Jednatelství bez příkazu, (§742 OZ) je právní úkon, při němž určitá osoba obstará cizí záležitost, za účelem odvrácení hrozící škody, aniž je k tomu oprávněna. Ten, jehož záležitost byla takto obstarána, je povinen nahradit jednateli bez příkazu nutný náklad, a to i v případě, že se výsledek (tj. škoda) bez zavinění nedostavil.
