Discussion

writeaway Feb 23, 2012:
this is very basic legal terminology found in ordinary dictionaries. US and UK English will be the same. A hearing is a hearing and conciliation is conciliation. In everyone's English
AllegroTrans Feb 22, 2012:
Not a uniquely French procedure at all Conciliation hearings are now an established part of the divorce procedure in the English County Courts. Many jurisdictions worldwide have similar procedures.

I agree, I think it's a uniquely French procedure. I know of no comparable procedure in the U.S., at least not in the jurisdiciton where I worked.

*** Addendum ***

As an update to my comment, my home state, Michigan, now has conciliation hearings for divorces involving children, but only for the purpose of trying to come to an understanding regarding the children, NOT to try to salvage the marriage.

http://courts.michigan.gov/scao/resources/publications/manua...

At least one state, Ohio, provides the OPTION (unlike French law, where apparently it is mandatory, under threat of a default judgment) for either party to request conciliation, either to try to preserve the marriage itself or to resolve other, non-relationship issues in order to avoid court.

I'm afraid I can't speak for US usage, however in any case this relates to a procedure in French law and not English law, so I suspect it may be the same

the translation has to be in US english, is it the same expression in US? Thank you

first hearing

in divorce proceedings, during which the judge may try to reconcile the couple and/or decide what steps to take next

http://www.maitretoubkin.com/english/articles/french-divorce...
Each spouse will need to be represented by a lawyer so as to ensure that they are freely consenting to the divorce. The spouse and their respective lawyers will be asked to attend a first hearing during which the family judge will attempt to reconcile the spouses (“Ordonnance sur tentative de reconciliation”). If the judge fails, he or she will order temporary and/or urgent measures to be followed pending the divorce itself.
Peer comment(s):

neutral AllegroTrans : it may well be the first hearing but I do not regard this as the correct translation for what is clearly a conciliation hearing - why not convey the fact in the translation?

you can say first or initial "conciliation" hearing. The procedure in France overall, however, is very different to that in the UK, at least.
