We recently filed an amended Statement of Claim in the case, which was necessary given the decisions already made by the Court. We had preferred to have discussed this matter with you in detail in person with the assistance of either Lyn Meng, or Mark Lee, or preferably both before writing this letter, but that has not been possible because of your absence overseas. We refer to the enclosed copy of the amended Statement of Claim. You will not understand this completely, or the reasons for it, but accept our assurances that the amendment was necessary and arises specifically because of the last decision of the Court, which granted you permission to build on your section, leaving unresolved the outstanding matter of compensation to you for the possible reduction in value of the section, because of the difficulty you may have when you come to sell it on account of the land covenant, and the costs (fees) you have incurred in having to bring this proceeding.
