Die am 1. April 2010 in Kraft tretende nunmehr dritte Änderung an der Ausführungsordnung des EPÜ 2000 seit Inkrafttreten am 13. Dezember 2007 gibt Anlass, die Häufung von Änderungen durch den Verwaltungsrat der Europäischen Patentorganisation zu hinterfragen. Diese Änderungen stehen vordergründig im Zusammenhang mit der EPA internen Initiative «raising the bar», durch welche die Verfahrenseffizienz vor dem EPA beschleunigt werden soll und qualitativ hochwertige Patente zur Erteilung gelangen sollen. Im Speziellen führen die aktuellsten Änderungen aber zu einem komplizierten und ineffizienten Verfahren und schränken den Anmelder in seinen Gestaltungsfreiheiten stark ein, ohne dass dadurch positive Auswirkungen im Hinblick auf qualitativ hochwertige Patente zu erwarten sind. Die Autoren führen eine kritische Diskussion über die Änderungen und deren Auswirkungen.

1 Einleitung
Die aktuellen Beschlüsse des Verwaltungsrats (VR) der Europäischen Patentorganisation (EPO) vom 25. März 2009 sind bei Anmeldern und zugelassenen Vertretern auf wenig Verständnis gestoßen. Diese Beschlüsse stellen bereits die dritte Anpassung der Ausführungsordnung (AO) zum Europäischen Patentübereinkommen (EPÜ) 2000 seit dessen Inkrafttreten am 13.12.2007 dar. Seit diesem Zeitpunkt gab es kein (Kalender-) Jahr ohne Änderungen an der AO. Diese rasche Abfolge von Änderungen führt insbesondere im Hinblick auf die in 2010 in Kraft tretenden Änderungen dazu, dass das Ausmaß und die Konsequenzen der Änderungen der AO und der Gebührenordnung durch die an den Verfahren Beteiligten nur erschwert wahrgenommen werden können.
Die durchgeführten und geplanten Änderungen der AO stehen vordergründig im Zusammenhang mit der EPA internen Initiative «Raising the Bar» . Diese Initiative soll das Ziel verfolgen, qualitativ hochstehende Patente zur Erteilung zu bringen. Liest man im Jahresbericht 2008 des EPA weiter, ergibt sich aber ein anderes Bild. Durch die Änderungen soll eine «Steigerung der Verfahrenseffizienz» erreicht werden und verhindert werden, dass Anmelder «die Effizienz des Prüfungsverfahrens unterminieren» . Es geht also im Grundsatz darum, Gestaltungsfreiheiten des Anmelders einzuschränken und ihn zu disziplinieren. Ob solche Einschränkungen zur Verbesserung der materiellrechtlichen Qualität und Beständigkeit von Patenten beitragen, ist unklar und höchst zweifelhaft.
In diesem Aufsatz werden wesentliche Punkte und Konsequenzen der bisherigen und beschlossenen Änderungen an der AO zum EPÜ 2000 kritisch beleuchtet.
2 Gesetzgebung EPÜ 2000
2.1. Rückblick
Mit dem Abschluss der Revisionskonferenz in München vom 20. bis 29. November 2000 und der Publikation in 2001 Sonderausgabe Nr. 4 ABl. EPA gemäss «Beschluß des Verwaltungsrats vom 28. Juni 2001 zur Annahme der Neufassung des Europäischen Patentübereinkommens» war das EPÜ 2000 keineswegs fertig. Da im EPÜ 2000 vorgesehen war, dass eine Vielzahl von materiell¬rechtlichen und verfahrensrechtlichen Punkten neu in der AO geregelt werden sollten, nahm das EPÜ 2000 für alle an der Ausarbeitung der AO nicht Beteiligten erst im Verlaufe des Jahres 2007 konkret Gestalt an. Am 13. Dezember 2007 trat das EPÜ 2000 dann in Kraft.
2.2. Auswirkung von EPÜ Art. 33
Die verstärkte Verschiebung von materiellrechtlichen und verfahrensrechtlichen Regelungen in die AO gibt dem VR der EPO verstärkt die Möglichkeit, Bestimmungen in der AO selbst zu implementieren (Art. 33(1)c). Dem VR wurden somit weitreichende Kompetenzen bei der Gestaltung der AO zum EPÜ 2000 eingeräumt. Diese Kompetenzerweiterung erklärt sich aus praktischen Überlegungen. Man wollte vermeiden, dass Änderungen von geringer Tragweite regelmäßig die Einberufung einer diplomatischen Konferenz erfordern. Eine solche umfassende gesetzgeberische Kompetenz birgt die Gefahr, dass das zuständige Gremium möglichst rasch und in seinem Sinne Änderungen durchführt. Dies ist besonders problematisch, weil dem VR die demokratische Legitimation fehlt: seine Mitglieder werden nicht vom Parlament des Mitgliedstaates gewählt, sondern von der Exekutive ernannt. Ferner ist der VR eigentlich ein Aufsichtsorgan, das für ordnungsgemäße Verhältnisse sorgen soll. Anders ausgedrückt entsteht aus Verwaltern, die von der Exekutive ausgewählt worden sind, unter Ausschluss der Öffentlichkeit ein Organ, das gesetzgeberische Kompetenzen wahrnimmt und das keiner Aufsicht untersteht. Das entspricht weder dem Grundsatz der Gewaltenteilung, noch ist es mit der gerichtlichen Kontrolle der Verwaltung vereinbar.
2.3. Einseitiges Gesetzgebungsverfahren
Weil auch der Gesetzesänderungen vorbereitende und beratende Ausschuss Patentrecht von VR-Mitgliedern und dem Präsidenten des EPA (unterstützt von EPA Bediensteten) als stimmberechtigte Personen gebildet wird, hat der VR bei Änderungen der AO freie Hand. Andere kompetente Teilnehmer im Ausschuss Patentrecht haben nur den Status von nicht stimmberechtigten Beobachtern, wie beispielsweise das Institut der beim Europäischen Patentamt zugelassenen Vertreter (epi). Werden Einwände seitens der Beobachter vorgebracht, können diese berücksichtigt werden, müssen aber nicht. In einer Abstimmung über Änderungen vertreten die stimmberechtigten Personen aber in der Regel die Interessen des VR bzw. der Amtsleitung. Diese Interessenslage wird dann dem VR zum Beschluss vorgelegt. Kritische Meinungen seitens der Anmelder bzw. zugelassenen Vertreter haben also im Gesetzgebungsverfahren der EPO kein Gewicht, weil dieser Personenkreis weder im Ausschuss Patentrecht noch im VR stimmberechtigt ist. Die Gesetzgebung erfolgt also einseitig durch den VR, in der Regel mit Unterstützung der Amtsleitung.
3 Würdigung der Änderungen per 1. April 2008
3.1 Anspruchsgebühren
Die Änderung der R. 45 vom 6. März 2008 sowie weiterer darauf basierender Regeln musste aufgrund der Änderung der Gebührenordnung (beschlossen am 14. Dezember 2007) konsequenterweise vorgenommen werden. Diese Änderung beinhaltet die Einführung einer Anspruchsgebühr von € 200.- ab dem 16. Anspruch bei gebührenfreien ersten 15 Ansprüchen.
Diese neue Gebührenstruktur erweist sich insbesondere für mittelständische und kleinere Unternehmen als Nachteil, wenn in einer Schutzrechtsanmeldung mehrere selbständige Ansprüche unterschiedlicher Kategorien aufgestellt werden. In solchen Fällen reichen fünfzehn Ansprüche in der Regel nicht aus, um beispielsweise eine vollständige Beanspruchung sowohl einer Vorrichtung als auch eines Verfahrens samt bevorzugter Weiterbildungen formulieren zu können.
Ferner wird abzuwarten sein, wie das EPA mit Patentansprüchen umgehen wird, in denen mehrere optionale Merkmale aus früheren abhängigen Ansprüchen mit „und/oder“ bzw. „vorzugsweise“ und ähnlichen Verknüpfungen zusammengefasst werden, um die formale Anzahl an Ansprüchen zu reduzieren. Innerhalb eines abhängigen Anspruchs sind dann mehrere Alternativen einzeln enthalten.
Neben der inhaltlichen Kritik ist es auch hinsichtlich des Zeitpunkts der Einführung dieser Änderungen unverständlich, warum diese Änderungen nicht gleich auf den 13. Dezember 2007 eingeführt wurden.
4. Würdigung der Änderungen per 1. April 2009
Die Hauptänderungen per 1.4.2009 betreffen eine einheitliche Benennungsgebühr und die Vorverlagerung der Fälligkeit von Zusatzgebühren bei umfangreichen Anmeldungen. Zusätzlich zur nachfolgenden inhaltlichen Kritik ist anzumerken, dass auch diese Änderungen bereits per 13. Dezember 2007 möglich gewesen wären mit vereinfachter Übergangsregelung, also ohne parallele Anwendung von zwei verschiedenen Regeln wie Regel 38, 39 und 71.
4.1. Zusatzgebühr
In einer Gesamtsicht hinsichtlich des Bearbeitungsaufwandes beim EPA ist die Vorverlagerung der Zusatzgebühr (ab der 36. Seite der Anmeldung) im Sinne einer verursachergerechten Kostenzuweisung als Schritt in die richtige Richtung zu werten. Die Grundlage der Seitenzählung bezieht sich auf die eingereichte Fassung – sei es in irgendeiner Sprache oder in einer Amtssprache. Die Seitenzahl gemäss einer ggf. später eingereichten Übersetzung in eine Amtssprache ist unerheblich .
4.2. Einheitliche Benennungsgebühr
Die Legitimation einer Benennungsgebühr ist durch Art. 79 gegeben. Die Einführung einer einheitlichen Benennungsgebühr ist für den Anmelder zwar eine Verfahrensvereinfachung, stellt aber für Anmelder die sich bisher zu Beginn des Verfahrens auf weniger als fünf benannte Länder beschränkt haben, eine Verteuerung des Verfahrens dar. Diese Verteuerung trifft ebenfalls Einzelanmelder bzw. kleine oder mittlere Betriebe als Anmelder am stärksten.
Sofern in Zukunft eine Anpassung des Art. 79 in einer diplomatischen Konferenz in Betracht gezogen wird, wäre es wünschenswert, wenn die Benennungsgebühren als gesonderte Einheitsgebühr komplett gestrichen wird. Die Benennungsgebühr könnte ebensogut bei der Einreichung der An¬meldung als Bestandteil der Anmeldegebühr oder bei der Stellung des Prüfungsantrages als Teil der Prüfungsgebühr erhoben werden. Dies wäre eine weitere Verfahrensvereinfachung für den Anmelder. Eine solche weitere Vereinfachung ist auch sinnvoll, weil für Art. 54(3) EPÜ 2000 durch Wegfall der R. 23a EPÜ 1973 die materiell-rechtliche Bedeutung der Entrichtung von Benennungsgebühren sowieso verschwunden ist. Dies würde dann zu einer analogen Regelung bezüglich der Benennung von Ländern wie beim PCT führen. Selbstverständlich müsste dabei auch eine eigenständige Regelung für Erstreckungsgebühren im Rahmen einer neuen Erstreckungsverordnung gefunden werden. Eine solche Regelung müsste unabhängig von der Benennung von Vertragsstaaten des EPÜ sein.
4.3. Anspruchsgebühren
Nebst der Einführung einer Anspruchsgebühr von € 200,- ab dem 16. Anspruch soll nicht unerwähnt bleiben, dass die seit 1.4.2009 geltende Gebührenordnung weitere erhöhte Anspruchsgebühren (€ 500,-) ab dem 51. Anspruch vorsieht. Zusammenfassend ist zu der nunmehr geltenden mehrstufigen Erhebung von Anspruchsgebühren anzumerken, dass sie speziell für Einzelanmelder und mittelständische und kleinere Unternehmen anmelderfreundlicher hätte gestaltet werden können, z.B. mit tieferen Gebühren (deutlich < € 200,-) ab dem 11. Anspruch (ähnlich wie bis 31.03.2008) und erhöhten Gebühren ab dem 30. Anspruch (> € 200,-). Dabei hätte das Amt ohne weiteres seine finanziellen Interessen wahren und gleichzeitig auf weniger finanzstarke Anmelder Rücksicht nehmen können.
Ob die neue Gebührenstruktur bei den Patentansprüchen für das EPA vorteilhaft ist, wird sich noch zeigen. Finanziell stellen die 5 zusätzlichen gebührenfreien Ansprüche erst einmal einen Verlust für das EPA dar. Sollte sich dieser monetäre Verlust nicht durch die neuen Anspruchsgebühren ausgleichen lassen, ist wohl mit erneuten, nicht anmelderfreundlichen Gebührenerhöhungen an anderen Stellen zu rechnen.
5. Würdigung der Änderungen per 1. April 2010

Im Folgenden wird im Speziellen eingegangen auf die Änderungen der Regeln 36(1), 36(2); 137(4); 161 sowie auf die Einführung der neuen Regel 70a.
5.1 Neues Verfahren bei Teilanmeldungen
Das Instrument «Teilanmeldung» ist durch die Pariser Verbandsübereinkunft (PVÜ) Art. 4G(1) vorgegeben. Da das EPÜ ein Sonderabkommen gemäss PVÜ Art. 19 ist, dürfen EPÜ-Bestimmungen der PVÜ nicht zuwider laufen.
Aus für Aussenstehende nicht nachvollziehbaren Gründen wurde innerhalb des EPA über eine Verschärfung des Verfahrens für Teilanmeldungen intensiv nachgedacht. Im Dokument CA/PL 8/08 des Ausschusses Patentrecht, Kapitel IV „Abuse of Divisionals“ wurde festgehalten, dass eine Duplizierung des Prüfungsverfahrens durch Einreichung von Teilanmeldungen ein Missbrauch des Patentsystems durch die Anmelder sei. Um diesen Missbrauch einzudämmen, wurden zur Über¬raschung der Anmelder und Vertreter die Regeln 36(1) und 36(2) am 25. März 2009 durch den VR-Beschluss geändert, der am 1. April 2010 in Kraft treten wird.
Aus der Teilanmeldungen betreffenden Entscheidung G 0001/05 ist zum Thema «Missbräuche» ausgeführt:
«Wenn administrative Maßnahmen wie eine Priorisierung von Teilanmeldungen bei der Prüfung und eine Bündelung und schnelle Bearbeitung von gleichzeitig anhängigen Teilanmeldungen, die es den Anmeldern erschweren, Gegenstände, hinsichtlich derer die Prüfungsabteilung in einer Anmeldung bereits eine negative Stellungnahme abgegeben hatte, dadurch aufrechtzuerhalten, dass sie sie immer wieder von Neuem einreichen, so sollte der Gesetzgeber überlegen, worin Missbräuche liegen und wie für Abhilfe gesorgt werden kann. »
Ob ein Missbrauch bei der Einreichung einer Teilanmeldung vorliegt, ist also in hohem Maße ermessensabhängig.
Die Duplizierung des Prüfungsverfahrens durch Einreichung von Teilanmeldungen als Missbrauch zu qualifizieren (CA/PL 8/08) entbehrt jeglicher Grundlage. Für diese Duplikate entrichtet der Anmelder je eine Anmeldungs- und Prüfungsgebühr sowie bereits aufgelaufene Jahresgebühren. Mindestens ökonomisch betrachtet erleidet auch das EPA bei den Duplikaten keine Nachteile. Im Gegenteil: die Bearbeitung einer mindestens teilweise schon bearbeiteten europäischen Anmeldung ist einfacher.
Das Argument Missbrauch durch Duplizierung stützt das EPA auf folgende Zahlen (Quelle CA/PL 8/08):
- 5% aller europäischen Patent-anmeldungen sind Teilanmeldungen;
- Teilanmeldungen der zweiten Generation machen 7% aller Teilanmeldungen aus; und
- Teilanmeldungen der dritten oder weiteren Generation machen 1% aller Teilanmeldungen aus.
Unterstellt man, dass die Teilanmeldungen zweiter oder höherer Generation alle auf «Missbräuchen» beruhen, so kommt man aufgrund der Anmeldezahlen für 2007 von rund 141.000 Anmeldungen auf eine Anzahl von rund 550 «missbräuchlichen» Anmeldungen. Vor diesem Hintergrund stellt sich die Frage, ob nicht die normale Bearbeitung der Teilanmeldungen zweiter und höherer Generation (ca. 8% aller Teilanmeldungen bzw. 4‰ (Promille!) aller Anmeldungen) für alle Beteiligten (Anmelder und deren Vertreter sowie Amt) den kleineren Aufwand bedeutet, als die Implementierung, Umsetzung und Überwachung der neuen 24-Monatsfrist. Die gewählte Regelung erscheint weder für das Amt noch für die Anmelder vorteilhaft, sondern führt auf beiden Seiten zu einem unnötigen administrativen Aufwand. Der Anmelder wird zusätzlich in seinen Gestaltungsmöglichkeiten stark eingeschränkt. Findige Anmelder und Vertreter haben bereits Umgehungsmöglichkeiten der 24-Monatsfrist in Umlauf gebracht, welche es auf legale Weise ermöglichen, auch eine Teilanmeldung nach Ablauf der 24 Monate in peto zu haben .
Es wird interessant sein, wie sich die Anzahl der Teilanmeldungen in den ersten 6 Monaten ab dem 1.4.2010 aufgrund der im Verwaltungsratsbeschluss enthaltenen Übergangsregelung entwickeln wird. Es ist zu erwarten, dass finanzstarke Anmelder mindestens eine Teilanmeldung auf Vorrat anlegen werden. Dies könnte auch in Zukunft vor Ablauf der neuen 24-monatigen Frist eine Strategie ebendieser Anmelder sein. Da solche Teilanmeldungen auf Vorrat nur für finanzstarke Anmelder eine realistische Option darstellen dürften, stellt das neue Verfahren eine klare Benachteiligung von mittelständischen Unternehmen und Einzelanmeldern dar. Es ist weiter anzunehmen, dass die Zahl der Teilanmeldungen (auf Vorrat) steigen wird, was zu einer starken Belastung des EPA führen wird. Diesbezüglich wird ein weiteres Mal auf den Jahresbericht 2008 verwiesen: Das Amt «erwartet, dass seine Ressourcen nicht für grundsätzlich vermeidbare Verfahrensbelange vergeudet werden». Dies ist aber mit dem neuen Verfahren bei den Teilanmeldungen gerade zu erwarten, weil der Anmelder im Zweifel mindestens eine Teilanmeldung auf Vorrat einreichen wird, die – sofern sie später nicht mehr gebraucht wird – ein zu vermeidender, zusätzlicher Verfahrensschritt darstellt, der seine Ursache unmittelbar in der neuen Regelung hat.
Gemäß Übergangsregelung sind vom neuen Verfahren bei Teilanmeldungen auch alle noch anhängigen Anmeldungen betroffen. Es handelt sich hierbei um eine unechte Rückwirkung, bei der die Rechtsfolgen der geänderten AO erst ab 1. April 2010 eintreten, wobei die neue Regelung an gegenwärtigen, noch nicht abgeschlossenen Sachverhalten (anhängige Anmeldung) anknüpft mit Rechtsfolgen für die Zukunft an (Frist für Einreichung einer Teilanmeldung), wodurch die betroffene in der Vergangenheit erworbene Rechtsposition (Teilanmeldung möglich solange Stammanmeldung anhängig) nachträglich entwertet wird. Bei einer Interessen- und Güterabwägung unter Berücksichtigung des Vertrauensschutzes des Anmelders hätte die Übergangsregelung dem Anmelder Vertrauensschutz zu gewähren, da sein schutzwürdiges Vertrauen auf den bisherigen Rechtszustand überwiegt. Neben dieser rechtlichen Einschränkung wird Anmeldern und Vertretern durch die Übergangsregelung zusätzlich ein finanzieller Aufwand in zweistelliger Millionenhöhe (bei Annahme eines Überprüfungsaufwandes von z.B. nur € 80.- pro anhängiger Anmeldung) aufgebürdet, um die Fristenlage hinsichtlich Teilanmeldungen in jeder anhängigen Anmeldung zu prüfen und entsprechende Schritte einzuleiten.
Zusammenfassend ist festzustellen, dass die angestrebte Änderung beim Verfahren der Teilanmeldungen insoweit mit den sehr allgemeinen Vorgaben der PVÜ konform sein mag, als Teilanmeldungen weiterhin möglich sind. Aber im Hinblick auf die Verfahrensökonomie und die Verfahrensführung wurde für den Anmelder eine wenig durchdachte und insbesondere keine «sinnvolle Regelung» gefunden, wie dies vom EPA publiziert wurde .
5.2 Zur Einführung der R. 70a und der Änderung von R. 161
Die neue R 70a bezieht sich auf R. 70(1) und sieht vor, dass das Europäische Patentamt den Anmelder gegebenenfalls auffordert, Mängel in den Anmeldungsunterlagen binnen einer Frist von 6 Monaten nach Hinweis auf die Veröffentlichung des Recherchenberichts zu beseitigen. Die geänderte R. 161 sieht für eine solche Mängelbeseitigung eine Frist von 1 Monat vor.
Beide Regeln erwecken vordergründig den Anschein einer gleichartigen Behandlung von EP-Direktanmeldungen und Euro-PCT-Anmeldungen. Die Änderungen dieser Regeln haben aber bei genauerer Betrachtung eine ganz unterschiedliche Qualität.
5.2.1 Zur neuen R. 70a
Auch wenn durch das BEST-Programm (Bringing Examination and Search Together) des EPA dieselbe Person eine Recherche zu einer Anmeldung durchführt, die Stellungnahme im Rahmen des erweiterten europäischen Recherchenberichts (EESR) erstellt und nach Vorliegen des Prüfungsantrags die Prüfung durchführt, so ist rechtssystematisch im EPÜ eine Trennung zwischen Recherchenabteilung (Art. 17) und Prüfungsabteilung (Art. 18) vorgegeben. Diese Trennung wurde bei der vorliegenden Einführung der R. 70a nicht berücksichtigt. In den Artikeln 92 und 94 EPÜ ist festgelegt, was im Rahmen der Recherche bzw. Prüfung durch die formaljuristisch getrennten Abteilungen erledigt werden soll.
Nach Art. 94(3) fordert die Prüfungsabteilung den Anmelder auf, die Unterlagen zu ändern. Die in der neuen R. 70a vorgesehene Aufforderung erfolgt durch die zu diesem Zeitpunkt des Verfahrens zuständige Recherchenabteilung (im Wortlaut der R. 70a: «das europäische Patentamt»), was aber nicht zu deren in Art. 92 definierten Kompetenzen, nämlich «Erstellen und Veröffentlichen des Recherchenberichts» gehört. Dass durch die R. 62 (EESR) eine Stellungnahme zum Recherchenbericht eingeführt wurde, kann der in Art. 92 vorgeschriebenen «Erstellung des Recherchenberichts» zugeordnet werden. Eine Aufforderung, Mängel zu beseitigen und Unterlagen zu ändern, geht aber über das in Art. 92 vorgesehene «Erstellen und Veröffentlichen des Recherchenberichts» hinaus. Hier werden Kompetenzen, die nach Art. 94 eindeutig der Prüfungsabteilung zugeordnet sind, auf die dafür nicht zuständige Recherchenabteilung übertragen. Die Anmeldung ist zum Zeitpunkt der Herausgabe des EESR noch nicht in der Zuständigkeit der Prüfungsabteilung. Diese Zuständigkeit der Prüfungsabteilung erfolgt erst mit der Stellung des Prüfungsantrags (R. 10(2)). Die dargelegte Vermischung von im EPÜ formaljuristisch klar getrennten Zuständigkeiten und Kompetenzen ist wohl unmittelbar auf die im Amt «gefühlte» Einheit von Recherche und Prüfung im Rahmen des BEST-Programms zurückzuführen. Eine solche Einheit ist aber im EPÜ gesetzgeberisch nicht umgesetzt.
Vor dem Hintergrund, dass eine Aufforderung nach R. 70a(1) von einer gemäß EPÜ dafür nicht vorgesehenen Abteilung herausgegeben wird, stellt sich somit auch die Frage, ob die Rechtsfolgen gemäß R. 70a(3) überhaupt Wirkung entfalten können. Dies wird die künftige Rechtsprechung klären, wenn eine diesbezügliche Beschwerde zu behandeln sein wird.
Die Aufforderung in R. 70a erfolgt in Zukunft zwangsweise, wenn die Rechercheabteilung Mängel in den Anmeldungsunterlagen findet. Dies wurde Jahresbericht 2008 im Übrigen bereits entsprechend vorangekündigt, in dem öffentlichkeitswirksam von einer «obligatorischen Erwiderung des Anmelders auf die dem Recherchenbericht beiliegende Stellungnahme...» gesprochen wird.
Zur Einführung der R. 70a(1) ist außerdem festzustellen, dass der Anmelder aufgrund seiner auf den Ergebnissen des EESR basierenden (ökonomischen) eigenen Bewertung der Anmeldung eine Entscheidung trifft, ob er die Anmeldung weiterführen will. Entsprechend wird der Anmelder die Prüfungs- und Benennungsgebühr entrichten. Entscheidet sich der Anmelder aber dafür, die Anmeldung nicht weiterzuführen, geht die Aufforderung nach R. 70a ins Leere. Dies ist aus einer Innensicht des EPAs genau das Gegenteil von «Steigerung der Verfahrenseffizienz». Anscheinend ist die Sicht im EPA bezüglich der Verfahrenseffizienz aber nur darauf fokussiert, dass der Anmelder dazu angehalten wird.
5.2.2 Zur geänderten R. 161
Eine Mitteilung nach R. 161 wird nach alter und neuer AO erst erlassen, wenn der Anmelder die erforderlichen Schritte gemäß R. 159 zur Einleitung der regionalen Phase wirksam vorgenommen hat. Dies geschieht normalerweise unter voller Ausnutzung der Frist von 31 Monaten (R. 159). In aller Regel ist mit dem Ablauf der 31-Monatsfrist auch der Prüfungsantrag wirksam zu stellen. Das wirksame Stellen des Prüfungsantrages bedeutet, dass die betreffende Euro-PCT-Anmeldung in die Zuständigkeit der Prüfungsabteilung übergegangen ist (R. 10(2)).
Der von der ISA=EP oder der IPEA=EP erstellte schriftliche Bescheid bzw. vorläufige Internationale Prüfungsbericht ist qualitativ vergleichbar mit einem Bescheid nach Art. 94(3). Die Qualität dieser beiden vorgenannten in der internationalen Phase entstehenden Dokumente/Bescheide wird hier ausdrücklich anerkannt.
Die vorgesehene Mitteilung nach der ab 1. April 2010 gültigen R. 161 hat zwei Konsequenzen:
i) Sie stellt im Regelfall (=Einleitung der regionalen europäischen Phase nach 31 Monaten) den ersten Bescheid dar, der von der Prüfungsabteilung erlassen worden ist. Das Datum dieses Bescheides triggert folglich die neue 24-Monatsfrist für das Einreichen einer Teilanmeldung (neue R. 36(1), siehe oben Kap. 5.1).
ii) Auf einen materiellen Prüfungsbescheid hat der Anmelder innerhalb der gesetzlichen Frist von 1 Monat zu antworten. Für diese Frist kann keine Fristverlängerung gemäß R. 132(2) beantragt werden, sondern gegebenenfalls nur die gebührenpflichtige Weiterbehandlung. Demgegenüber beträgt im eigentlichen Prüfungsverfahren die Frist zur Beantwortung in aller Regel 4 Monate mit der Möglichkeit, diese auf rechtzeitig gestellten Antrag hin verlängern zu können.
Die vorstehend aufgeführten Konsequenzen ergeben sich aus einer sachkundigen Interpretation der Gesamtheit der Regelungen des EPÜ.
5.2.3 Fazit
Die Einführung der R 70a und die Änderung der R. 161 im Hinblick auf die Herausgabe einer Aufforderung zur Änderung der Unterlagen durch die Recherchenabteilung erscheinen im Lichte der obigen Ausführungen wenig durchdacht. Dies führt sogar dazu, dass in Bezug auf die neue R. 70a die Frage im Raum steht, ob der Verwaltungsrat bei den Änderungen der Ausführungsordnung seine Kompetenzen überschritten hat, da die R. 70a keine Weiterbildung bzw. Spezifizierung der zugehörigen Artikel 17 und 92 des EPÜ darstellt. Vielmehr wird in der AO eine im EPÜ so nicht vorgesehene Sonderkompetenz der Recherchenabteilung definiert, um die durch BEST amtsintern vorgesehene Einheit von Recherchenabteilung und Prüfungsabteilung schleichend zum Gesetz zu machen. Eine derartige dem EPÜ widersprechende gesetzgeberische Umsetzung von im Amt gelebter Praxis in der AO ist nach gängigem Rechtsverständnis eigentlich nicht hinnehmbar. Leider gibt es aber keine juristische Möglichkeit gegen Beschlüsse des VR vorzugehen bzw. Änderungen in der AO von einer unabhängigen Instanz überprüfen zu lassen.
Die neue R. 70a und die geänderte R. 161 zwingen den Anmelder dazu, vor der Herausgabe eines eigentlichen Prüfungsbescheids nach Art. 94(3) Stellung zu beziehen und Mängel in den Unterlagen zu einem früheren Zeitpunkt als bisher zu beseitigen. Es bleibt abzuwarten, wie das EPA Anmeldungen behandeln wird, bei denen der Anmelder/Vertreter nur eine kurze Stellungnahme als Reaktion auf die Mitteilung nach R. 70a bzw. R. 161 abgibt, ohne Änderungen in den Unterlagen vorzunehmen. Nach R.70a(3) sollte eine solche Stellungnahme ausreichen, die Rücknahmefiktion der R. 70a(3) zu vermeiden.
Die angeblich vom EPA angestrebte Effizienzsteigerung beim Prüfungsverfahren kann nur dann erreicht werden, wenn das Amt selbst auf rechtzeitig eingereichte Änderungen bzw. Stellungnahmen innerhalb weniger Monate (
The third amendment to the Implementing Regulation to EPC 2000 since its entry into force on 13 December 2007, which is due to take effect on 1 April 2010, gives reason to question the frequency of amendments by the Administrative Council of the European Patent Organization. These amendments relate primarily to the EPO-internal initiative “raising the bar”, whereby the procedural efficiency vis-à-vis the EPO is to be expedited and high-quality patents are to succeed in being granted. However, the latest amendments in particular result in a complicated and inefficient procedure and heavily restrict the applicants in their freedom of scope without thereby enabling positive effects to be expected in terms of high-quality patents. About the authors
1 Introduction
The current resolutions of the Administrative Council of the European Patent Organization (EPO) of 25 March 2009 have resulted in minimal understanding among applicants and authorized representatives. These resolutions already constitute the third amendment to the Implementing Regulation to the European Patent Convention (EPC) 2000 since the latter’s entry into force on 13.12.2007. Since that point, not a year has gone by without amendments being made to the Implementing Regulation. The effect of this rapid sequence of amendments, particularly with regard to the amendments that enter into force in 2010, is that the extent and consequences of the amendments to the Implementing Regulation and the Rules relating to Fees can only become more difficult to comprehend by those involved in the procedures.
The implemented and proposed amendments to the Implementing Regulation relate primarily to the EPO-internal initiative “Raising the Bar” . This initiative is intended to drive the granting of high-quality patents. Closer scrutiny of the EPO Annual Report 2008 reveals another picture, however. The amendments are aimed at “enhancing procedural efficiency” and reducing opportunities for applicants to “circumvent efficient examination procedures” . Its basic principles are therefore restricting freedom of scope for applicants, and disciplining them. Whether such restrictions help improve the material quality and stability of patents is unclear and highly doubtful.
In this article, key points and consequences of the previous and approved amendments to EPC 2000 are critically highlighted.
2 EPC 2000 Legislation
2.1. Review
EPC 2000 was by no means completed with the conclusion of the revision conference in Munich from 20th to 29th November 2000 and the publication in 2001 of Special Edition No. 4 OJ EPO as per “Decision of the Administrative Council of 28 June 2001 adopting the new text of the European Patent Convention”. Since EPC 2000 made provision for a great many material and procedural points to be revised in the Implementing Regulation, EPC 2000 did not take any specific shape for all those involved in drawing up the Implementing Regulation until 2007. EPC 2000 then entered into force on 13 December 2007.
2.2. Effect of EPC Art. 33
The increased movement of material and procedural rules into the Implementing Regulation gives the EPO Administrative Council greater opportunity to implement provisions in the Implementing Regulation itself (Art. 33(1)c). The Administrative Council was thus afforded extensive authority in terms of shaping the Implementing Regulation to EPC 2000. This extension of authority is explained as being due to practical considerations. They wanted to avoid the need to call a diplomatic conference regularly for minor amendments. Such extensive legislative authority conceals the risk that the body responsible will make amendments quickly and in its own interests. This is particularly problematic because the Administrative Council has no democratic legitimacy: its members are not elected by the parliament of the Member State, but appointed by the executive. Moreover, the Administrative Council is actually a supervisory body which is intended to ensure that everything functions properly. In other words, from administrators selected by the executive has evolved – to the exclusion of the public – a body which assumes legislative authority and which is not subject to supervision. This neither corresponds to the principles of separation of powers, nor is it compatible with the judicial control of administration.
2.3. Unilateral legislative processes
Because even the Committee on Patent Law , which prepares and advises on statutory amendments, comprises members of the Administrative Council and the president of the EPO (supported by EPO employees) as enfranchised persons, the Administrative Council has a free hand in terms of amendments to the Implementing Regulation. Other competent members of the Committee on Patent Law have only the status of non-enfranchised observers, such as – for example – the Institute of Professional Representatives before the European Patent Office (epi). If objections are raised by the observers, these may be taken into account but do not have to be. In any agreement about amendments, however, the enfranchised persons generally represent the interests of the Administrative Council or the management of the Office. This set of interests is then presented to the Administrative Council for resolution. Critical opinions on the part of applicants or authorized representatives therefore carry no weight in the legislative procedures of the EPO, because this group of persons has no voting rights either on the Committee on Patent Law or on the Administrative Council. Legislation is therefore carried out unilaterally by the Administrative Council, generally supported by the management of the Office.
3 Evaluation of the amendments of 1 April 2008
3.1 Claims fees
The amendment of R. 45 of 6 March 2008 and of further regulations based thereon must be carried out consistently on the basis of the amendment to the Rules relating to Fees (concluded on 14 December 2007). This amendment incorporates the introduction of a claims fee of € 200.00 from the 16th claim, the first 15 claims being free of charge.
This new charging structure is proving to be particularly disadvantageous in particular for small and medium-sized businesses, if several independent claims in different categories are presented in one patent rights application. In such cases fifteen claims are not usually sufficient, for example, to enable a full claim and a device, as well as a method together with preferred embodiments, to be formulated.
Furthermore, it remains to be seen how the EPO will deal with patent claims in which a number of optional features from what used to be independent claims are combined using “and/or” or “preferably”, or similar connectives, in order to reduce the formal number of claims. A number of alternatives are then included individually within one independent claim.
In addition to criticism relating to the content, it is also difficult to understand the timing for implementation of these amendments, i.e. why they were not likewise implemented on 13 December 2007.
4. Evaluation of the amendments of 1 April 2009
The main amendments of 1.4.2009 relate to a standardized designation fee and the advancement of the due date for additional fees for extensive claims. In addition to the following criticism relating to content, it should be noted that these amendments also would have been possible on 13 December 2007 with simplified transitional arrangements, i.e. without parallel application of two separate rules such as rule 38, 39 and 71.
4.1. Additional fee
From an overall perspective, in terms of processing costs at EPO the advancement of the additional fee (from the 36th page of the application) may be seen as a step in the right direction for the purposes of cause-related cost allocation. The page count is based on the version filed – whether in one or other language or in an official language. The page count according to any subsequently filed translation into an official language is negligible .
4.2. Standard designation fee
A designation fee is legitimized by Art. 79. The introduction of a standard designation fee may simplify the process for the applicant, but for applicants who have restricted themselves to fewer than five designated countries up until this procedure started, it means the process is more expensive. Both individual applicants and small/medium-sized enterprises are affected most heavily by this increase in costs.
Whilst any future amendment to Art. 79 will be taken into account in a diplomatic conference, it would be desirable for the designation fees to be completely canceled as a separate standard charge. The designation fee could just as easily be charged as part of the application fee when the application is filed or as part of the examination fee when the request for examination is presented. This would be a further procedural simplification for the applicant. A further simplification such as this also makes sense because, for Art. 54(3) EPC 2000, as a result of the discontinuation of R. 23a EPC 1973, the material significance of the payment of designation fees has likewise disappeared. This would then lead to an analogous arrangement with regard to the designation of countries such as in the PCT. Of course, this would also require a separate arrangement to be made for extension fees within the framework of a new extension regulation. Such an arrangement would need to be independent of the designation of contracting states to the EPC.
4.3. Claims fees
In addition to the introduction of a claims fee of €200.00 from the 16th claim, it should also be mentioned that the Rules relating to Fees applicable since 1.4.2009 provides for further increased claims fees (€500.00) from the 51st claim. In summary, with regard to the multi-level charging of claims fees applicable from now on, it should be noted that these could have been structured in a more applicant-friendly way especially for individual applicants and small/medium-sized enterprises, e.g. with lower charges (significantly less than €200.00) from the 11th claim (similar to the situation prior to 31.03.2008) and increased charges from the 30th claim (more than €200.00). This would have enabled the Office to protect its financial interests without any problems whilst at the same time taking any financially weaker applicants into account.
Whether the new fee structure for patent claims is advantageous for the EPO remains to be seen. In financial terms the five additional charge-free claims represent only a one-time loss for the EPO. If this monetary loss cannot be balanced by the new claims fees, then further applicant-unfriendly charge increases may be expected elsewhere.
5. Evaluation of the amendments of 1 April 2010
Full information about the forthcoming amendments to the Implementing Regulation of 1 April 2010 may be obtained from the specified URLs or from the Official Journal .
In particular, the amendments to rules 36(1), 36(2); 137(4); 161 and to the introduction to the new rule 70a are dealt with below.
5.1 New procedure for divisional applications
The “divisional application” instrument was proposed by the Paris Convention Art. 4G(1). Since EPC is a special agreement as per Paris Convention Art. 19, EPC provisions may not run contrary to the Paris Convention.
For reasons that are incomprehensible to outsiders, serious consideration has been given within the EPO to tightening the procedure for divisional applications. In the document CA/PL 8/08 of the Committee on Patent Law, Chapter IV “Abuse of Divisionals”, it was determined that any duplication of the examination procedure by filing divisional applications is an abuse of the patent system by the applicant. In order to curtail this abuse, on 25 March 2009 – to the surprise of applicants and representatives – rules 36(1) and 36(2) were amended by the Administrative Council resolution which enters into force on 1 April 2010.
The following, on the subject of “abuses”, is quoted from Decision G 0001/05 relating to divisional applications:
“If administrative measures, such as giving priority to the examination of divisional applications and bundling and speedily deciding co-pending divisional applications so as to minimize the possibility for applicants to keep alive subject-matter on which the Examining Division had already given a negative opinion in one application by means of refiling the same subject-matter again and again, are not adequate, it would be for the legislator to consider where there are abuses and what the remedy could be.”
Whether the filing of a divisional application constitutes an abuse is, therefore, discretionary to a large extent.
For the duplication of the examination process by filing divisional applications to qualify as abuse (CA/PL 8/08), is devoid of any foundation. The applicant pays an application and examination fee for each of these duplicates as well as annual charges that are already expired. From the economic perspective at least, the EPO does not suffer any disadvantage from the duplicates. On the contrary: processing is easier for a European application that has already been at least partially processed.
The abuse by duplication argument is supported by the EPO on the basis of the following figures (source CA/PL 8/08):
- 5% of all European patent applications are divisional applications;
- divisional applications of the second generation comprise 7% of all divisional applications; and
- divisional applications of the third or subsequent generation comprise 1% of all divisional applications.
Assuming that divisional applications of the second or subsequent generation are all based on “abuses”, then – on the basis of the application figures for 2007 of around 141,000 applications – this leaves a figure of around 550 “abusive” applications. Against this background it must be asked whether the normal processing of divisional applications of the second and subsequent generations (approx. 8% of all divisional applications or 4 in every thousand of all applications) costs less for all participants (applicants and their representatives, and Office) than the implementation, incorporation and monitoring of the new 24-month time limit. The selected regulation seems to benefit neither the Office nor the applicant, but results in an unnecessary administrative cost for both sides. In addition, applicants are severely restricted in their freedom of scope. Resourceful applicants and representatives have already brought into circulation ways of circumventing the 24-month time limit, which enable a divisional application to be kept up their sleeve legitimately even after expiry of the 24 months .
It will be interesting to see how the number of divisional applications in the first 6 from 1.4.2010 will increase on the basis of the transitional arrangements incorporated in the Administrative Council’s resolution . It should be expected that financially strong applicants will file at least one divisional application as a backup. This could also be a strategy of these very applicants in future before expiry of the new 24-month time limit. Since having such divisional applications in reserve could only be a realistic option for financially strong applicants, the new procedure represents a clear disadvantage for small and medium-sized enterprises and individual applicants. It may also be assumed that the number of divisional applications (in reserve) will increase, leading to a heavier burden on the EPO. In this regard, reference is made again to the Annual Report 2008: the Office “demands that resources are not squandered on systematically avoidable procedural matters”. This, however, is precisely what may be expected with the new procedure for divisional applications, because the applicant, if in doubt, will file a divisional application as a backup, which – if it is subsequently no longer needed – represents an avoidable additional procedural step which has is origin directly in the new arrangements.
According to the transitional arrangements all applications still pending are also affected by the new procedure. This is a non-authentic retroactive effect in which the legal consequences of the amended Implementing Regulation do not enter into force until 1 April 2010, wherein the new arrangements are linked to current situations that have not yet been concluded (pending applications) with legal consequences for the future (time limit for filing a divisional application), with the result that the relevant legal position obtained in the past (divisional application possible as long as parent application pending) is retroactively invalidated. When weighing up all the interests at stake and taking protection of the applicant’s legitimate expectations into account, the transitional arrangements would have to guarantee that the applicant’s legitimate expectations are protected, since their confidence in the previous legal position, which is worthy of protection, takes precedence. Alongside this legal restriction, the transitional arrangements cause applicants and representatives to be additionally encumbered with a financial outlay amounting to tens of millions of Euros (assuming the cost of a request for examination of only €80.00 per dependent application, for example), in order to review the deadline situation with regard to divisional applications in each dependent application and take steps accordingly.
In summary, it can be seen that the desired amendment to the procedure for divisional applications may be in keeping with the very general standards of the Paris Convention to the extent that divisional applications continue to be possible. However, with regard to procedural economics and administration, a poorly considered arrangement which – in particular – does not constitute “suitable rules” as publicized by the EPO , has been found for the applicant.
5.2 With regard to the introduction of R. 70a and the amendment of R. 161
The new R 70a relates to R. 70(1) and provides that the European Patent Office should request the applicant, if necessary, to rectify deficiencies in the application documents within a period of 6 months after notification of the search report publication. The amended R. 161 provides for such deficiencies to be rectified within a period of 1 month.
On the surface these two rules give the appearance of direct EP applications and Euro-PCT applications being treated similarly. However, on closer scrutiny the amendments to these regulations have a quite different quality.
5.2.1 With regard to the new R. 70a
Even if, through the EPO’s BEST program (Bringing Examination and Search Together), the same person carries out a search of an application, gives an opinion in the context of the extended European search report (EESR), and carries out the examination upon receiving the request for examination, in legal terms there is a separation in the EPC between search department (Art. 17) and examination department (Art. 18). This separation was not taken into account in this implementation of R. 70a. Articles 92 and 94 EPC stipulate what is to be carried out in the course of the search and/or examination by the legally separate departments.
According to Art. 94(3) the examination department requests the applicant to amend the documents. The request provided for in the new R. 70a is made by the examination department responsible at this stage of the process ( “the European Patent Office” as defined in R. 70a:), but this, however, is not included in their responsibilities as defined in Art. 92, i.e. “drawing up and publication of the search report”. Since an opinion on the search report was introduced by R. 62 (EESR), the “drawing up of the search report” prescribed in Art. 92 may be assigned. However, a request for deficiencies to be rectified and documents to be amended goes beyond “drawing up and publication of the search report” as provided for in Art. 92. In this instance powers that are clearly assigned to the examination department according to Art. 94 are transferred to the search department, which is not responsible for them. At the time the EESR is issued, the application is not yet under the responsibility of the examination department. The examination department does not assume responsibility until the request for examination is submitted (R. 10(2)). This confusion of responsibilities and powers that are clearly legally separate in the EPC can probably be directly attributed to the perceived feeling of entity in the Office between search and examination in the context of the BEST program. However, this entity is not incorporated into the EPC for legislative purposes.
If a request under R. 70a(1) is issued by a department that is not provided for this purpose according to the EPC, this also begs the question as to whether the legal consequences according to R. 70a(3) can actually have any effect. This will be clarified by the future jurisdiction if a complaint on this matter is to be handled.
The request in R. 70a will be enforced in the future if the search department finds deficiencies in the application documents. Moreover, advance notice of this was already given in the Annual Report 2008 which effectively makes reference to a “mandatory response [by the applicant] to the written opinion issued with the search report...”.
With regard to the introduction of R. 70a(1) it can further be established that applicants make a decision based on their own assessment (in economic terms) of the application, which is in turn based on the results of the EESR, as to whether they wish to pursue the application. The applicant pays the examination and designation fee accordingly. However, if the applicant decides not to pursue the application, the request according to R. 70a comes to nothing. From the internal perspective of the EPO, this is precisely the opposite of “enhancing procedural efficiency”. Apparently, however, the EPO’s view concerning procedural efficiency is focused only on the applicant being enjoined to practice it.
5.2.2 With regard to the amended R. 161
According to the old and new Implementing Regulation, a communication according to R. 161 is issued only if the applicant has taken the necessary steps to initiate the regional phase in accordance with R. 159. This normally happens with the 31-month time limit being fully exploited (R. 159). Generally speaking, the request for examination must also effectively be submitted once the 31-month time limit is reached. Effective submission of the request for inspection means that the relevant Euro-PCT application is transferred to the responsibility of the examination department (R. 10(2)).
The written communication or international preliminary examination report issued by the ISA=EP or the IPEA=EP is comparable in terms of quality with a communication according to Art. 94(3). The quality of these two aforementioned documents/communications produced in the international phase is expressly recognized here.
The notification provided for according to R. 161 valid as from 1 April 2010 has two consequences:
i) It is normally the first communication (= initiation of the regional European phase after 31 months), which has been issued by the examination department. The date of this communication subsequently triggers the new 24-month period for the submission of a divisional application (new R. 36(1), see section 5.1 above).
ii) The applicant must respond to a material office action within the statutory period of one month. No extension to this period may be requested according to R. 132(2), but further processing is possible if necessary upon payment of a fee. In contrast, during the actual examination process the time limit for responding is generally 4 months with the option to extend it provided sufficient notice is given.
The consequences described above result from an informed interpretation of all the EPC regulations.
5.2.3 Upshot
The introduction of R 70a and the amendment of R. 161 with regard to the issuing by the search department of a request to amend the documents, appear to be poorly considered in the light of the above observations. This even leads one to ask, with reference to the new R. 70a, whether the Administrative Council has exceeded its authority in the amendments to the Implementing Regulation, since R. 70a does not present any development or specification of the relevant articles 17 and 92 of the EPC. Instead, any special competence of the search department not thus provided for in the EPC is defined in the Implementing Regulation, in order to make the entity of search department and examination department, as provided for internally through BEST, into law by insidious means. Implementing Office practice in the Implementing Regulation for legislative purposes in this way, contrary to the EPC, is simply not tolerable according to conventional understanding of the law. Unfortunately, however, there is no legal facility for taking action against Administrative Council resolutions or having amendments to the Implementing Regulation reviewed by an independent entity.
The new R. 70a and the amended R. 161 compel the applicant, before an actual official communication is issued according to Art. 94(3), to state an opinion and rectify deficiencies in the documents by an earlier time limit than before. It remains to be seen how the EPO will deal with applications in which the applicant/representative provides only a brief statement of opinion in response to the notification according to R. 70a and/or R. 161, without making any amendments to the documents. According to R.70a(3) such a statement of opinion should be sufficient in order to avoid the fiction of withdrawal in R. 70a(3).
The enhanced efficiency that the EPO is allegedly striving for in its examination process can only be achieved if the Office itself also duly responds within a few months (

La période de garantie est de 12 mois, à compter de la Réception provisoire mais est limitée en tout cas à 18 mois à dater l’entrée en vigueur du contrat. La période de garantie pour les pièces réparées ou remplacées se terminera a la fin de la période de garantie originale de la pièce remplacée ou réparée et n’excèdera en aucun cas la période de garantie mentionnée ci-dessus.

Die vorliegende Erfindung betrifft ein Kältegerät mit drei voneinander isolierten und durch von Kältemittel durchströmte Verdampfer gekühlten Lagerzonen.
[0002] Bei einem herkömmlichen Typ derartiger Kältegeräte sind die Verdampfer der drei Lagerzonen in einem Kältemittelkreis hintereinandergeschaltet. Die Kühlleistung des am weitesten stromabwärts im Kältemittelkreis liegenden Verdampfers wird über die in dem Kältemittelkreis zirkulierende Kältemittelmenge geregelt. Hierfür ist ein Kältemittelsammler in einem Hochdruckbereich des Kältemittelkreises angeordnet. Wenn dieser flüssiges Kältemittel speichert, arbeitet der Kältemittelkreis in einem unterfüllten Zustand, was dazu führt, dass das Kältemittel im Wesentlichen bereits verdampft ist, bevor es den am weitesten stromabwärts liegenden Verdampfer erreicht. Die Kühlleistung konzentriert sich somit auf die von den weiter stromaufwärts liegenden Verdampfern gekühlten Lagerzonen. Da in den beiden stromaufwärtigen Lagerzonen eine voneinander unabhängige Regelung der Kühlleistung nicht möglich ist, müssen die Kühlleistung dieser Verdampfer und der Kältemittelbedarf dieser Lagerzonen exakt aufeinander abgestimmt sein, um eine Unterkühlung in der einen oder anderen Lagerzone zu verhindern.
[0003] In DE 197 56 861A1 wird versucht, diesen Nachteil zu beheben, indem bei einem Kältemittelgerät mit drei Lagerzonen, die durch in einem Kältemittelkreis in Reihe geschaltete Verdampfer gekühlt sind, an dem am weitesten stromaufwärts gelegenen Verdampfer eine zweite Einspritzstelle vorgesehen wird, die es ermöglicht, den Weg des Kältemittels durch diesen Verdampfer zu verkürzen. Eine voneinander unabhängige Kühlung der zwei in dem Kältemittelkreis nachgeordneten Lagerzonen ist jedoch auch mit dieser Anordnung schwierig.
[0004] Aus DE-OS 1 941 495 ist ein Kältegerät mit drei Lagerzonen bekannt, denen jeweils in parallelen Kältemittelkreisen angeordnete Verdampfer zugeordnet sind. Ein solcher Aufbau ermöglicht zwar eine willkürliche Verteilung der Kühlleistung auf die verschiedenen Lagerzonen, doch führen die hierfür benötigten Wegeventile zu hohen Kosten.
[0005] Ziel der vorliegenden Erfindung ist, ein Kältegerät mit drei Lagerzonen anzugeben, bei dem die Kühlleistung mit einfachen Mitteln flexibel auf die verschiedenen Lagerzonen verteilt werden kann.
[0006] Die Aufgabe wird dadurch gelöst, dass bei einem Kältegerät mit drei voneinander isolierten und durch von Kältemittel durchströmte Verdampfer gekühlten Lagerzonen, wobei ein erster Kältemittelkreis durch eine erste und eine zweite der drei Lagerzonen verläuft, ein zu dem ersten Kältemittelkreis paralleler zweiter Kältemittelkreis durch die erste und die dritte der Lagerzonen verläuft.

[0008] Vorzugsweise ist die erste Lagerzone in beiden Kältemittelkreisen die stromaufwärtige Lagerzone.

[0018] Fig. 1 ist eine schematische Frontalansicht eines Kältegerätes mit drei Lagerzonen, einem Gefrierfach 1, einem Frischkühlfach 2 und einem Normalkühlfach 3. Dem Gefrierfach 1 und dem Normalkühlfach 3 sind jeweils in offener Stellung gezeigte schwenkbare Türen 4, 5 zugeordnet. Das Normalkühlfach 3 ist normalerweise durch eine Frontplatte einer herausziehbaren Schublade verschlossen. Die Schublade ist in der Figur nicht dargestellt, um die Rückwände aller drei Fächer 1, 2, 3 zeigen zu können. An diesen Rückwänden ist - schaumseitig und daher an sich nicht sichtbar - jeweils ein Verdampfer 6, 7, 8 zum Kühlen des entsprechenden Faches 1, 2 bzw. 3 angeordnet. Die Verdampfer 6, 7, 8 sind jeweils als gestrichelte Umrisse dargestellt. Sie sind in an sich bekannter Weise aufgebaut aus einer sich an die Rückwand des entsprechenden Faches anschmiegenden ebenen Platine aus Metall, zum Beispiel aus Aluminiumblech, und einer mit dieser Platine flächig verbundenen zweiten Metallplatte, in der Kältemittelleitungen bildende Rillen eingetieft sind; alternativ können die Kältemittelleitungen auch durch an der Platine befestigte Rohrleitungen gebildet sein.
[0019] Auf der Platine des Gefrierfachverdampfers 6 verlaufen zwei Kältemittelleitungen 9, 10 in Mäandern nebeneinander her von einer Einspritzstelle 11 bzw. 12 zu einem Auslass 13 bzw. 14. Beide Kältemittelleitungen 9, 10 erstrecken sich im Wesentlichen über die gesamte Höhe und Breite der Platine, so dass deren gesamte Oberfläche sowohl durch die Kältemittelleitung 9 als auch die Kältemittelleitung 10 effizient kühlbar ist. An den Auslass 13 ist der Verdampfer 7 des Frischkühlfaches 2 angeschlossen; an den Auslass 14 der Verdampfer 8 des Normalkühlfaches 3. Die Verdampfer 7, 8 sind über eine gemeinsame Saugleitung 15 mit einem Verdichter 16 verbunden, der Verdichter 16 speist die zwei Kältemittelleitungen 9, 10 des Gefrierfachverdampfers 6 über einen Verflüssiger 17, eine Druckleitung 18, ein Magnetventil 19 und Kapillaren 20, 21, die an den Einspritzstellen 11, 12 in die Kältemittelleitungen 9 bzw. 10 münden.
[0020] In einer ersten Stellung des Magnetventils 19 verbindet dieses die Druckleitung 18 mit der Kältemittelleitung 9 des Gefrierfachverdampfers 6 und dem hiermit in Reihe verbundenen Verdampfer 7 des Frischkühlfaches 2, während die Leitung 10 abgesperrt ist. In diesem Zustand verteilt sich die Kühlleistung des zirkulierenden Kältemittels auf das Gefrierfach 1 und das Frischkühlfach 2 in einem ersten durch die Konstruktion des Kältegerätes vorgegebenen Verhältnis.

So verteilt sich die Kühlleistung des Kältemittels in einem zweiten Verhältnis auf das Gefrierfach 1 und das Normalkühlfach 3.
[0022] In einer dritten Stellung des Magnetventils 19 werden beide Kältemittelleitungen 9, 10 des Gefrierfachverdampfers 1 und die mit ihnen in Reihe verbundenen Verdampfer 7 bzw. 8 gleichzeitig mit Kältemittel versorgt. Der Kältemittelfluss durch den Gefrierfachverdampfer 6 ist daher höher als in den beiden zuvor erwähnten Stellungen des Magnetventils 19, doch führt dies nicht zu einer wesentlich stärkeren Abkühlung des Gefrierfachverdampfers 6. Daher ist in dieser Stellung in jedem der zwei parallelen Kältemittelkreise die Verteilung der Kühlleistung zu Gunsten des jeweils stromabwärts liegenden Faches 2 oder 3verschoben. So ist es möglich, die Abmessungen der Verdampfer 6, 7, 8 und die die Fächer 1, 2, 3 umgebenden Isolationsmaterialstärken jeweils so zu dimensionieren, dass bei ausschliesslich ungleichzeitigem Betrieb der parallelen Kältemittelkreise, das heisst bei Betrieb nur in den ersten zwei Stellungen des Magnetventils 19, eine etwas zu starke Kühlung des Gefrierfaches 1 resultiert, wenn die anderen beiden Fächer 2, 3 jeweils auf eine Solltemperatur geregelt werden. Diese übermässige Kühlung des Gefrierfaches 1 kann jedoch verhindert werden, indem in der dritten Stellung des Magnetventils 19 die zwei parallelen Kältemittelkreise gleichzeitig versorgt werden. So können effektiv die Temperaturen in den drei Fächern unabhängig voneinander geregelt werden, ohne dass es hierfür erforderlich wäre, die Menge an zirkulierendem Kältemittel zeitweilig zu reduzieren und so einen ineffizienten unterfüllten Zustand des Kältemittelkreislaufes herbeizuführen.
Patentansprüche
1. Kältegerät mit drei voneinander isolierten und durch von Kältemittel durchströmte Verdampfer gekühlten Lagerzonen (1, 23), wobei ein erster Kältemittelkreis (9, 7) durch eine erste (1) und eine zweite (2) der drei Lagerzonen verläuft, dadurch gekennzeichnet, dass ein zu dem ersten Kältemittelkreis (9, 7) paralleler zweiter Kältemittelkreis (10, 8) durch die erste und die dritte der Lagerzonen (1, 3) verläuft.
2. Kältegerät nach Anspruch 1, dadurch gekennzeichnet, dass die erste Lagerzone (1) in beiden Kältemittelkreisen die stromaufwärtige Lagerzone ist.
3. Kältegerät nach Anspruch 1 oder 2, dadurch gekennzeichnet, dass die erste Lagerzone (1) die kälteste unter den Lagerzonen (1, 2, 3) ist.
4. Kältegerät nach einem der vorhergehenden Ansprüche, dadurch gekennzeichnet, dass die Kältemittelkreise (9, 10) in der ersten Lagerzone (1) über eine gleiche Verdampferplatine geführt sind.
5. Kältegerät nach Anspruch 3, dadurch gekennzeichnet, dass jeder Kältemittelkreis sich über im Wesentlichen die gesamte Ausdehnung der Verdampferplatine des Verdampfers (6) der ersten Lagerzone (1) erstreckt.
6. Kältegerät nach einem der vorhergehenden Ansprüche, dadurch gekennzeichnet, dass in jedem Kältemittelkreis ein Absperrventil (19) stromaufwärts von den Lagerzonen (1, 2, 3) angeordnet ist.
7. Kältegerät nach Anspruch 6, dadurch gekennzeichnet, dass das Absperrventil (19) ein Magnetventil ist.
8. Verdampfer für ein Kältegerät nach einem der vorhergehenden Ansprüche, dadurch gekennzeichnet, dass er zwei miteinander unverbundene Kältemittelleitungen (9, 10) auf einer gemeinsamen Platine aufweist.
9. Verdampfer nach Anspruch 8, dadurch gekennzeichnet, dass in jeder der Kältemittelleitungen (9, 10) eine Einspritzstelle (11, 12) gebildet ist.
Translation - English Refrigeration device with three temperature zones
The invention relates to a refrigeration device having three storage zones that are insulated from one another, and are cooled by means of evaporators through which a coolant flows.
In a conventional refrigeration device of this type the evaporators in the three storage zones are connected in series in a coolant circuit. The cooling capacity of the evaporator located furthest downstream in the coolant circuit is controlled via the coolant quantity circulating in the coolant circuit. For this purpose a coolant reservoir is disposed in a high-pressure area of the coolant circuit. When this liquid coolant is stored, the coolant circuit operates in an underfilled state, which causes the coolant to have essentially already evaporated before it reaches the evaporator located furthest downstream. The cooling capacity is thus concentrated on the storage zones cooled by the evaporators located further downstream. Since the cooling capacity in the two downstream storage zones cannot be controlled independently of one another, the cooling capacity of this evaporator and the coolant requirement of these storage zones are precisely tailored to one another to prevent any undercooling in one or other storage zone.
An attempt was made in DE 197 56 861 A1 to eliminate this disadvantage, wherein – in a coolant device having three storage zones that are cooled by evaporators connected in series, on which a second injection site is provided on the evaporator located furthest upstream, that enables the path of the coolant to be shortened by this evaporator. Even with this arrangement, however, it is difficult for the storage zones located downstream in the coolant circuit to be cooled independently of one another.
A refrigeration device having three storage zones is known from DE-OS 1 941 495, in which evaporators are disposed respectively in parallel coolant circuits. Even though such a configuration enables the cooling capacity to be distributed randomly across the different storage zones, the directional valves required for this purpose lead to high costs.
The object of this invention is to provide a refrigeration device having three storage zones, wherein the cooling capacity can be flexibly distributed to the different storage zones by simple means.
This object is achieved in that, in a refrigeration device having three storage zones that are insulated from one another and cooled by means of evaporators through which a coolant flows, wherein a first coolant circuit extends through a first and a second of the three storage zones, a second coolant circuit parallel to the first coolant circuit extends through the first and the third of the storage zones.
When coolant is circulated through the first coolant circuit, the available cooling capacity is distributed to the first and the second storage zone in a first proportion (wherein this proportion may be variable by varying the coolant quantity circulating, controlling the coolant pressures occurring, or similar), and when the coolant is circulated through the second coolant circuit, the cooling capacity is distributed to the first and the third storage zone in a second proportion. However, if both coolant circuits are supplied simultaneously, the heat to be dissipated from the first storage zone is distributed to both coolant circuit – in other words, if the coolant from the first circuit is cooled by the second circuit and vice versa – so that the distribution of the cooling capacity in each of the two coolant circuits is shifted clearly in favor of the second or the third storage zone respectively.
The first storage zone in both coolant circuits is advantageously the upstream storage zone.
The observed shift in the distribution of cooling capacity when both coolant circuits are operating simultaneously is all the greater, the smaller the difference in temperature between the first storage zone and the coolant circulating within it. The first storage zone is therefore advantageously the coolest of the three storage zones.
Furthermore, it is beneficial for the redistribution of cooling capacity if the coolant circuits in the first storage zone are guided via an identical evaporator board.
Moreover, each coolant circuit should preferably extend across essentially the entire extent of the evaporator board of this first storage zone, so that there are no areas on this evaporator board which are cooled essentially by only one of the two coolant circuits.
In order to control the coolant distribution, it is expedient for a shut-off valve to be disposed in each coolant circuit upstream from the storage zones.
Said shut-off valve is preferably a solenoid valve.
An evaporator for a refrigeration device of the type described above is characterized in that it has two separate coolant lines, i.e. which do not communicate with one another, on a shared board.
An injection site is expediently formed in each of these coolant lines.
Further features and advantages are explained in the following description of exemplary embodiments with reference to the attached diagram.
Fig. 1 shows a schematic diagram of an inventive refrigeration device.
Fig. 1 is a schematic frontal view of a refrigeration device having three storage zones, a freezer compartment 1, a cool-fresh compartment 2 and a normal refrigerator compartment 3. The freezer compartment 1 and the normal refrigerator compartment 3 are each allocated a swivel-mounted door 4, 5, shown in the open position. The normal refrigerator compartment 3 is usually closed by a front panel of a removable drawer. The drawer is not illustrated in the diagram to enable the rear walls of all three compartments 1, 2, 3 to be shown. An evaporator 6, 7, 8 for cooling the corresponding compartment 1, 2 or 3 is disposed on each of these rear walls, on the foam side and therefore not visible. The evaporators 6, 7, 8 are each shown as dashed outlines. They are constructed, in a manner that is known per se, from a flat board made of metal, for example aluminum sheet, which fits against the rear wall of the corresponding compartment, and a second metal panel connected flat against this board, in which grooves forming the coolant lines are embedded; alternatively the coolant lines may also be formed by means of pipelines fastened to the board.
On the board of the freezer compartment evaporator 6, two coolant lines 9, 10 run alongside one another in a meandering pattern from an injection site 11 or 12 to an outlet 13 or 14 respectively. Both coolant lines 9, 10 extend essentially across the entire height and width of the board, so that its entire surface can be cooled efficiently both by the coolant line 9 and by the coolant line 10. The evaporator 7 of the cool-fresh compartment 2 is connected to the outlet 13; the evaporator 8 of the normal refrigerator compartment 3 is connected to the outlet 14. The evaporators 7, 8 are connected to a compressor 16 via a shared suction line 15; the compressor 16 feeds the two coolant lines 9, 10 of the freezer compartment evaporator 6 via a condenser 17, a pressure line 18, a solenoid valve 19 and capillaries 20, 21, which flow to the injection sites 11, 12 in the coolant lines 9 and 10 respectively.
In a first position of the solenoid valve 19, said solenoid valve connects the pressure line 18 with the coolant line 9 of the freezer compartment evaporator 6 and with the evaporator 7 of the cool-fresh compartment 2 connected to it in series, whilst the line 10 is shut off. In this state the cooling capacity of the circulating coolant is distributed to the freezer compartment 1 and the cool-fresh compartment 2 in a first proportion predefined by the construction of the refrigeration device.
In a second position of the solenoid valve 19 the line 9 is shut off whilst the line 10 and the evaporator 8 of the normal refrigerator compartment 3 connected to it in series is supplied. Thus the cooling capacity of the coolant is distributed in a second proportion to the freezer compartment 1 and the normal refrigerator compartment 3.
In a third position of the solenoid valve 19, both coolant lines 9, 10 of the freezer compartment evaporator 1 and the evaporators 7 and 8 respectively, which are connected with them in series, are supplied with coolant simultaneously. The flow of coolant through the freezer compartment evaporator 6 is therefore higher than in the two previously mentioned positions of the solenoid valve 19, yet this does not result in significantly greater cooling of the freezer compartment evaporator 6. Thus, in this position, the distribution of the cooling capacity is shifted in each of the two parallel coolant circuits in favor of whichever compartment, 2 or 3, is downstream. It is therefore possible for the dimensions of the evaporators 6, 7, 8 and of the insulating material strengths surrounding compartments 1, 2, 3 to be dimensioned in each case so that, if the parallel coolant circuits are only operated non-simultaneously, i.e. are operated only in the first two positions of the solenoid valve 19, this results in the freezer compartment 1 being somewhat overcooled if the other two compartments 2, 3 are each regulated at a target temperature. This excessive cooling of the freezer compartment 1 may be prevented, however, by the two parallel coolant circuits being supplied simultaneously in the third setting of the solenoid valve 19. Thus the temperatures in the three compartments may be effectively controlled independently of one another, without it being necessary for the quantity of circulating coolant to be temporarily reduced and thereby causing the coolant circuit to be inefficiently underfilled.
Claims
1. Refrigeration device having three storage zones (1, 2, 3) that are insulated from one another and are cooled by means of evaporators through which a coolant flows, wherein a first coolant circuit (9, 7) extends through a first (1) and a second (2) of the three storage zones, characterized in that a second coolant circuit (10, 8) parallel to the first coolant circuit (9, 7) extends through the first and the third of the storage zones (1, 3).
2. Refrigeration device according to Claim 1, characterized in that the first storage zone (1) is the upstream storage zone in both coolant circuits.
3. Refrigeration device according to Claim 1 or 2, characterized in that the first storage zone (1) is the coolest of the storage zones (1, 2, 3).
4. Refrigeration device according to one of the above claims, characterized in that the coolant circuits (9, 10) in the first storage zone (1) are guided via an identical evaporator board.
5. Refrigeration device according to Claim 3, characterized in that each coolant circuit essentially extends across the entire extent of the evaporator board of the evaporator (6) for the first storage zone (1).
6. Refrigeration device according to one of the above claims, characterized in that a shut-off valve (19) is disposed in each coolant circuit upstream from the storage zones (1, 2, 3).
7. Refrigeration device according to Claim 6, characterized in that the shut-off valve (19) is a solenoid valve.
8. Evaporators for a refrigeration device according to one of the above claims, characterized in that it has two coolant lines (9, 10) that are not connected to one another, on a shared board.
9. Evaporator according to Claim 8, characterized in that an injection site (11, 12) is formed in each of the coolant lines (9, 10).
