Some KudoZ entries have already been made, albeit without really analysing the Anglo-Am. contractual vs. tortious backdrop and using pledge which would, misleadingly in this case, suggest giving a co. charge or mortgage.

Gullberg also features undertaking which fits well with the lämna verb and 'den starkaste formen av ett åtagande' label: given undertakings vs. made representations.

I'm unsure bloagen as corps. can give a 'personal' undertaking, so I've prefixed with binding in this context.

Covenants are usually given in leases and in a land sale scenario.

Express statements is OK, whilst I believe the antithesis = negligent mis-statements in tort vs. contractual or criminal mis-representations would be the English way of looking at the end-effect if things go wrong.

jämföra med en garanti: I assume you are translating the latter as a (BE) guarantee/(AE) guaranty or warranty. That's why I never suggested (express) contractual warranties for the term.

Also there is a moot point: the latter in contract is a minor term and a condition a major term whereas, in UK insurance, it is the OTHER way round!
