The XXX Project Winter Operations Regulations deal with rules and proceedings aimed at informing, training, and protecting people, equipments, property, and premises of the Companies working in site from winter risks during the winter season.
1.2. SCOPE
All employees working under the Veladero Project and all the staff working for contractors, subcontractors and suppliers must comply with the regulations described herein. All authorized visitors and different officers who acting in their capacity must enter the Operations Area and those areas specified by XXX Mining (hereinafter called “the Company”) shall observe strictly the rules indicated herein. These regulations shall be in effect every year during the winter period which has been fixed by the Company from April 15 to September 15. It could be in effect automatically for other periods of the year, provided that the weather conditions make it necessary.
1.3. MANDATORY RULES
The present regulations, being mandatory, must be observed and respected by:

DURACIÓN DEL CONTRATO

Source text - Spanish Since a pre-operational audit cannot evaluate on-the-ground compliance with the Code, gold mines seeking pre-operational conditional certification are expected to have written documentation of proposed design and operating plans and procedures available for the auditor’s review whenever practical. Design drawings, draft operating procedures, draft emergency response plans and draft training plans will provide an auditor with the best evidence that the operation can be expected to be in full compliance with the Code’s Principles and Standards of Practice.
However, it is recognized that an operation seeking pre-operational certification may not have progressed to a point where this degree of planning has been completed. In such a case, in lieu of design drawings, proposed operating procedures, or other draft management plans, an operation may provide it’s commitment to implement measures consistent with the Principles and Standards of Practices of the Code. Such commitments can be in form of process descriptions, cyanide management plans, and other written statements of intent that conclusively demonstrate that, once the facility has been constructed and is in operation, and the actions to which it has committed are implemented, the operation will comply with the Code’s Principles and Standards of Practices. The commitment must include sufficient detail for the auditor to be confident in such a finding.
Operations are encouraged to use this Verification Protocol as a template in preparing a Cyanide Management Plan that would describe how the operation planned to address each element and reference the existing documentation available for review. Although such a plan is not required in order to comply with the Code, it would guide the operation in addressing all elements required for Code compliance during the planning and design stages of the project, and aid an auditor in evaluating an operation that has not been built and therefore cannot be visually inspected.
The goal of this Protocol is to encourage and support a thorough and probing inquiry by the auditor. This Protocol is structured to require that an auditor provide detailed responses, sufficient to provide a clear justification for the findings. Full responses are necessary for each question; “yes”, “no” or “not applicable” answers are not sufficient. The auditor must describe the specific evidence to support the findings that a gold mine operation using cyanide is expected to meet the Code provisions. Information must be provided on the documents reviewed.

PROGRAMMING
XXX is currently a seventh grade student in the Itinerant Emotional Support setting at South Brandywine Middle School. Jimmy meets the criteria for Special Education under the category of Other Health Impairment (OHI). XXX has a medical diagnosis of Attention Deficit Hyper-Activity Disorder (ADHD). OHI is defined as having limited strength, vitality or alertness, including a heightened alertness to environmental stimuli that results in limited alertness to the educational environment that is due to a chronic or acute health problem (ADHD) that adversely affects the child's educational performance.
He participates in the regular education setting for all major classes and specials. XXX is fully mainstreamed into the regular education without academic assistance. All major classes are currently 87 minutes in duration. He reports to mathematics and language arts daily and social studies and science every other day. He receives daily instruction and works towards his IEP goals with his the learning support teacher during AM and PM check in times. XXX also receives mental health services through Social Work 1 time per 6 day cycle for 30 minutes. A certified mental health specialist will be giving him this instruction. In addition, XXX will also be receiving a class in Social Skills one class period for 45 minutes every 6 day cycle. XXX has access to the support classroom as well as guidance counselors if he is need of emotional support throughout the day.
The team agrees that XXX is successful in the regular education setting and will continue to receive Itinerant Emotional Support Services. He continues to benefit from reteaching/review of social skills coping strategies throughout the day and during check in times.
PROGRESS MONITORING
Goal:As measured using a daily point sheet, Jimmy will receive 85% or better in all areas addressed for 3 consecutive months.
Baseline = 70 %
Progress: XXX suffered a traumatic even this marking period. XXX is consistently scoring between an 83% - 100% with an average of 89%. He is consistently using his strategies to self monitor. He will ask to leave the classroom to cool down if needed. He also asks his emotional support teacher questions about social situations. He wants to be able to handle social situations correctly. He asks about situations that have not happened yet as well as situations that have already occurred to ensure that he had handled them correctly. If XXX is having an off day, most times he is able to be redirected by either his regular education teacher or his emotional support teacher. However, he does have days where he does not want to participate in class because he feels it is "boring". He also still struggles with calling out at inappropriate times .For having such a tragic event happen in XXX's life, he is appearing to handle his emotions extremely well.
XXX has passed his goal in this area. Moving forward he will be monitored based off of class disruptions, social interactions with peers, and coping strategies. XXX feels as though he does not relate to his peers and is too mature for them.
TEACHER OBSERVATIONS:

XXX currently has a C average in math class, which I believe is not reflective of his ability. He has shown a good understanding of math concepts, but seems to do little to no work outside of the classroom. During class, he participates about 75% of the time, and the other 25% of the time he will sit and do nothing, goof off and refuse to complete classwork with his group mates. XXX's behavior has never been malicious, mean, or disrespectful. He just sometimes has a hard time settling in.

XXX has been very inconsistent in class. There are days when he is really focused and it does not take many prompts to keep him on task. Terrain Capacity for Skiing/Boarding
We propose to analyze the terrain within the entire study area which exhibits good skiing and snowboarding potential to estimate the overall capacity of the
site. The Terrain Capacity Analysis graphically illustrates the terrain “pods”
within the study area which possess good potential for ski development. Within
each terrain pod, we will then join the upper and lower points to establish the total vertical rise, horizontal distance and straight line slope. The Terrain Capacity Analysis map and program printouts provide a reliable indication of the maximum ski area development potential of the site and the general balance of the developable terrain. The terrain balance will then be measured in relationship to
the proportions of the market distribution of skier skill levels.
Base Area Development Suitability
We will then explore the extent of potential base facility terrain, near the existing hotel that could be accessed by vehicle from Route 11. Gently sloping lands (less than ten percent) are required within comfortable skier walking distance (450 meters) of the bottom terminal of the access gondola to provide the

Source text - English Vague principles -for example, the right of a state to use force in self-defense in the event of an attack by another- tend to invite scofflawry. Nevertheless, it is one of the paradoxes of the law that some very broad and elastic principles -despite, or perhaps even because of, their lack of precision- may actually have a profound and lasting effect on the jurisprudential context within which they operate. The role of the principle of “due process” within the U.S. legal system is but one of many examples. Such an inverse and counterintuitive correlation between a legal principle’s determinacy and its capacity to affect conduct cannot be explained solely in terms of how often the principle is invoked in litigation, although that may have been a factor in securing its legitimacy. Rather, the phenomenon may be attributable primarily to the hold the principle -despite its elasticity- has taken on the judicial, but also on the political, imagination of the epistemic community in which it is used as the prism for viewing, arguing, and ultimately resolving disputes.
One way to understand the dynamic quality of some vague, yet powerful, legal principles is to view them operationally. What do they achieve, in practice? An answer suggested by examining the evidence generated by the operation of the principle of proportionality is that they appear to achieve their dispute-resolving project by deliberately creating a space for “second opinions" to which claims of disputants can be referred. These second opinions are rendered in many contexts but appear primarily after a person, government, or institution has taken an action against another in response to what is believed to be a detrimental and unlawful provocation. Such retaliations or countermeasures may even be modulated by the mere possibility that a second opinion might be obtained. The second opinion would examine whether the initial provocation was unlawful and, if so, whether the response to it was proportionate.
It may well be that the surprising jurisprudential success of some broad principles, despite their vagueness, is simply due to their having provided what turns out to be an efficient process for rendering such second opinions. Specifically, any legitimacy deficit the principle of proportionality incurs because of it vagueness may be compensated by its utility as a restraint on what might otherwise be an unchecked circulus inextricabilis of provocations and retaliations.
This restraining effect suggests that proportionality may surely resemble beauty, but not because proportionality (or, for that matter, beauty) exists only in the subjective eye of the beholder. Rather, proportionality (again, like beauty) has attained purchase as a governing principle because, under the aegis of a credible decision-making process, a general system of subsidiary rules has evolved that demonstrably affects outcomes (whether in wars, trade disputes, or beauty contests). In other words, the general principle has achieved currency because, in its frequent application, case by case, it has shed much of its indeterminacy. When it comes to dispute settlement, it has dawned on the global system, proportionality is a tool that seems to work.

Source text - Spanish En México, durante la época colonial, el actual estado de Michoacán era un centro manufacturero importante de muebles de madera laqueados policromos. La región de bellos lagos y bosques abundantes era la tierra de los purépechas, una población indígena también conocida como indios tarascos. En la época prehispánica, los purépechas cubrían calabazas de todos los tamaños y formas con muchas capas de una pasta hecha con aje, la secreción grasosa de un insecto, aceite de semillas de chía y un compuesto mineral de dolomita. Después de ser pulidas, las vasijas adquirían una superficie suave y lustrosa que era impermeable a la humedad. Los objetos que se destinaban a la élite indígena o con propósitos religiosos se decoraban con múltiples colores. Inicialmente, la pieza recibía varias capas de laca; el artista grababa entonces un dibujo en esa base de laca. Las secciones que habían de recibir nuevos colores eran ahuecadas y pigmentos en polvo mezclados con los mismos ingredientes utilizados para la pasta eran incrustados en las secciones ahuecadas. Durante el proceso de decoración, el objeto era pulido varias veces. Cuando la imagen se completaba, se daba un pulido final a toda la pieza. Esta técnica de decoración prehispánica se conoce como embutido.
El gusto de los primeros colonizadores españoles por estas calabazas laqueadas se ve documentada en la literatura de principios del siglo XVI.
Los autores observan la durabilidad de las vasijas, su resistencia a la humedad y en especial sus superficies brillantes. Los europeos prácticamente desconocían los laqueados asiáticos en esta época y pasarían muchas décadas antes de que se desarrollara la técnica del barniz de Occidente. No existe ningún ejemplar completo de las calabazas laqueadas prehispánicas: solo se han encontrado fragmentos. Pero, poco después de la llegada de los españoles, los purépechas ya laqueaban y decoraban artículos europeos de madera que los recién llegados colonizadores necesitaban para su consumo. Al mismo tiempo los muebles con decoración policroma eran la moda máxima en la Europa del siglo XVI. En su patria, pocos españoles podían permitirse el lujo de amueblar su casa como ahora podían hacerlo en la América española. En consecuencia, los coloridos muebles de Michoacán pronto encontraron u n próspero mercado en México y en todo el Imperio español. El convento agustino de Tiripetío servía como centro de capacitación para los artesanos purépechas. Los frailes trajeron artesanos entrenados en España para que enseñaran carpintería, herrería, cantería y otras habilidades necesarias para decorar iglesias y proporcionar a los colonizadores accesorios al estilo europeo. Pátzcuaro y Peribán son dos pueblos mas en que los artistas del laqueado aplicaron decoraciones con la técnica del embutido a los muebles, también se utilizaba esta técnica en otros pueblos de Michoacán.
Que toda la superficie esté ornamentada caracteriza el diseño de las obras laqueadas y embutidas de Michoacán de los siglos XVI y XVII. Los temas retratados en los objetos laqueados de Michoacán, escenas de caza, de cortejo, de animales domésticos y silvestres, así como los temas mitológicos, reflejan el gusto europeo. Los escritorios, equipados con cajones y un frente que se convierte en superficie para escribir son un invento español. Se produjeron desde fines del siglo XV hasta principios del siglo XVIII. Hoy se los conoce como bargueños. Poseer uno de esos escritorios portátiles, lo cual implica leer y escribir, se limitaba a las clases altas, pues solo los miembros de la sociedad de élite y las órdenes religiosas eran letrados. Para su construcción, era esencial la portabilidad y la seguridad del contenido de estos muebles. La superficie para escribir, que se cierra sobre los cajones, poseía una sólida cerradura de metal. Se le añadían manijas en ambos lados y engastes metálicos alrededor de la caja protegían la superficie decorada y contribuían a la integridad de la construcción. En el hogar, los bargueños se colocaban casi siempre sobre una mesa de tijera plegable.
Translation - English In the Colonial period, the Mexican state of Michoacan was an important manufacturing center of polychrome, lacquered wooden furniture. This area with beautiful lakes and abundant forests was the land of the purepecha people, a native indigenous people also known as the tarascos tribes. In the pre-Hispanic period the purepechas took gourds of all sizes and shaped and covered them with layers of a paste made of aje (the grease secretion of an insect), chia seed oil and a mineral dolomite compound. After being polished the vessel surface became smooth, shiny and waterproof. Those objects made for the native indigenous elite or for religious purposes were decorated with many colors. First the piece was covered with several layers of lacquer. Then the artist engraved a drawing on the lacquered surface. Small areas chosen to show color were hollowed out. Powdered pigments mixed with the same ingredients used for the paste were set in the hollowed areas. During the decoration process the object was polished up several times. When the image was complete, the whole piece was polished up once more. This pre-Hispanic decoration technique was known as inlay.
The first Spanish conquerors' preference for these lacquered gourds has been documented in the literature of early 16th century.
The authors describe the durability of the vessels, their resistance to humidity and especially their shinny surfaces. The Europeans knew almost nothing about the Asian lacquered pieces of that time and many decades would go on until the Western varnish technique was developed. There is no whole pre-Hispanic lacquered gourd piece —only fragments have been found. But soon after the arrival of Spaniards the purepechas were lacquering and decorating European wooden pieces that the newcomers needed for their own use. At the same time, the polychrome decorate furniture had become the top fashion in the 16th century Europe. In their homeland, few Spaniards could afford luxury furniture in their homes but now they can do it in Spanish America. As a result, the colorful Michoacan furniture soon found a thriving market in Mexico and all through the Spanish Empire. The Augustine Tiripetio Monastery functioned as a learning center for the purepechas artisans. The friars brought artisans trained in Spain to teach carpentry, blacksmith's forge, stonework and other skills needed to decorate churches and provide the settlers European-style accessories. Patzcuaro and Periban are two more towns in which the lacquer artists applied decoration to furniture with the inlay technique. The technique was also used in other towns of Michoacan.
All the writing box surface is ornamented —a distinctive feature of the 16th and 17th-century lacquered and inlayed pieces from Michoacan. The motives used to decorate the lacquered objects from Michoacan are hunting, courting, domestic and wild animal scenes. The mythological-related scenes reflect the Europeans' preferences. The writing cabinets equipped with drawers and a front piece that turns into a writing surface are a Spanish invention. They were manufactured from late 15th century to early 18th century. Nowadays they are known as bargueños (Spanish for cabinets). Only the upper classes could afford one of these portable writing boxes since it implied that the owner could read and write. Only the elite society members and the religious orders were literate. Both the portability and the safety of the contents of these pieces of furniture were essential. The writing surface closed over the drawers and had a strong metal lock. Handles were added on both sides and metal settings around the box protected the decorated surface and improved the safety

Discogenic pain is a major source of chronic low back pain. Patients suffering from discogenic pain are often young, otherwise healthy individuals who present with pain localized to the back. Although the cause of dis-cogenic pain is controversial, most clinicians agree on a key characteristic of the pain that patients exhibit: the pain is typically worse in positions in which the spine is in flexion, such as sitting, bending forward, or leaning over at the sink (flexion exacerbated pain). Patients with discogenic pain therefore accommodate their syn-drome by avoiding positions such as sitting, which cause their painful segment to go into flexion, and prefer-ring positions such as standing, which maintain their painful segment in extension.
Most clinicians also agree on the biomechanical characteristics of disc degeneration: in the early stages of the degenerative cascade, in which the overall disc height is relatively preserved (less than 50% loss of height), the disc exhibits hypermobility. Decreased passive resistance to flexion seen at the diseased segment is thus asso-ciated with pain on flexion in presenting patients. Flexion and extension are known to change the mechanical loading pattern at a lumbar segment. When the segment is in extension (the standing position), the axial loads borne by the segment are shared by the disc and the facet joints (in a healthy spine, approximately 30% of the load is borne by the facet joints). In flexion, however, the segmental load is borne almost entirely by the disc. Furthermore, when the segment is in flexion, the nucleus shifts posteriorly, changing the loads on the posteri-or portion of the annulus (which is innervated), likely causing its fibers to be subject to tension and shear forces. Segmental flexion, then, both increases the loads borne by the disc and causes them to be borne in a more painful way.

Los pacientes que sufren dolor discogénico son con frecuencia individuos jóvenes, por lo demás sanos, que tienen dolor localizado en la espalda.
Si bien la causa del dolor discogénico es controversial, la mayoría de los médicos clínicos coinciden en una característica clave de este tipo de dolor que muestran los pacientes: el dolor suele empeorar en posiciones en las que hay que flexionar la columna, como sentarse, inclinarse hacia adelante o inclinarse sobre el fregadero o lavabo (la flexión intensifica el dolor).

Sin embargo, al producirse la flexión, el disco soporta la carga segmental casi por completo. Además, cuando el segmento se flexiona, el núcleo se desplaza hacia atrás y cambia las cargas en la parte posterior del anillo (que está inervado), lo que posiblemente hace que las fibras sean sometidas a fuerzas de tensión y resistencia.
Por lo tanto, la flexión por segmentos aumenta las cargas que soporta el disco y hace que este proceso de soporte sea más doloroso.
