Source text - German EINVERSTÄNDNISERKLÄRUNG DES HAUPTDARSTELLERS
Der nachfolgende Text stellt einen Vertrag zwischen XYZ („Agentur“), die im Namen des Kunden agiert, und _____________ („Künstler“), der seine Dienstleistungen im Zusammenhang mit der oben aufgeführten Kampagne anbietet, dar.
1. ARBEITSSESSION. Der Künstler tritt im Rahmen der oben aufgeführten Kampagne auf, die an einzelnen und/oder allen Tagen vom 15. bis 17. Januar 2009 („Drehtage“) in und um Amsterdam, Niederlande, gedreht wird. Der Künstler bietet seine Dienstleistungen als Hauptdarsteller an und wird somit im Rahmen der Produktion der oben aufgeführten Kampagne gefilmt/fotografiert.
2. ENTGELT. Pro Drehtag, an dem der Künstler auftritt, erhält er ein Honorar von _____________ („Session-Honorar“); in diesem Honorar inbegriffen sind Reisekosten, Überstunden, Sozial-/Krankenversicherungsbeiträge, jegliche Steuern sowie die Provision des Agenten für die oben aufgeführte Arbeitssession. Jegliche Zahlung unter diesem Vertrag wird von _________________ („Agent/Produktionsfirma“) an den Künstler innerhalb von 30 Kalendertagen nach dem letzten Drehtag und nach Empfang des vom Künstler unterzeichneten Endvertrags geleistet. Der Künstler stimmt zu, dass er sich im Zusammenhang mit jeglicher Zahlung unter diesem Vertrag ausschließlich an Agent/Produktionsfirma wendet. Der Künstler erkennt an, dass die Zahlung der oben genannten Summe die volle Bezahlung für die Arbeitssession darstellt und er keine weiteren Zahlungen im Zusammenhang mit dieser Kampagne erhält, es sei denn, der Künstler wird in der endgültigen, editierten Fassung des/der Werbespots gezeigt; in diesem Fall trifft die nachfolgend in Punkt 3 aufgeführte Regelung zu.
3. NUTZUNGSRECHTE. Der Künstler gewährt hiermit der Agentur und/oder dem Kunden das Recht, den Auftritt des Künstlers, der im Rahmen der Arbeitssession im Zusammenhang mit der Kampagne erfolgt, unter den folgenden Bedingungen zu nutzen. Der unten aufgeführte Betrag wird nur dann an den Künstler bezahlt, wenn dieser auch in der Endversion der Kampagne erscheint/gezeigt wird:
a. LAUFZEIT. Die Laufzeit dieses Vertrages beginnt mit der ersten Ausstrahlung des/der Werbespots und läuft ein (1) Jahr nach diesem Zeitpunkt ab, wobei vorausgesetzt wird, dass die Agentur und der Kunde den/die Werbespot(s) sowohl in Archiv- und PR-Shows/Sendungen/Darbietungen wie auch in Shows/Sendungen/Darbietungen, in der Branchenauszeichnungen verliehen werden, auf unbegrenzte Dauer nutzen darf.
Translation - English DECLARATION OF AGREEMENT OF THE MAIN PERFORMER
The following text establishes a contract between XYZ (the „Agency“), acting in the name of the Client, and _____________ (the “Artist”), who offers his services in connection with the above-mentioned campaign.
1. WORK SESSION. The Artist shall perform in connection with the above-mentioned campaign which is to be filmed on any or all days from the 15th to the 17th of January 2009 in and around Amsterdam. The Artist is offering his services as the principal performer and will be filmed/photographed within the production of the above-mentioned campaign.
2. COMPENSATION. The Artist shall receive an honorarium in the amount of ________________ („session honorarium”) for each day of filming; this honorarium shall be understood to include travel expenses, overtime, social security payments and health insurance premiums, all applicable taxes as well as the accommodation of the Agent for the duration of the above-mentioned work sessions. All payments under this contract shall be made to the Artist by _____________________ (“Agent/Producer”) within thirty calendar days following that last day of filming and after receipt of the final contract signed by the Artist. The Artist recognizes the fact that payment of the above-mentioned sum constitutes full payment for the work session and that he has no claim on any further payments in connection with this campaign, except in the case in which the Artist is shown in the final edited version of the advertizing spot; in which case the rule stated in Point 3 would come into play as follows.
3. RIGHT OF USE. The Artist herewith grants the Agency and/or the Client the right to use the Artist’s performance which was given in the context of the work session connected with the campaign under the following conditions. The amount mentioned below will only be paid to the Artist if he appears or is shown in the final version of the campaign.
a. TERM OF VALIDITY. The term of validity of this contract shall begin with the first broadcast of this advertising spot and shall expire one (1) year after this point in time, whereby it is to be assumed that the Agent and the Client may use the/these advertising spot(s) for an unlimited period of time in shows, broadcasts and/or performances of an archival or public relations nature as well as in shows, broadcasts and/or performances for the purpose of industrial labeling.
