English term

not covered

Exclusions and limitations:
-....
-...
-Any services or supplies provided to any person not covered under the Agreement in connection with a surrogate pregnancy."

Question: 1. if "in connection with a surrogate pregnancy" modifies "Any services or supplies"?

2. if "not covered" modifies "any person" or "services or supplies"?

Thank you Eris, for your detail analysis.
Erisu Jun 30, 2009:
Shirley, thanks for the link. I agree with all of the participants in that forum thread. It sounds like the insurance would not cover any costs incurred with a surrogate pregnancy if the surrogate mother is not the one insured (thus "provided to any person not covered") but would cover the costs if the SM is the one insured under "the Agreement". But yes, it is indeed a confusingly worded sentence. I just personally feel that if it is meant any other way, the sentence's grammar would be too strange and doesn't sound natural. Leave it up to the insurance companies to make a simple sentence confusing.

Peggy, would you mind advising us as to the occurences of "Agreement" in this document? (From the references I've found, the context seems to come from the insurance plans provided by Anthem Blue Cross. And the "Agreement" only appears once in each plan of them.)

(Please see Explanation below.)

1.“In connection with surrogate pregnancy”在此似乎是修飾 “the Agreement"。
如果 “Agreement” 是指本合約,一般我們會說 “under this agreement”,但是這裡卻用“under the agreement”。

Surrogate Maternity And Cycle Medical Plans
http://www.newlifeagency.com/forms/SMC_BRO.pdf

2. "not covered" 有可能是修飾 “Any services or supplies" (不在...保險給付範圍之內的醫療服務或是或醫療用品)

("not covered" 如果是修飾 any person 的話,這個人本來就沒有保險,如果將其列為 limitations 和 exclusions 條款的一項,邏輯上好像有點說不通。)

有關 “not covered” 修飾 “services” 或 “supplies”,請參考以下文件:

http://www.pcmiservices.com/documents/benefits/Young-Adult-B...

Thank you very much, Peggy for the clarification.
Note from asker:
Thank you so much, Shirley for pointing out the most confusing 2 points and offering explanation:) I asked the client. They said 1. "in connection with a surrogate pregnancy" modifies "Any services or supplies" 2. "not covered" modifies "any person" I agree with your rationale with your second point. I am checking with them again. And thanks Eris, for your contribution to the discussion:)
Peer comment(s):

neutral Erisu : Nice food for thought. 再者,如果"not covered"要修饰"services/supplies"的话,在此次的情况下,如果不用 "which are not.."

Thank you, Eris, for your comment. The statement itself is confusing. Even native speakers would feel confused too, I guess. Please see http://www.surromomsonline.com/support/archive/index.php/t-1...
