Separation Agreement
По смыслу понятно, что Соглашение о раздельном проживании и разделе имущества может быть приложено к решению суда. Авторы Соглашения не хотят, чтобы это Соглашение "слилось" (ищу правильный термин) с этим решением суда, а хотят чтобы оно было его самостоятельной частью.
Вот все предложение:
If any action for divorce is hereafter instituted by either party against the other, this Agreement may, if desired, be submitted to the Court in such action for approval and incorporation in a decree should one be granted; but this Agreement shall be independent of, *** not merged with ***, nor dependant for its effectiveness upon such approval or incorporation, nor be otherwise affected thereby.

Тут надо развести "incorporated but not merged". Конкретно я так понимаю, что его надо включить путем отсылки (суд утвердил соглашение между сторонами от ...), но нельзя его содержание переписывать в текст решения суда, чтобы оно могло действовать, даже если решение суда будет, например, отменено.
