивать техническую возможность отказа пользователей от получения электронных сообщений, возможность рассылки электронных сообщений по инициативе государственных органов, а также ограничивать передачу информации, распространяемую с нарушением требований законодательства.
За работу с анонимными пользователями операторам мессенджеров придётся заплатить штраф. Для граждан он составит от трёх до пяти тысяч рублей, для должностных лиц — от 30 до 50 тысяч рублей, а для юрлиц — от 800 тысяч до миллиона рублей.
Заместитель председателя Комитета Госдумы по информационной политике, информационным технологиям и связи Марина Мукабенова указала, что аналогичные меры применяются в европейских странах. «Власти там ушли далеко вперёд в идентификации пользователей. В Великобритании власти требуют от мессенджеров немедленной дешифровки любой переписки пользователей, которых они заподозрили в противоправных действиях», — сказала депутат.
По словам парламентария, закон не вводит полный контроль, а лишь даёт возможность правоохранительным органам получить сведения, необходимые для расследований преступлений.
Повысятся пенсии и зарплаты бюджетников
Пенсии неработающих пенсионеров будут увеличены на 3,7 процентов. Величина индексации в наступающем году превысит уровень инфляции. Также с 1 января 2018 года на четыре процента увеличатся оклады госслужащих, дипломатических работников и служащих сферы юстиции.

As of 1 January, a considerable number of Federal laws and Government decrees will come into force. Parlamentskaya Gazeta has chosen the most important legislative changes that will affect the majority of Russians.
Low-income families will receive benefit for the first child.
Low-income families will receive additional benefits for children. In addition, the list of purposes for which maternity capital can be spent will be extended. This is part of a package of presidential laws aimed at supporting families.
The government will pay for the birth of first-born child.
One of the laws gives low-income families the right to receive payments for the birth of the first and the second child. From 1 January 2018, this benefit will be paid to families with an average per capita income not exceeding 1.5 times the subsistence minimum in the region.
‘The difference is that the funds for benefits for the first child will be transferred in the form of subventions from the federal budget to area budgets within the Federation. Payments for the second child will be made out of maternity capital funds’, explained Maksim Topilin, the Minister of Labour and Social Welfare.
The amount of payment will be determined by the child subsistence minimum in the federal area where the family lives. The second law proposes the continuation of the maternity capital program for three years, and also extends the list of purposes for which these funds can be spent. Thus, pre-school education in nurseries will be added to the list of purposes.
The minimum wage will move closer to the subsistence level
From 2018, the minimum wage (MROT) is to be increased to 85 per cent of the subsistence minimum, and in 2019 they will be equalised. At the same time, the law stipulates that if the actual subsistence minimum reduces, the minimum wage will not be decreased.
In 2018 the minimum wage will be 9,489 roubles.
Chairman of the Federation Council Committee on Social Policy, Valery Ryazansky underlined that this law can be described as a culmination. ‘Over the past few years, we have adopted a law every year to bring the minimum wage closer to subsistence level’, the senator said. ‘This document draws the finishing line under this process.’
Excise duty on petrol is to increase
Excise duties on a litre of motor vehicle petrol and diesel fuels will be increased by 50 kopeks.
According to Deputy Finance Minister, Ilya Trunin, this measure will deliver an additional 55 billion roubles to the budget. From the New Year, duties will also be increased on cigarettes, papirosi, tobacco, cigars, cigarillos, electronic nicotine delivery systems and liquids for such.
How prices will change in the coming year
Excise duty rates for cars will also be amended. In 2018, duty on cars with an engine capacity of between 200 and 300 horsepower will be 714 roubles per 1 horsepower (hp), rising to 1,218 roubles for those between 300 and 400 hp, to 1,260 roubles for those between 400 and 500 hp, and to 1,302 roubles for those over 500 hp. This will provide additional revenues of 14 billion roubles to the budget annually.
Telemedicine technologies are coming to health care.
The legal framework is being laid for the introduction of telemedicine in Russia. As explained by Leonid Levin, chairman of the State Duma Committee for Information Policy, Information Technology and Communications, in the past doctors effectively provided such services at their own risk when they ‘sent analysis results, copies of hospital discharges and findings by post and via messenger services.’
In addition, the application of information technology to health care will allow electronic prescriptions to be issued and information from patients’ medical cards input into the system can be examined by any doctor visited by the patient.
When working on the laws, parliamentarians paid particular attention to the protection of both patients’ personal data and the information from their medical cards.
According to Leonid Levin, the confidentiality of this kind of information is even more important for many citizens than the non-disclosure of data on bank cards. ‘It is essential to protect this information so that it cannot be used by those with criminal intent,’ he admitted.
A ‘tax free’ system will begin to operate in domestic airports.
A ‘tax free’ system will be introduced in Russia - reimbursement to foreigners of VAT when exporting goods purchased in Russia.
This right can be used by citizens of countries which are not members of the Eurasian Economic Union. As explained by Alexander Remezkov, first deputy chairman of the State Duma Committee on Budget and Taxes, this concerns large purchases worth not less than ten thousand rubles.
In his opinion, this demonstrates Russia’s openness for interaction with other countries and its interest in attracting foreign tourists.
The ‘tax free’ system will be trialled at airports and sea port where the largest numbers of foreign citizens are recorded. Introduction of the system will cost 260 million roubles, but, in the words of Oleg Safonov, head of RussiaTourism, it will in the future lead to an increase in tourism and the volume of Russian trade.
The pensions of those retiring will be indexed promptly
The pensions of pensioners who cease working will be indexed from the month after the month in which they left work.
‘So, if someone stopped working from 1 June, then their pension has to be indexed as of 1 July. And, equally, if they stopped working from 30 June, then their pension has to be indexed as of 1 July,’ explained one of the authors of this law, Elena Bibikova, member of the Federation Council Committee on Social Policy.
What additional payments can pensioners expect in the New Year.
At the same time, the senator stressed that the adjustment will not take place immediately, but approximately in the same timescales as today, that is, in three to four months, since those administrative procedures that are currently in force will continue.
‘The Pension Fund needs to obtain and process the relevant data so it can calculate the payment amounts. But it is very important that the pensioners’ money will not be lost, and in 3-4 months they will receive all the amount due to them, taking into account the indexation from the month following the month they ceased to work,’ she said.
‘Foundling’ children will begin to receive a social pension
Orphans, whose parents are unknown (so-called ‘foundlings’ ) will begin to receive a social pension. The payment amount will be 10,068 roubles and 53 kopeks per month. Developed by a group of senators headed by Federation Council chairman Valentina Matvienko, this law resolves a problem that has existed since 1956.
More effort was put into finding new parents for orphans
‘It was in 1956 that a law was passed to establish a social pension for orphan children on the loss of their providers. But children whose parents were unknown did not come under this legal regulation,’ said Valery Ryazansky, chairman of the Federation Council Committee on Social Policy.
A new type of social pension will be allocated to those children who were simply found or were left by a mother who did not identify herself.
Package tours will be registered in the ‘Electronic Voucher’ system
The sale of all package tours will be registered in the state ’Electronic Voucher’ database. A document with a unique number - an electronic voucher - will be registered in the system for each tour sold. Using the voucher number, tourists can track the status of their tour online. All stages of payment and booking of airline tickets and the hotel will also be available in the system.
There will be no delays with charters during the New Year holidays.
Using the ‘electronic voucher’ you can apply to the tour operator’s personal responsibility fund at the ‘Tourist Aid’ Association in the event of non-fulfillment of the tour operator's obligations. In addition, the project will ensure the constant exchange of data between Rosturizm (Russia Tourism), Rospotrebnadzor (Federal Service for Overseeing Consumer Rights Protection and Human Wellbeing), the Financial Guarantees Fund, FNS (Federal Tax Service), banks and insurance companies, tour operators, providers of tourist services.
State services will be provided without reference to the place of residence
It will be possible for applications, documents or information, necessary for obtaining State services, to be submitted in any subdivision of the federal body of executive power, or organ of the State non-budgetary fund, or in a multi-functional centre (MFC), irrespective of one’s place of residence.
The government has come forward with this legislative initiative. As explained by the Deputy Minister of Communications and Mass Media, Oleg Pak, the document is designed to improve the quality of public services delivered to citizens.
In an explanatory memorandum to the Act, it is stated that, ‘These changes minimise the material and time costs of Russian citizens by enabling federal bodies of executive power to be more responsive to the real needs of citizens in obtaining public services that might arise in different regions of Russia.’
Cyber attacks against critical IT infrastructure will be punishable under the Criminal Code.
Cyber attacks against Russia’s ‘critical information infrastructure’ will be criminalised. Maximum sentence of up to 10 years imprisonment.
Russia anticipates a digital revolution in 2018.
Objects deemed to be part of such infrastructure are information systems and telecommunication networks belonging to government agencies, automated control systems of technological processes in the spheres of defence, health, transport, communications, credit and finance, energy including nuclear, fuel, space and satellite technology, mining, metallurgy and chemicals.
‘When the losses to the domestic economy from cyber attacks can amount to hundreds of millions of dollars, the state cannot stand aside. When there are insufficient cybersecurity specialists in the market and companies are cutting costs in this area because of general economic strictures, it is the State which has to provide specific guarantees in the sphere of information security,’ observes Leonid Levin, chairman of the State Duma Committee on Information Policy, Information Technology and Communications.
Messaging services will not be allowed to work with anonymous subscribers
A ban on anonymous use of mobile messaging services is to be introduced. Identification will be enabled by using the subscriber number as per the relevant contract between the sender of the message and the communication operator.
In addition, message service owners will be required to provide a technical facility for users to decline electronic messages and a facility for sending electronic messages at the initiative of state authorities. They must also restrict the transfer of any information distributed in violation of legal requirements.
If they work with anonymous users, message service operators will have to pay a fine. For citizens, the fine will be from 3,000 to 5,000 roubles; for company officials from 30,000 to 50,000 roubles; for companies from 800,000 to 1,000,000 roubles.
Marina Mukabenova, deputy chairman of the State Duma Committee on Information Policy, Information Technologies and Communications, indicated that similar measures are being applied in European countries. ‘The authorities there have taken big steps forward in the identification of users. In the United Kingdom, the authorities require messaging service providers to instantly decrypt any correspondence between users whom they suspect of acting illegally,’ the deputy said.
According to the parliamentarian, the law does not introduce full control, but only allows law enforcement agencies to obtain information necessary for the investigation of crimes.
Pensions and salaries for state employees are to be increased.
The pensions of non-working pensioners will be increased by 3.7 per cent. The level of indexation in the coming year will exceed the level of inflation. Also from January 1, 2018, the salaries of civil servants, diplomatic employees and officials working in jurisprudence will increase by four percent.
