Ne bih mogao tvrditi da je to razlika između US/UK engleski. Evo još nekoliko citata gde se čini da se u američkom engleskom koriste oba izraza u oblasti prava:

Što se tiče "extenuating circumstances" ako pogledate na Google (http://www.google.com/search?q="extenuating circumstances"&i... pojavljuje se 1.180.000 puta naspram samo 318.000 puta za "mitigating circumstances". Medjutim, zanimljivo je što u prvih stotinak slučajeva na Google-u, osim Wikipedije, ne koristi se u pravnom kontekstu, već se najčešće tiče akademskog života. Ako neko može dodatno da rasvetli ovo, dobrodošao.

Mislim da su ovo sinonimi i da nema razlike.
In law, extenuating circumstances are criminal cases in which, though an offence has been committed without legal justification or excuse, its gravity, from the point of view of punishment or moral opprobrium, is mitigated or reduced by reason of unusual or extreme facts leading up to or attending the commission of the offence.
Mitigating circumstances: Circumstances that may be considered by a court in determining culpability of a defendant or the extent of damages to be awarded to a plaintiff. Mitigating circumstances do not justify or excuse an offense but may reduce the severity of a charge. Similarly, a recognition of mitigating circumstances to reduce a damage award does not imply that the damages were not suffered but that they have been partially ameliorated.
Extenuating circumstances: Facts surrounding the commission of a crime that work to mitigate or lessen it.
Extenuating circumstances render a crime less evil or reprehensible. They do not lower the degree of an offense, although they might reduce the punishment imposed.
