Law/Patents - Law (general) / Reply to a statement of defence in a fraud case
German term or phrase: Tatbeitrag
Hi all,

I'm translating a Reply to a statement of defence in a fraud case and the term "Tatbeitrag" appears in several instances. I am not sure what the best translation into EN would be here. Below some context:

Thanks in advance!

contribution to the offence
Explanation:

It is true that the senior position held by the defendant may give a special significance to his/her contribution to the offence.

agree  Björn Vrooman: "In determining whether an offense is not 'otherwise serious,' the court should consider (1) the offense as a whole, and (2) the defendant’s individual contribution to the offense." One example of five that can be found at [Edit: put in d-box].

active rôle in a civil or criminal fraud

Explanation:
It's not very clear to me why, unless there is a Nebenklage in a criminal fraud case or a private Treuhandfonds embezzlement/ misappropriation case, there is a statement of defence that could equally apply to a civil claim (as could do in US law & equity - Barron's US law dictionary, plus in the law of tort, crime & equity - a power of attorney fraud etc. - in England & Wales).

There seems to be a general assumption that this is a criminal case governed by e.g. the DEU/CH, LIE or AUT Strafgesetzbuch.

action/act

Explanation:
actions/acts of the defendant

--------------------------------------------------
Note added at 24 mins (2019-12-10 20:18:19 GMT)
--------------------------------------------------

well "defendants" in your context as its "der Beklagten"

--------------------------------------------------
Note added at 25 mins (2019-12-10 20:19:11 GMT)
--------------------------------------------------

and should read "it's" of course

--------------------------------------------------
Note added at 28 mins (2019-12-10 20:22:52 GMT)
--------------------------------------------------

and with "contributing to the offence (UK) offense (US)"

a bit untidy so here's a cleaner draft:

actions/acts of the defendants contributing to/bearing on the offence/offense"

--------------------------------------------------
Note added at 30 mins (2019-12-10 20:24:50 GMT)
--------------------------------------------------

"contributory acts/actions" as alternatives as per:

Angesichts der Unklarheit der Beweisführung liege eine Verletzung der Verteidigungsrechte vor, denn die Kommission müsse klar und eindeutig erkennen lassen, welche Tatbeiträge sie welchem Unternehmen zurechne und welche Konsequenzen dies habe. eur-lex.europa.eu
In light of the unclear appraisal of the evidence, there is an infringement of the rights of the defence, as the Commission is under an obligation to indicate, in a clear and unequivocal manner, which contributory acts it attributes to which undertakings and the consequences thereof.

this last example is from eur-lex and I always give their examples some credence

--------------------------------------------------

as you have several mentions of the term, you can jiggle around with your rendering as you see fit but this is the overall idea

I see everybody is giving you answers to your full context but you only (and correctly) asked for a translation of "Tatbeitrag" so see what you do ...

--------------------------------------------------
Note added at 4 hrs (2019-12-11 00:31:15 GMT)
--------------------------------------------------

this is a grey (UK) gray (US) area and I have often given answers regardless, so up to you
