Source text - German Es wäre trotz der Bedeutung der Kodifikationsidee unrichtig, die deutsche Rechtsordnung einseitig als gesetzesgeprägt anzusehen und sie etwa rich-terrechtlich akzentuierten Systemen besonders des anglo-amerikanischen Rechtes strikt gegenüberzustellen. Auch in der deutschen Rechtsordung besitzt das Richterrecht, also die in der Rechtsprechung entwickelten und konkretisierten Rechtssätze, ganz erhebliches Gewicht. Dies gilt zunächst wegen der Notwendigkeit, das Gesetzesrecht auszulegen und zu konkreti-sieren, weil es niemals alle in der Praxis möglichen Fälle vorausdenken kann. Oft vermeidet auch der Gesetzgeber eine allzu konkrete Entscheidung über eine Sachfrage und überläßt die Rechtsentwicklung bewußt der Rechtsprechung.
Translation - Swedish Trots den betydelse som idén om kodifiering har skulle det vara fel att klassificera den tyska rättsordningen som ensidigt lagstyrd och därmed ställa den i motsats till common-law-systemen. Även i den tyska rättsordningen spelar domarrätten, d.v.s. de vid rättskipningen utvecklade och konkretiserade rättssatserna, en stor roll. Det beror främst på att det är nödvändigt att tolka och konkretisera lagarna, därför att lagstiftaren inte kan förutse alla i praktiken förekommande fall. Ofta har lagstiftaren också undvikit ett alltför konkret avgörande i en sakfråga och överlåter medvetet utvecklingen av rätten till domstolarna.
